The Dos and Don'ts of Pre-Hire Screening
This presentation will provide guidance on how you can use pre-employment screening tools in your hiring process to avoid potential legal exposure. We will explore the legal and practical considerations of tools such as back-ground and credit checks and testing, including when and how you can use background or credit check results to disqualify applicants and what you need to do before and after you implement pre-employment tests.

Why I Sue You
Tod Schleier, a prominent Phoenix plaintiff's lawyer, will provide an inside look into why and how he chooses certain cases and declines others (his thought process includes more than just failures to follow the law, as he will cover how the treatment of employees often plays a significant role in his cases). Mr. Schleier also will discuss how you can avoid being one of his targets.

ADA Update
This session will examine ADA topics that have been receiving heightened agency and court attention. Such areas included automatic terminations of employees on extended leave, attendance policies that penalize absences that may be FMLA or disability related, and requiring full releases of employees returning from leave. We will also cover ADA and FMLA interplay.

Who's Protected Now?
This segment will provide an analysis of recent cases and EEOC guidance that seem to have expanded Title VII and
other federal employment discrimination laws to grant protection for certain groups of people, such as transgendered individuals and breast-feeding mothers. We will highlight non-traditional categories of individuals that courts and the EEOC are currently focused on, as well as provide employers with tips and advice for maintaining an
equal employment opportunity workplace.

This presentation will focus on the EEOC mediation program, specifically its separation from other EEOC units, differences between EEOC and private mediations, when to bring counsel, whether or not to have Internal Grievance
Programs and Arbitration Agreements, and the differences between mediation and arbitration.
