FREE AND UNLIMITED NATIONWIDE LEGAL RESEARCH - FOR MEMBERS OF THE WEST VIRGINIA STATE BAR - 

Starting July 1, 2010, West Virginia State Bar members will have free and unlimited access to FASTCASE - a fully searchable online law library.

To use the free benefit, begin by visiting the West Virginia State Bar website at
www.wvbar.org. Select "member login" from the drop-down menu under the "Members" tab. Log in with your email address and password. If you have not created your member password, please refer to instructions below.

Once you have logged in at the West Virginia State Bar website, begin your research at "Fastcase Access," located just under the Site Search window in the West Virginia State Bar heading. Click here for graphic. At the top of the page, get started right away typing your search into the Quick Caselaw Search field. You can also click on Advanced Caselaw Search where you can search desired jurisdictions and use standard keyword connectors to find the best cases for your issue.

Instruction for creating and updating Member login password.

Go to the "Member Directory," which is available under the "Members" tab. To create a new password, click on the following link.
https://wvbar.org/members/login.aspx. Enter your email address in the PASSWORD RESET section and click the RESET PASSWORD button. You will receive an email within a few minutes with a link to another window. In the upper portion of the new window, enter your email address where requested and your new password in the password window. You will need to reenter the new password in the retype password window.

Your password must be at least 8 characters long and contain a minimum of one uppercase, one lowercase alphabetic and one numeric character. Once you have completed this portion it should take you to your profile.

There is an option to reset your password if you should forget it. No one will have access to your password, not even The West Virginia State Bar.

MCLE REMINDER - The 2008-2010 reporting period will end on June 30, 2010. The filing deadline is July 31, 2010. If necessary, you may take courses in the month of July 2010 and carry the credits back to meet the 2008-2010 requirement. Courses carried back may NOT be split between two different reporting periods. You may carry over six excess general credits earned to the 2010-2012 reporting period. You may check your credits online and file approved activities completed using the State Bar's website if you have an e-mail on file with the State Bar office. To access your records, go to www.wvbar.org, click on MCLE, then click Members Only.  If you have not used the new online submission program, you will need to go to the Password Reset Feature, enter your e-mail as on file with the State Bar, and click reset password.  You will then receive an e-mail with a link to create your password.  The password must be created within one hour.  You may then review your credits and submit credits online.  You may access the reporting period, the requirements, and forms by double-clicking MCLE on the website.  If you have questions, contact Hope Gresham at greshamh@wvbar.org.

 

ETHICS 2010 - WVCLE, jointly sponsored by the WVU College of Law and The West Virginia State Bar, is proud to announce its ETHICS 2010 seminar which will be held at the WVU Medical Center in Charleston, WV, and via distance learning classrooms in Martinsburg and Morgantown, on June 30, 2010.  This seminar will feature state ethics experts Rachael L. CHANGE IN PRO HAC VICE FEE - By Order entered February 11, 2010, effective July 1, 2010, the fee for pro hac vice admission under Rule 8.0 of the West Virginia Rules for Admission to the Practice of Law has been increased to $350.00.  A comparable change in the fee was made to Rule 4.02 of the West Virginia Trial Court Rules, dealing with pro hac vice admission.  That change was also made by Order entered on February 11, 2010.  To review the Order amending Rule 8.0 click here.  To review the Order amending Rule 4.02 click here.

MEDIATION TRAINING SESSIONS - On July 13 and 14, 2010, The West Virginia State Bar's ADR Committee will present its annual Basic Mediation Training Sessions.  The sessions will be held at the Days Hotel in Flatwoods. The sessions provide 16 hours CLE credit with 1.2 hours in ethics.  Click here to review the Agenda.  Registration deadline is July 7.

An  Advanced Mediation Training Session will be held on August 10, 2010, also at the Days Hotel in Flatwoods.  This session will offer 6.5 hours credit with 1.2 hours in ethics.

ETHICAL QUANDARIES FOR PUBLIC LAWYERS - Chairperson Charlene A. Vaughan has announced that the Government Lawyers Committee and the State Bar will sponsor an audio CD entitled, Ethical Quandaries for Public Lawyers: Conflicts, Trial Publicity, Organization as a Client and More on July 16, 2010 at the State Capitol Training Centers' Capitol Room located in Bldg 7 on the Capitol grounds in Charleston, WV. The program focuses on the unique ethical issues confronted by public lawyers using an entertaining, interactive format. Expert panelists dramatize illustrative hypothetical scenarios followed by a discussion session after each hypo. Featuring all NEW scenarios, topics include: special conflicts of interest for former and current government officers and employees; trial publicity; confidentiality of information; client with diminished capacity; organization as a client; candor towards the tribunal; fairness to opposing party and counsel, and more.
 
There will be a short Committee meeting starting at 2 p.m. followed by the playing of the CD. The Committee hopes this last minute chance to earn ethics CLE credits will also serve as an enticement for government lawyers to join the Committee. Seating is limited, so first come, first served. The CD CLE has been approved for 1.80 audio ethics credits.

ANNUAL MEMBERSHIP DUES NOTICES - Dues notices for the July 1, 2010 - June 30, 2011 fiscal year were mailed on Friday, June 11, 2010, to all members of the Bar. Dues payments must be postmarked by September 1, 2010, to avoid the $25 late penalty fee. The 2010-11 Financial Responsibility Disclosure (FRD) Notice is located on the back of the dues card. The FRD Notice must be postmarked by September 1, 2010, to avoid an additional $25 late filing fee.  Members who are on "active but not practicing" status, do not have to comply with this mandatory FRD requirement. 

 

MEDIATOR LISTINGS - In order to bring The State Bar in compliance with Rule 25.04 of the West Virginia Trial Court Rules, The State Bar has established a website listing of members who are both willing and qualified to serve as mediators in the circuit courts of this State. A member who wishes to be listed as a mediator shall pay an annual fee of $25.00. If the member is willing to serve on a volunteer basis, this will be noted on his/her listing and the fee shall be waived. The listing of mediators will be by county and in alphabetical order for that county. Initially, the mediator may only be listed for the county in which he or she maintains his or her State Bar address. To view Rule 25.04 of the West Virginia Trial Court Rules click here. INFORMATION FROM THE GOVERNMENT LAWYERS COMMITTEE

 More exciting loan repayment assistance news from Equal Justice Works: 
 
 Greetings,

 

I am glad to inform you that the John R. Justice Student Loan Repayment Program (JRJ) will provide 10 million dollars in loan repayment assistance to state and federal public defenders and state prosecutors who agree to remain employed as public defenders and prosecutors for at least three years. 

 

JRJ will be administered by Governor-designated state agencies that must register and apply by 8:00 p.m. eastern time on July 13, 2010.  Funds will be available to states based on the total population of each state with a minimum base allocation of $100,000. Please work to ensure that your governor designates a state agency in advance of the deadline.

 

I have posted a JRJ webpage  which will be updated as information becomes availableand have scheduled two webinars to help prosecutors and defenders interested in the program.
