2009 Benefit Review

A number of new laws and regulations will affect the design and administration of group health plans beginning 2009. This article briefly highlights some important employee benefit issues that should be addressed early in 2009.

Changes to I-9 Procedures

What? Another I-9 change? Will this ever end? I just implemented a change a few months ago. What in the world is this all about?
 
Bad news - another change. Good news - it isn't that extensive.

These are words every Human Resource professional has spoken recently. Yes, we have yet another change in I-9 procedures that is effective February 2, 2009**. As of this date, the Department of Labor has not completed the M-274, the Handbook for Employers that explain the changes.
 
A summary of changes:

The rule narrows the list of acceptable documents and further specifies that expired documents are no longer considered acceptable forms of identification. Employers must use the revised Form I-9 for all new hires and to reverify any employee with expiring employment authorization beginning on February 2. 

  • Five documents have been removed from list A, including:
    • Certificate of US citizenship (Form N-560 or N-561)
    • Certificate of Naturalization (Form N-550 or N-570)
    • Alien Registration Card (I-151)
    • Unexpired Reentry Permit (Form I-327)
    • Unexpired Refugee Travel Document (Form I-571)
  • One document was added to list A
    • Unexpired Employment Authorization Document (I-766)
  • All employment Authorization Documents with photographs have been consolidated as one item on List A
    • I-688, I-688A, I-688B, I-766
  • Instructions on Section I now indicate that employees do not have to provide a social security numbering Section I unless the employer participates in E-Verify
  • Employers can now sign and retain Forms I-9 electronically.

**ANNOUNCED TODAY!  The U.S. Citizenship and Immigration Services (USCIS) announced that it has delayed by 60 days, until April 3, 2009, the effective date for using the revised Form I-9, originally scheduled to go into effect today.  Please note:  Employers who use the new form prior to the April 3, 2009 effective date are subject to civil monetary penalties.  Read more
