OSHA Grants Additional Time on Noise Reduction Comments
OHSA has announced in the Federal Register its intent to change its official interpretation of workplace noise exposure standards and enforcement. Currently, OSHA regulates acceptable workplace noise levels in a common-sense manner, allowing employees to protect workers through "personal protective equipment" (ear plugs and ear muffs, engineering controls like noise-dampening equipment and muffling systems). However OSHA is asking for comments on its announcement requiring employers to implement all "feasible" controls - with "feasible" meaning "capable of being done"- regardless of the costs or effectiveness of currently-used personal protective equipment. While the OSHA notice is not a proposal, it is a change to a long-held OSHA policy. The agency has granted an extension of 90 days for public input. ABA will submit comments through a broader industry coalition.
