JUDICIAL APPOINTMENT TO THE COURT OF CLAIMS - The West Virginia State Bar is seeking candidates for the position of Judge of the Court of Claims. If interested, provide a resume to the State Bar on or before March 30, 2011.  The Speaker and the President will make the appointment from a list of three candidates recommended by the Board of Governors of the State Bar. A minimum of ten (10) years' experience as a licensed attorney is required. This position involves hearing and deciding claims filed against state agencies and the Crime Victims Fund. The main offices of the Court are at the State Capitol with travel to other parts of the state for hearings.  Some administrative law, mediation, or other judicial experience would be beneficial. CHIEF HEARING EXAMINER -  The Department of Transportation is seeking applicants for the position of Chief Hearing Examiner in the Office of Administrative Hearings.  The Office of Administrative Hearings hears and determines appeals of orders suspending or revoking drivers licenses,  licenses renewal rejections, including the levying of civil money penalties.

RALEIGH AND FAYETTE COUNTIES - On October 6, State Bar President Tish Chafin and Executive Director Anita Casey will be visiting your counties.  Please join them for a short, very informal meeting.  The schedule is:

INSURANCE LAW SEMINAR - WVCLE, jointly sponsored by the WVU College of Law and The West Virginia State Bar, will present its annual "Insurance Law" seminar on October 8 & 9, 2010, at the WVU College of Law in Morgantown, West Virginia.  This program will feature state experts:  Professor Thomas Cady, Vincent King, Ancil Ramey, Barbara Keefer, Briana Marino, Eric Hulett, John Polak, James Stoneking, and Michael Stevens.  This seminar will provide invaluable insights into recent developments and issues related to the practice of insurance law in West Virginia.  To register online, please click here or call (304) 293-7255 for more information.

CM/ECF CLASSES - October 19, 20 & 21, 2010 - 500 West Pike Street, 3rd Floor, Clarksburg, WV - The Clerk's office will conduct CM/ECF training for attorneys/staff at the Clarksburg point of holding Court, Tuesday, October 19th  through Thursday morning October 21st.   Attorneys attending a three-hour session will earn three CLE credits for office management.  The morning session will begin at 9:00 a.m.   The afternoon session will begin at 2:00 p.m.  There is no fee for the training. 

Due to limited seating, reservations are due by Thursday, October 14.

Bowman, The Honorable Frederick P. TRAINING IN VETERANS LAW - The National Organization of Veterans' Advocates, Inc. (NOVA), which has been training lawyers in veterans law since 1993 and has been recognized as a leader in service to veterans and in CLE training, will be providing training at its Fall 2010 three day seminar in nearby Washington, D.C. from Saturday October 23rd through Monday October 25, 2010. NOVA's comprehensive three day program begins with a full day session on October 23rd  designed for new practitioners which covers the practice of VA law from the initial filing of a claim through the appellate stages. Following is two days devoted to more advanced presentations on specific types of claims, on the newly decided cases and on attorney fees.
 
Attendance at the seminar will be approved for WV MCLE credits including legal ethics, and will also been approved by the VA as meeting their 3 hour CLE requirement for initial accreditation under 38 C.F.R. 14.629 (b)(iii) and their biannual 3 hour CLE requirements under 38 C.F.R. 14.629 (b)(iv).
 
All those who wish to use this CLE from this seminar to meet the VA's requirements should immediately apply for accreditation from the VA.

DELINQUENT MEMBERSHIP DUES & FRD SUSPENSIONS - As of today, we have 329 active State Bar members who still either did not pay their annual membership fees by the deadline date of September 1, 2010 and/or did not complete the required Financial Responsibility Disclosure (FRD) form on the back of the membership dues card by the deadline date of September 1, 2010.A $25 late fee automatically attached after September 1, 2010 for late payment of membership dues and a separate $25 late filing fee automatically attached for the late return of the FRD Notice.  If the membership dues payment and/or the applicable late fees are not paid by November 17, 2010, then the State Bar member is automatically suspended from the active practice of law.  If the member has paid the fees and has not completed and submitted the FRD Notice on the back of the dues card by November 17, 2010, then the State Bar member is automatically suspended from the active practice of law.

 
YOUR BOARD OF GOVERNORS AT WORK - The West Virginia State Bar Board of Governors most recent quarterly meeting was held at Pipestem Resort on September 24 and 25, 2010. Relating to the mission of the West Virginia State Bar, the following was received and accomplished: 

� Received an extensive report from West Virginia College of Law Dean Joyce McConnell who discussed various facility and building issues; the incoming 1L class and further reported on the College of Law's creation of a sustainable land use Clinic which is non-litigation focused.  Further, Dean McConnell reported that the College of Law has teamed with Barnes & Noble for the creation of the Barnes & Noble Caf� Bookstore at the College of Law.  This allows, for the first time, the ability to have food and beverage services available at the College of Law. 

 � Received report from WVCLE Chairperson, Stephen L. Thompson, and Jessica Justice who discussed the newly-appointed members to the WVCLE Committee and provided information on WVCLE's plans for programming, particularly in light of the fact that the Bar is now in non-reporting year for CLE.   

� Received report from American Bar Association delegates Dan Callaghan and Immediate Past President Sandra Chapman concerning their attendance at the August ABA Annual Meeting in San Francisco.  Mr. Callaghan also discussed his observations with respect to the financial strength of ALPS. 

� Received information from West Virginia University College of Law Professor Robert Bastress with respect to proposals for new funding and donation opportunities of Legal Aid of West Virginia.
 
� Approved the execution of an option to purchase the properties which currently house the West Virginia State Bar Center and Office of Disciplinary Counsel from the West Virginia Bar Foundation and further discussed various options concerning plans for the State Bar Center in light of the State Bar Strategic Plan of improving its facilities and infrastructure. 

� Approved disbursements of IOLTA funds to approved entities.  
 
� Confirmed various supplemental appointments to the Commission for Judicial Independence.  The appointees include Dean Joyce McConnell, and required non-lawyers Rachel Lester, Charleston; Genevieve McCutcheon, Bridgeport; and, Russell Dunkin, Wheeling. 

� Received information that from the numerous nominees recently provided by the West Virginia State Bar Board of Governors to the West Virginia Governor's office that Governor Manchin has appointed Charles S. Trump, Berkeley Springs; Burt Ketchum, Huntington; Debra H. Scudiere, Morgantown; and, W. Kent Carper, Charleston to the Judicial Advisory Commission. 
 
�  Approved disbursement of funds from budget to WVCLE for its use in producing the Solo and Small Firm CLE. 

� Received report from Young Lawyers Section Chairperson, Chris Gardill, who reported on YLS Developments with respect to the West Virginia Law Adventure program and further work by YLS members on the Practice Handbook.  

� Approved continued publication of the West Virginia Lawyer as well as the annual State Bar Directory and authorized the Chair of the Editorial Board and Executive Director to continue to discuss and negotiate any needed contracts with the respective publishers to maximize advertising revenue for the benefit Bar Members. 
 
� Received report Office of Disciplinary Counsel, Chief Disciplinary Counsel Rachel Fletcher-Cipoletti, who detailed her office's diligent handling of its case load and who further discussed the upcoming relocation of the ODC offices from its current Kanawha Boulevard location to the Kanawha City area.  

� Received oral and written report from Logan M. Hassig, President of the The West Virginia Bar Association concerning the Bar Association's efforts on its online services and its recent annual meeting which was held on August 12 - 14, 2010, at the Greenbrier.  This was the Bar Association's 124th annual meeting and enjoyed its highest attendance in decades.  The 2011 annual meeting is scheduled for August 11 - 13, 2011, at the Greenbrier. 

The next quarterly meeting of the West Virginia State Bar Board of Governors will be on January 14 and 15, 2011, at the Bridgeport offices of Steptoe & Johnson, PLLC.

STATE BAR REGIONAL MEETINGS - The State Bar will begin its annual set of Regional Meetings today. Ten meetings will be held at various locations throughout the State. The meetings will begin at 10:30 am, include a lunch, and should end by 1:30 pm. The meetings will provide a total of 3.0 MCLE credit hours in legal ethics, office management, substance abuse and/or elimination of bias. The cost is $100 per person.
