House Committee Passes Miner Safety & Health Act

Last week the House Education and Labor Committee passed legislation modifying the Occupational Safety & Health Act (OSH Act) by providing OSHA with greater authority for penalties, enforcement, and whistleblower provisions. The Miner Safety and Health Act (H.R. 5663), renamed the Robert C. Byrd Miner Safety and Health Act of 2010, passed on a party-line vote of 30-17. The full House is expected to take up the legislation soon. ABA has been leveraging its resources through the Coalition for Workplace Safety, expressing concerns that the legislation creates an adversarial relationship between businesses and OSHA. The coalition states that OSHA must be a resource for employers as well as an enforcement agency.
