| Two new federal tax credits |
Within the last few weeks, Congress has enacted two tax incentives that apply to nonprofits, one to reward hiring of new staff and another to help smaller organizations pay for health insurance. To help our members know about these new laws, NDANO offers you the following information with links for more details: Hiring incentive tax credit
The first new law allows nonprofits of all sizes and other employers to keep the 6.2 percent payroll taxes they typically would pay on certain new hires. The incentive is only available for a short time, and it applies to only certain newly hired workers. Learn more about the HIRE Act and its impact on nonprofits. This payroll tax forgiveness provision expires at the end of the year, so you will save more the sooner you hire eligible unemployed workers. Small employer health credit
The new health care reform law lets smaller nonprofits claim up to a 25 percent tax credit when they pay for at least half of the health insurance premiums for their employees. To claim the credit, the nonprofit must have 25 or fewer full-time employees who earn less than $50,000 in average wages, and the nonprofit must pay at least 50 percent of the insurance premium cost for employees. Eligible nonprofits can start claiming the credit as early as when they file their second quarter payroll tax returns. Your organization may soon be receiving a postcard from the Internal Revenue Service providing information about the small employer credit. Does your nonprofit organization:

*Have regular interaction between your staff and your clients?
Is the topic of Americans with Disabilities Act (ADA) guidelines a mystery to you? If you answered "yes" to any of these questions, you could be at risk for a third party lawsuit. At the heart of many nonprofits is the desire to serve. While the goal of a nonprofit is to focus on a well-defined demographic, others in need can interpret their exclusion as discrimination. Even though the nonprofit may have valid reasons for turning away a client, it may violate the law. A nonprofit could find itself in the middle of an expensive lawsuit. Third party lawsuits
By definition, the insurance company is known as the insurer, and the organization protected by insurance is known as the insured. The insurer and insured are considered the first and second parties of an insurance contract. When someone sues the insured, they become the third party and the resulting lawsuit is known as a third party lawsuit. Below is an example of a third party lawsuit: A class action lawsuit was brought against an organization that assisted women seeking refuge from domestic violence. A group of men claimed they had often been denied services. Although the lawsuit was deemed to be without merit, it required a strong defense. The case was ultimately dismissed, but the defense costs exceeded $100,000. Public accommodation lawsuitsNonprofits that provide housing assistance for their clients are particularly vulnerable to third party lawsuits. The ADA addresses specific guidelines for public accommodation. Disabled clients may rely on a nonprofit to assist them in finding suitable housing. While the nonprofit may have done its best to find favorable accommodations, disabled clients may have difficulty with movement in the residence, accessing counters or sinks or using improperly outfitted bathrooms. In other instances, clients may be denied counseling or rehabilitation services due to a mental illness or past history with the organization. These are all situations that can lead to a public accommodation claim - a more specific type of third party claim. It is important to be aware of all laws regarding services to the public. Failure to comply with these laws could result in significant risk. Nonprofits do not have to face these risks alone. | IRS update |
Don't throw away your tax-exempt statusMost tax-exempt organizations, other than churches, must file an annual return or notice with the IRS. If an organization does not file as required for three consecutive years, the law provides that it automatically loses its tax-exempt status. The IRS has posted new FAQs and an audio interview discussing the automatic revocation of tax-exempt status for failure to file on IRS.gov. Revised publication on taxation of unrelated business income releasedThe IRS recently released a revised edition of Publication 598 (rev. March 2010), Tax on Unrelated Business Income of Exempt Organizations. The popular publication explains the rules that apply to the taxation of unrelated business income, including the types of organizations that are subject to the tax and how to figure unrelated business taxable income. It also highlights changes that include:
- Increases in the maximum cost of a low-cost article and dues of agricultural organizations and business leagues,
- The expiration of the five-year carryback election for losses on total capital expenditures, and
- The expiration of qualified cash contributions for relief efforts in Midwestern disaster areas.

Value of volunteer time
The estimated dollar value of volunteer time for 2009 is $20.85 per hour, according to Independent Sector. North Dakota's average dollar value of volunteer time was $16.03 in 2008. Charitable organizations can use this estimate to quantify the enormous value volunteers provide. This value of volunteer time information can be used on financial statements-including statements for internal and external purposes, grant proposals and annual reports-only if a volunteer is performing a specialized skill for a nonprofit. Northwest Venture Communities Inc. (NVCI) is a nonprofit organization working to build prosperity through the reduction of poverty in northwestern North Dakota.
