The Office of the Governor is currently accepting applications for the position of Executive Director, West Virginia Public Defender Services.  The Executive Director is responsible for the development and improvement of programs for legal representation to indigent persons through private attorneys and full-time Public Defenders.  Duties include, but are not limited to, policy making; developing and implementing programs of education; editing all legal publications and documents issued from the agency; overseeing and supervising agency staff; preparing and managing the agency's budget; representing the agency before the Legislature and assisting in drafting legislation.  Additional duties include approval of all grants, loans to or contracts made with  public defender corporations and various other individuals for the purposes of providing legal representation to indigent persons as well as overseeing the work of the Criminal Law Research Center.

 

Qualified Candidates must be a licensed attorney admitted to the State Bar of West Virginia as well as five years of full-time or equivalent part-time paid experience in the practice of law or as a public defender.  Salary is set by West Virginia Code �6-7-2a(b) at $70,000.

6TH Judicial Circuit Vacancy - The Judicial Vacancy Advisory Commission is currently receiving applications to fill the judicial vacancy on the 6th Judicial Circuit. Candidates must submit their completed applications by no later than 5:00 p.m. on December 22, 2010. Applications and instructions are available at www.governor.wv.gov. RED FLAGS RULE - The Red Flags bill, which was passed by the Senate, has passed the House.  This should effectively exempt all lawyers, regardless of firm size, from the Red Flags Rule.


STANLEY K. FOSHEE - LAW LICENSE SUSPENDED - Charleston, WV- On November 22, 2010, pursuant to recommendations made in a reciprocal disciplinary action under Rule 3.20 of the Rules of Lawyer Disciplinary Procedure, the Supreme Court of Appeals of West Virginia issued an Order suspending the law license of Stanley K. Foshee for a period of three years.  Additionally, the Court ordered that prior to filing any petition for reinstatement of his law license in West Virginia, Mr. Foshee must comply with the provisions set forth in the Agreed Disposition Order issued by the State Bar of Virginia and pay costs.
