Affirmative Action Plans: Compliance Reviews on the Increase

The news from the Department of Labor's (DOL) is that their proposed Fiscal Year 2010 budget requests an additional $23.6 million and 213 full time employees for the Office of Federal Contract Compliance Programs  (OFCCP) to augment field office staff and increase the number of compliance evaluations and complaint investigations. This increase represents a 36.4% increase in the OFCCP staff size compared to FY 2009.
 
The OFCCP's stated goal is to continue to increase the number of compliance reviews they perform. 
 
Are you prepared?

If you are a government contractor or subcontractor you are required to have affirmative action plans for Females and Minorities, and for Disabled and Veterans in place.
The OFCCP requires Companies that hold Government Contracts of $50,000 or more and employ at least 50 people to complete an annual written AAP for each location.
By preparing and updating your plans on an annual basis, you can avoid significant stress and panic if you are notified that any these documents must be presented in a short timeframe.
 
Make sure that you are ready if you receive:

  • A letter notifying you of an OFCCP Compliance Review or  Desk Audit that provides a 30 day turnaround to submit your written Affirmative Action Plans.
  • A call or letter scheduling an onsite Compliance Check which is usually set up with only a few days notice, requiring EO/AA data and related information to be collected immediately.
  • A state government bid, as many have affirmative action program requirements and tight submission deadlines.
  • Any of the above that have been sitting in the mailroom, on a vacationing employee's desk, or just "floating around" the company causing your response time to shrink considerably.
An AAP can be written using any complete year timeframe. Some companies write their plans to match the date of their EEO-1 or at the beginning of a quarter, although, the preferred effective date for a plan is January 1. By making your AAP effective at the beginning of the year, it will be easier to collect, track, update, store and retrieve the relevant data.  It will also give you the opportunity to audit your employee records each year to ensure the data is correct and current.
