Will Healthcare Reform Put Squeeze on Agent Commissions? 

Medical Loss Ratio (MLR) rules imposed by federal regulators for the Affordable Care Act (ACA) are putting a squeeze on agent commissions. Insurance regulators require insurers to spend at least 85% of the premiums collected from large groups and at least 80% of the premiums collected from small groups and individuals on medical costs. 

 

Commissions for brokers and agents may be trimmed to cover administrative costs due to narrow MLR definitions that could cut spending on case management, wellness, disease management, and fraud and abuse prevention.  During the next few years, state-run insurance exchanges will change the way individuals and small employers purchase coverage and possibly leave commission structures under the control of state regulators. For insurance agents and brokers, these new rules and programs could represent an opportunity for new business or the need to find a new career.

In a letter to Health and Human Services, NAIFA President, Thomas D. Currey promoted the unique role of insurance agents and brokers in selecting health insurance.  He emphasized that "dramatic increases in health care costs," as well as newly enacted risk pools and tax credits, make "the licensed insurance professional an increasingly important part of the health care equation."

 
CE "Grandfather" Exemption Is Not Automatic, Says TDI 
Agents who are continuously licensed for 20 years but fail to request a CE exemption upon reaching the 20 year mark are not automatically exempt from continuing education requirements. Agents must file Form LHL216 to request the CE exemption and are at risk of the imposition of heavy fines for the failure to do so. This form and others are available at www.tdi.state.tx.us/forms/form11.html 
 
Are Exemptions from the State's Franchise Tax at Risk?
As Texas lawmakers are preparing to tackle a projected budget shortfall of at least $18 billion in the next biennium, removing some tax exemptions is going to get serious consideration as the state seeks to boost revenue. At present agents and advisors who operate as sole proprietorships or in general partnerships are not subject to the state's franchise/business activity or "margin" tax. Also, currently exempted are insurance companies that pay an annual premium tax levied under the Insurance Code

Tax exemptions overall are an attractive potential revenue source because there are scores of them totaling billions of dollars each year. At the request of House Speaker Joe Straus, Ways and Means Committee members met May 25th in a public hearing to look at the state's major exemptions, creating a case of jitters among lobbyists and interest groups, who are scrambling to build a case for their particular exemptions before next year's legislative session.  

Any business or industry that benefits from current tax exemptions or exclusions would be well-advised to watch the interim hearings and be very involved in the session, says NAIFA-TX CEO/lobbyist Des Taylor, adding that there will not be many exemptions that are not "on the table" for scrutiny by lawmakers.

Successful 2010-2011 Board candidates will join three remaining Trustees, Frank Correa LUTCF from NAIFA-Fort Worth; Jason Talley LUTCF from NAIFA-San Antonio; and the unsuccessful candidate for Secretary-Treasurer, either Ussery or Massey, both of whom were elected to two-year terms last year. Completing the Board will be Ron Mullen CLU, ChFC from NAIFA-Austin, National Committeeman; Randy Robertson LUTCF from NAIFA-Lubbock, Immediate Past President; and Cylinda Clark from NAIFA-Dallas, the incoming President. Clark becomes only the second woman president of TALU/TAIFA/NAIFA-TX in its 85 year history.
