THE COUNTDOWN TO SINE DIE HAS BEGUN

With only two legislative days remaining in the 2010
Legislative Session, both houses are working feverishly on remaining
issues. On Tuesday, the House of
Representatives worked into the evening hours on its special order calendar,
adjourning after 9:00 pm. The
Senate blazed through a 20 page special order calendar the same day. The final two days will be packed with issues directly
affecting the HBAA. SB 412
(Ross, Montgomery)passed the Senate this
week and has moved to the House for consideration. You will remember that this bill addresses the development
finance issues that have arisen from the recent Kilgore case ruling. Representative Marcel Black, Chairman
of the House Judiciary Committee, has agreed to hold a committee meeting so
that SB 412can be reported back for a second reading on Wednesday. Several members of the House Rules
Committee have expressed support for the bill and will be actively working to
have the bill placed on the special order calendar for the final day, and the
HBAA feels confident that that will happen. The HBAA was able to amend the Alabama Association of
Realtors - supported HB 701(Greeson, Ider) to ensure that the right of
redemption period on residential property and developments remains at one
year. The bill originally sought
to reduce the period on commercial loans to 90 days; however, that was
increased to 180 days. Since
residential development loans are considered "commercial", the HBAA made the
amendment clarifying that residential property was not commercial for purposes
of the act. The bill now moves to
the Senate for consideration. Several other bills of interest to the HBAA
remain in play and could be considered next week. The HBAA will be monitoring all of these closely as we get
down to the wire on the final days of the 2010 Legislative Session.

HBAA SALUTES RETIRING SENATORS

HBAA joined with other industry groups and lobbyists on
Tuesday to salute those Senators who have chosen to retire from the Senate this
year. The reception served as a
non-partisan celebration of the leadership that each brought to the Senate
during their time in Montgomery.
