The City of Greenville Board of Zoning Appeals will hold a Public Hearing on Thursday, January 19, 2012 at 4:00 PM in the 10th floor Council Chambers at City Hall for the purpose of considering the following Applications: 


A. S 11-223. Application of Friends 4 Good, LLC (Pelham Commons Investors, LLC, Owner), for a Special Exception Permit pursuant to Section 19-2.3.5, Special Exception Permit, and Section 19-4.1, Table of Uses, of the Greenville City Code to establish a 'Restaurant / Bar Open After Midnight' within an existing building located at 215 Pelham Road in a 'C-2', Local Commercial, District (TMS # 0279000100800)

B. S 12-17. Application of Om Shatki, Inc. dba 'Kash and Karry' (Om Shatki 2, LLC, Owner), for a Special Exception Permit pursuant to Section 19-2.3.5, Special Exception Permit, and Section 19-4.1, Table of Uses, of the Greenville City Code to establish a 'Convenience Store' within an existing building located at 1148 Pendleton Street in an 'RDV', Redevelopment, District (TMS # 0119000200300).


C. S 12-18. Application of Greenville Hospital System for a Special Exception Permit pursuant to Section 19-2.3.5, Special Exception Permit, and Section 19-4.1, Table of Uses, of the Greenville City Code to establish a 'Visitor Accommodations' establishment within an existing building located at 1425 Augusta Street in an 'RM-2', Single and Multifamily Residential, District (TMS # 0217000100600).


D. S 12-20. Application of the International Center of the Upstate for a Special Exception Permit pursuant to Section 19-2.3.5, Special Exception Permit, and Section 19-4.1, Table of Uses, of the Greenville City Code to establish an 'Office' within an existing building located at 9 S. Memminger Street in an 'RM-2', Single and Multifamily Residential, District (TMS # 0080000400600).


E. S 12-21.  Application of Todd Ruquet (MGM Financial Corporation, Owner) for a Special Exception Permit pursuant to Section 19-2.3.5, Special Exception Permit, and Section 19-4.1, Table of Uses, of the Greenville City Code to establish an 'Auto Sales Establishment' within an existing building located at 1513 Wade Hampton Boulevard in a 'C-3', Regional Commercial, District (TMS # 0274040100800).


F. S 09-209(a).  Application of the City of Greenville in behalf of Nishant Shah (Belk Simpson Company, Owner) for an Amendment of a Special Exception Permit pursuant to Section 19-2.3.5, Special Exception Permit, and Section 19-4.1, Table of Uses, of the Greenville City Code. The Applicant requests that the Permit authorizing the establishment of an 'Auto Wash and Detailing Facility' be amended to eliminate the provision addressing expiration and extension of the Permit.  The property is located at 700 Haywood Road in a 'C-3', Regional Commercial, District (TMS # 0285000100500).


You are invited to review documents relating to these applications before the public hearing.  Documents are available for review online @ http://www.greenvillesc.gov/PlanningZoning/PlanningApplications/default.aspx or in the Planning and Development Office on the 5th floor of City Hall, 206 South Main Street, Greenville, between 8:00 AM and 5:00 PM, Monday through Friday.  You may call the Office at 864.467.4476 for more information on these applications. 


If you wish to comment upon an application, you may attend (or be represented at) the public hearing; in the alternative, you may submit written comments to Marie McClendon, PO Box 2207 Greenville, SC 29602 or by fax at 864.467.4510 or email at mmcclendon@greenvillesc.gov.  All comments will be presented to the Board for its consideration.  However, inasmuch as the Board is a quasi-judicial body, only sworn testimony can be considered in the Board's Decision.  You may speak for or against an application at the hearing where a total of ten (10) minutes will be allotted for public comment.


The criteria for the Board's decision are enumerated in the application and Staff Report.  The Staff Report will provide background on the Applicant's request and its location, the pertinent recommendations of the Comprehensive Plan (and any other plans relating to the proposal or its location), and a review of the request in the context of the specific criteria required by the City Code.  Staff will provide the Board with its conclusion on the way in which the request either conforms, or does not conform, to the criteria.  Staff may recommend stipulations to the Board for its consideration in granting the request.  Further information on the criteria for granting Special Exceptions and Variances may be found in Sections 19-2.3.5 and 19-2.3.7 of the City Code respectively (which may be reviewed online @ www.greenvillesc.gov). 


The Board will usually vote to grant or deny an application the same afternoon that it considers the evidence and public testimony; however, it may decide to continue the hearing or postpone deliberation to a future date.


After the Board votes to grant or deny an application, Staff will prepare a written Decision for mailing to the Applicant. Anyone having a substantial interest affected by the Decision may appeal to the Greenville County Circuit Court within thirty (30) days of the mailing of the Decision.  If no one appeals the Decision (or upon conclusion of the appeal process), Staff will prepare a permit for execution by the Applicant and Property Owner (if different) that will be recorded in the Greenville County Office of the Register of Deeds evidencing the Decision and any stipulations.  The permit is binding upon the property owner, successors, and assigns.
