As of January 1 2010 all transactions on real estate deals in Bulgaria will be conducted via bank transfers, according to an amendment to the Notary Act put forward by the Justice Ministry. If approved by Parliament, the change will ban all real estate payments made in cash.

The amendment's aim, first raised a year ago, is to reduce real estate fraud and money laundering. The move is part of the Ministry's policy of adopting legislative amendments to a number of laws as a way of reducing corruption and crime as well as ensuring that all fees and taxes owed to the state are paid.

The highlight of these efforts will be the adoption of a Law on State Depositary Bank which would serve as a guarantee for all payments in the form of the state acting as custodian for deposits. It will not have the functions of a commercial bank, hence it will not appear as their competitor, the draft bill says, according to Bulgarian-language Dnevnik. It will not charge interest but will levy a certain fee on every deal.  

The idea is that it would be used by notaries and lawyers irrespective of the deal, whether it be the purchase of real estate or a vehicle or other transfer of ownership or bankruptcy.     

The draft bill adopts France's experience where there is a similar model, Dnevnik said. The main advantage of such a deposit bank is that it would cut down on fraudulent deals and tax evasion.

The risk is that there will be a waiting period during which the money subject to the deal will be blocked at the deposit bank. The French experience shows that this period can be about 25 days during which the seller cannot touch the money. Another setback is that the deposit bank will keep a fee for servicing the transactions. So clients will have to pay yet more money, Dnevnik quoted real estate brokers as saying.

Many people are willing to risk not reporting the real amount of the sum as long as it saves them taxes, Biserka Marinova, owner of real estate agency Lega Real, told Dnevnik. Tax authorities and the National Revenue Agency have worked hard over the past couple of years to curtail this negative practice.

The new regulations will without a doubt complicate matters, she said. One such complication will be the combination of having a bank loan as the means to fund the deal and the waiting period to get them from the depositary bank. And there is the question of the funds required for the setting up of the new state body and its staff.

For now, that idea is at the draft bill stage but judging by the regular pronouncements by Justice Minister Margarita Popova and Finance Minister Simeon Dyankov on the subject, it could become reality by the end of the year.

Sofia's New Mayor
The First Woman Mayor 
fandukovaYordanka Fandukova, from the ruling Citizens for the European Development of Bulgaria, (GERB) won a clear victory in the battle to become Sofia's mayor, winning 66.1 per cent of the vote as opposed to the Socialist Party candidate Georgi Kadiev's 26.5 per cent, according to exit polls.

Fandukova, a former school headmistress, won the election in the first round outright, precluding the need for a second round runoff. With her victory, she becomes the first woman mayor in Sofia's history.

Speaking after her victory, Fandukova said that her victory underlined support for the previous mayor. She also thanked other right-wing parties for not standing against her in the contest.

Prime Minister Boiko Borissov, speaking alongside Fadukova at a post-election news conference, said that the former education minister would carry on her predecessors' good work at the Sofia mayor's office. Borissov took the opportunity to take a swipe at the previous BSP administration for incompetent governance that, he claimed, resulted in Bulgaria losing EU funds that should have gone on infrastructural projects.

Former socialist prime minister Sergei Stanishev, as well as Kadiev, the defeated candidate, explained the poor result by citing the low turnout. Stanishev, in particular, attributed this to voters being put off by the current Government. He said that Kadiev had fought a courageous campaign in which he had pointed out the wrongoings in Sofia's local government.

Because the Bulgarian law still does not allow foreign nationals to own land, the majority of investors are purchasing their properties through a company registered in this country. However having a company is a serious issue and investors must accept seriously the requirements of the tax law, which is quite strict and conservative. During the recent years the tax authorities have become quite active and regular checks are performed with or without a reason. Even if your company is registered just to own a property and not actively trading, it is still subject to control and inspection by the local tax officers.  Each company (including the dormant ones) is obliged to prepare an annual tax report for its business activities and submit it to the local tax office before 31st March each year. The fines for not submitting the annual tax declaration on time start from 500 Levs (approx. 250 Euros).  For dormant companies (registered only to own a property), or companies without any activities we charge an annual fee which will cover the annual tax report and submission to the local tax office.
If your company is operational the charge is paid monthly and is subject to additional negotiation, depending on the amount of work required.

Tax Official Sacked
After Diverting 172,000leva to his sons bank account! 
levaTwo National Revenue Agency employees from Sofia will face charges of embezzlement after diverting 172 000 leva, private broadcaster bTV said on November 13 2009.

The two worked on the case of a company which had to be reimbursed 172 000 leva of value-added tax. When the file had to be closed so the the company could get its tax refund, one of the employees replaced a sheet of paper in the file's folder, changing the company's bank account details with an account held by his son.

The scam was revealed two days later after an internal check showed that there was a discrepancy in the details of the two bank accounts. Fortunately for the NRA and the company, the money was recovered.

The two NRA officials, however, were fired with cause and their case was sent to prosecutors, who are expected to press charges. Six NRA employees in Sofia have been fired in the past six months over corruption allegations as a result of internal investigations. space) prices have declined by 26% year-on-year; they reached their peak in the fourth quarter of 2008.
