A Message from the President

Good beginnings are conducive to long term success. I trust you are off to a very productive start for 2007. TAIFA kicked off the year on a positive note with a successful Legislative Day January 23. Nearly 200 TAIFA members and 70 lawmakers were in attendance. You should be encouraged by the productivity of our advocacy efforts on your behalf. You may read about this event in greater detail on the TAIFA website at www.taifa.org.

I strongly encourage members to review the
NAIFA in the 21st Century Strategic Report. Each of you needs to be a part of this conversation as we move forward. Together, we must move past our initial tendency to have an emotional or “knee jerk” response and embrace the complexity of our organization while developing a plan to thrive in the 21st century. We have already received some excellent input but need to hear from more members. Your Texas leadership is listening, and will formulate an appropriate response to our NAIFA Board, based on the feedback we receive from throughout the state.

As President of TAIFA, I am urging leaders to look across the organization and contribute creative options for the future, thinking about what is best for TAIFA, and providing the clarity and focus of leadership we need. The most dangerous action we can take is to do nothing at all. Our leaders are asking tough questions, but it is up to all members to work together to avoid the miasma of apathy. We did not get here overnight, and we won’t fix everything overnight either. It won’t be easy; we’ll have to make some tough decisions and we won’t be shy about doing so. We will be bold in our thinking and deliberate in our actions. Together, we will become a stronger NAIFA, fully equipped to handle the challenges of the 21st Century.

TAIFA Legislative Day 2007

Texas Capitol Welcomes TAIFA Members
Over 150 TAIFA members descended on the Texas Capitol January 23rd for TAIFA’s 2007 Legislative Day. Braving the cold and rain, Texas’ finest arrived from the four corners of the state to visit with their lawmakers to discuss issues facing insurance agents and financial advisors throughout the state of Texas.

The meeting in Austin marks a pivotal point in the year for TAIFA, as legislative issues move to the forefront of emphasis. “The greatest thing that comes out of Legislative Day,” said Lane Boozer, Chair of TAIFA’s Political Involvement Committee, “is the building of relationships between members and lawmakers.” He added, “As issues come up in the House and Senate, these relationships will ensure that the voices of agents are heard and considered.”

With more than one thousand bills already filed in the House and four hundred filed in the Senate, the 80th Session is sure to be busy. Your TAIFA staff is carefully following all filed legislation. For updates throughout the session, please visit www.taifa.org.


Secretary of State Greets TAIFA Members
Texas Secretary of State Roger Williams greeted TAIFA members at the Capitol Grill on the morning of January 23, in conjunction with TAIFA’s 2007 Legislative Day. The Secretary, a former baseball player and native of Fort Worth, serves not only as Texas’ chief elections' officer, but also its chief business officer. In his message to a crowded room of TAIFA members, the Secretary said, “Small businesses drive the economy of Texas and you are all small business owners.” He continued, “Your success is success for Texas, and the growth of your business opens the door to new opportunities for Texans.”

Also joining TAIFA members for the morning session was TAIFA member and State Representative David Farabee. “It is reassuring to me to see so many of you here today,” he said, “representing not only the industry, but your clients who depend on you for financial viability and protection.”


Resolutions Honor TAIFA, Officers
On January 23, TAIFA members were honored by the Texas House of Representatives for their many contributions to the citizens of Texas over more than 80 years of service. TAIFA members, gathered in Austin for TAIFA Legislative Day, filled the South Gallery of the Texas House as the resolution, sponsored by TAIFA member and State Representative David Farabee was read in full by the clerk.

In addition to recognizing TAIFA President Tim K. Provence III for his service and leadership, HR 94 honored TAIFA for its ongoing role as, “a vital group of professionals who consistently work in behalf of consumers and businesses to advance financial independence and reliable insurance for all.”

Another resolution, HCR 37 filed by TAIFA member and State Representative Joe Driver, was read recognizing Mark R. Warren for his service and leadership as TAIFA’s 81st President, and for contributions he and his wife, Freada, have made to the cause of organ donation in the wake of the tragic death of their son, Clay Warren.


Legislators Meet with TAIFA Members
More than seventy Texas Legislators joined TAIFA members at the University of Texas Alumni Center for lunch in conjunction with TAIFA’s Legislative Day on January 23. Representing the Senate and Lieutenant Governor David Dewhurst was TAIFA member Senator Tommy Williams of The Woodlands.

After a few welcoming remarks by Senator Williams, TAIFA member and State Representative Joe Driver introduced Speaker Tom Craddick who shared his thoughts on the upcoming session. Speaker Craddick thanked TAIFA members for their hospitality commenting, “I know the session is about to begin when I receive my invitation to the TAIFA luncheon.” He continued, “Your event is the first one of the session and we always look forward to being with you.”

Speaker Craddick offered an overview of the 80th Session and the issues that arise when working with a budget surplus as opposed to a deficit. “When there’s no money, it’s easy to say no to proposals for new programs,” the speaker said, “but with a surplus, it is important that great discretion be used to manage the resources of Texas to the benefit of its citizens.”

TAIFA members used the luncheon to establish and build upon relationships with Texas lawmakers. As the 80th Session continues, these relationships will assure open lines of communication between TAIFA and Texas leaders.

TAIFA President Provence, in saluting the 80th Legislature, said that the invitation two years from now will be from NAIFA-TX, unveiling TAIFA's new name.

Advocacy Update
Is a "Personal Lines-Only" License Coming to Texas?

Insurance industry lobbyists have asked TAIFA to support a new "personal lines license" that would allow the person obtaining the license to act as an agent of an insurance company with restricted authority to sell only personal insurance products.

Current Texas law requires a person who intends to sell only personal lines insurance products to obtain a General Property and Casualty License which permits the individual to sell not only personal lines insurance but also commercial insurance. According to the Texas Department of Insurance, a majority of states offer a "personal lines-only" license.

Advocates for a new "personal lines-only" license in Texas argue that such a license would facilitate greater uniformity in producer licensing among states as sought by the federal Gramm-Leach-Bliley Act of 1999.

TAIFA will review the proposed legislation before deciding its position.

80th Texas Legislature

Overview of the Session
Priorities of TAIFA in the 80th Legislative Session represent issues that matter most to members.

TAIFA Opposes

• Any changes to the new business activity tax that would either 1) impede efforts to cover the costs of property-tax cuts or 2) impair the funding of reforms to the state’s public educational system. Instead, lawmakers should give the new law, passed during the 79th Third Called Special Session, a chance to work;

• Any attempt to ban the sale of corporate-owned life insurance in Texas. TAIFA believes that businesses should be able to use COLI as an integral part of their overall financial planning process;

• Legislation that increases health care costs for Texas employers, their employees and families. TAIFA opposes any attempt to erode the federal preemption of state law relating to health benefit plans under the Employee Retirement Income Security Act (ERISA) that protects the ability of employers to operate uniformly across state lines; and

• Legislation granting state securities regulators jurisdiction over variable products.

TAIFA Supports

• Legislation that defines acceptable practices and provides a mechanism by which regulators can hold insurers and agents accountable for recommending and/or selling unsuitable products to senior citizens and others;

• Changes to the current funding mechanism of the Texas Windstorm Insurance Association (TWIA), which is not adequate to deal with the potential loss that could be caused by a category 4 or 5 hurricane hitting certain parts of the Texas Gulf Coast;

• Legislation to create a “life-only” license to allow the person obtaining the license to act as an agent with restricted authority to sell life insurance and annuities and associated lines. The "life-only" license would facilitate greater uniformity in producer licensing among the states as sought by the federal Gramm-Leach-Bliley Act of 1999;

• Legislation to reduce unnecessary administrative burdens in the workers’ compensation system on insurance carriers, injured workers and health care providers, building on reforms enacted in House Bill 7 during the 79th Legislature;

• Anti-fraud legislation which costs Texans millions of dollars in the insurance marketplace and supports legislation to increase the Texas Department of Insurance focus on identifying and prosecuting fraud and abuse within the workers compensation system; and

• Legislation that would prevent uninsured motorists from collecting pain and suffering damages if they are in an accident with an insured driver.

TAIFA will protect

• Provisions in the Texas Insurance Code which shelter life products and annuities from seizure by creditors; and

• Reforms enacted in previous sessions to address rising medical malpractice insurance costs.

TAIFA lobbyists in Austin are working tirelessly to ensure that the interests of consumers of insurance products and services are protected and that the view of insurance agents and financial advisors is heard–loud and clear. Legislative alerts will be sent to members and Key Contacts for lawmakers, urging specific action, as necessary, throughout the 80th Texas Legislative session.


TAIFA Members Land Key Appointments
Activity is increasing in the Texas Legislature following the organization of the Senate, election of the Speaker of the House and Committee assignments.

In the Senate, TAIFA member and Senator Tommy Williams (R-The Woodlands) will serve as Vice Chair of State Affairs and will serve on the Committee of the Whole Senate, Education, Finance and Transportation & Homeland Security.

In the House, member and State Representative Joe Driver (R-Garland) was named chair of the Law Enforcement Committee and will serve on the Environmental Regulation Committee.

Member and State Representative David Farabee (D- Wichita Falls) was named Vice Chair of Energy Resources and will serve on the County Affairs Committee.

Member and freshman Representative Kirk England (R-Grand Prarie) was named to the powerful Appropriations Committee, to Elections (Budget & Oversight Chair) and to Rules & Regulations.

TAIFA News and Information

NAIFA in the 21st Century Report Released
On Monday, January 22, NAIFA members across the country received an e-mail from President John Davidson, LUTCF entitled “NAIFA in the 21st Century.” The contents of the e-mail included the findings of the NAIFA Transformation Taskforce’s national survey. In short*, the survey indicated that:

• NAIFA is perceived to be, at its core, an advocacy organization. However, members are unaware of specific activity and accomplishments in advocating on their behalf.

• The local NAIFA organization shapes and controls members perceptions of NAIFA; many of the problems with member satisfaction and retention appear to originate at the local level.

• Members expressed interest in a national- only reduced cost membership that supports advocacy and provides national-level benefits.

In response to the report, TAIFA President Tim Provence issued a letter to all members, directing them to gather information and to “seek first to understand.” “By reviewing this information,” Provence said, “you are doing what we all must do in this season, considering ALL the information provided and placing a premium on the conversation to come from the findings of the strategic plan.” He added, “TAIFA wants your constructive input,” while reminding members that no plan is set in stone until it is approved by the National Delegate Council.

TAIFA remains committed to the growth and development of local associations across the state. In May, leaders from local associations will gather in Austin to participate in the second year of the “Local Success Planning (LSP)” program. The program, which will build upon leadership concepts explored in 2006, will help to train leaders at the local level for a successful year of growth and development.

TAIFA Remembers Johnny Wright “Everybody Knows Johnny Wright Knows Life Insurance.”

Johnny Wright, past president of TLRT and long-time association member and agent for Southland Life, died Saturday, January 27, in Tyler. Funeral services were held there Tuesday, January 30. Johnny, 95, was a native of Tyler, born May 30, 1911. He joined Southland Life in 1953 and was still serving his clients at the time of his death. His slogan was “Everybody Knows Johnny Wright Knows Life Insurance.”

Johnny was president of TLRT in 1963. He also served as president of the Tyler ALU and the East Texas Estate Planning Council, as well as a number of civic clubs, the Tyler Chamber of Commerce and other organizations. He was a Life Member of the Million Dollar Round Table. He is survived by two sons and one daughter.

Qualifying Membership: $27,000 in first-year commissions (FYC) and/or fees*

Lone Star Leader Membership: $54,000 in first- year commissions (FYC) and/or fees**

Grand Council Membership: $108,000 in first- year commissions (FYC) and/or fees**

Life Membership: 7 consecutive or 10 cumulative years of membership in TLRT

Qualifying Life Membership: Meets both Life Member and Qualifying Member requirements

Management Membership: Actively employed as a general agent or manager
