Hopefully you are recently back from vacation and feeling more refreshed after fighting the difficult economic climate of the last few months.
 
Congress is also on vacation - in recess. But when they return they are very likely to pass the Employee Free Choice Act [EFCA] which, if your employees are not unionized, can have a significant impact upon your businesses' profits, your relationship with your employees and your employees' perception of their workplace.
 
In this month's article we'll discuss the two major decisions your employees will be making:
  • how much discretionary effort they want to expend each day?
  • whether they want to be represented by a labor union?
and how you can proactively determine what those decisions will be and manage accordingly - versus being vulnerable to the significant consequences.

Last month we discussed:
  • how your employees decide daily - often subconsciously - how Engaged and Committed they are to their jobs and your organization
  • that Engaged Employees are more productive, provide higher customer satisfaction and generate significantly more profit
  • and that your employees' level of Engagement is primarily determined by their relationship with their immediate Supervisor
 
The Second Decision Your Employees Will be Making
 
According to the National Association of Manufacturers, the Corporate Executive Board, The New Your Times, etc. in the next two months Congress is probably going to pass EFCA. Senator Harkin has said that "an agreement is "80-90% there." While the final version of the legislation is yet to be determined, those closest to the situation expect that it will include:
  • a 'quickie' election occurring just 5-10 days after the petition - giving employers very little time to react
  • employers no longer being able to persuade employees not to vote for the union in 'captive audience' presentations
  • a union organizer having access to your employees on your company property
  • should your company and the union not reach an agreement on the terms of the first contract, a government appointed Arbitrator will dictate your company's wages, benefits, etc.
So the 'bottom line' is, in the very near future it will be significantly easier for a union to organize your employees.
