REVISED RULES OF APPELLATE PROCEDURE - Chief Justice Robin Jean Davis announced that the Court released the Revised Rules of Appellate Procedure for public comment on Monday May 17, 2010. The Court has prepared a page on its website with resources in connection with this announcement. The revised rules are available here:
 
The public comment period concludes on July 19, 2010.  In order to facilitate comments, the Court has scheduled free public seminars to occur over the next three weeks.  Attorneys who attend the ninety-minute seminars are eligible to receive 1.8 CLE credits in office management/ethics. Printed copies of the rules will be distributed at the seminars. The seminars will be: 
 
(1) 3:30 p.m. to 5 p.m. on Tuesday, May 18, at the Ohio County Public Library Auditorium, 52 16th St., in Wheeling;
(2) 3:30 p.m. to 5 p.m. on Wednesday, May 19, at the Fayette County Courthouse in Fayetteville;
(3) 10:30 a.m. to noon on Thursday, May 20, at the Judge Black Judicial Annex, Fort Boreman Room, in Parkersburg;
(4) 11 a.m. to 12:30 p.m. Friday, May 21, at the Upshur County Courthouse, in Buckhannon;
(5) 10:30 a.m. to noon Monday, May 24, at the Chief Logan State Park Conference Center in Logan;
(6) 11 a.m. to 12:30 p.m. Tuesday, May 25, at the West Virginia University College of Law, Marlyn E. Lugar Courtroom, in Morgantown;
(7) 1 p.m. to 2:30 p.m. on Wednesday, May 26, at the South Branch Inn in Moorefield;
(8) 2 p.m. to 3:30 p.m. on Thursday, May 27, at the Dunn Building, County Commission Hearing Room, in Martinsburg;
(9) 10:30 a.m. to noon, Thursday, June 3, at the Pullman Plaza Hotel in Huntington. 

ATTORNEY - SUPREME COURT CLERK'S OFFICE - The West Virginia Supreme Court of Appeals seeks an attorney to be employed in the Office of the Clerk for a full-time position. The attorney will be expected to assist the Clerk of Court with various aspects of the clerk's office operations, including case management, records management, opinion and order processing, publications management, and other matters as assigned by the Clerk. Candidates must have a superior academic record and be a member in good standing of the West Virginia State Bar, with suitable work experience. Additional requirements include the capacity for articulate oral and written expression, ability to manage and complete multiple tasks simultaneously with minimal supervision, a basic ability to produce a variety of documents for print and Web publication, and basic knowledge of computer databases and statistical reporting. LAWYER DISCIPLINARY BOARD - The Lawyer Disciplinary Board submits for public comment the following Legal Ethics Opinion: Ghostwriting or Undisclosed Representation: What is Permissible and What is not Permissible.  This L.E.O. was reviewed by the Board at its February 26, 2010 meeting.  Please submit your comments by July 1, 2010, to the Office of Disciplinary Counsel, 2008 Kanawha Boulevard East, Charleston, West Virginia  25311. MEDIATION TRAINING SESSIONS - On July 13 and 14, 2010, The West Virginia State Bar's ADR Committee will present its annual Basic Mediation Training Sessions.  The sessions will be held at the Days Hotel in Flatwoods. The sessions provide 16 hours CLE credit with 1.2 hours in ethics.  Registration deadline is July 7.   Click here to register for the Basic Mediation Training Sessions.   
 
An  Advanced Mediation Training Session will be held on August 10, 2010, also at the Days Hotel in Flatwoods.  This session will offer 6.5 hours credit with 1.2 hours in ethics.  Registration deadline is August 5.  Click here to register for the Advanced Mediation Training Session.

ETHICAL QUANDARIES FOR PUBLIC LAWYERS - Chairperson Charlene A. Vaughan has announced that the Government Lawyers Committee and the State Bar will sponsor an audio CD entitled, Ethical Quandaries for Public Lawyers: Conflicts, Trial Publicity, Organization as a Client and More on July 16, 2010 at the State Capitol Training Centers' Capitol Room located in Bldg 7 on the Capitol grounds in Charleston, WV. The program focuses on the unique ethical issues confronted by public lawyers using an entertaining, interactive format. Expert panelists dramatize illustrative hypothetical scenarios followed by a discussion session after each hypo. Featuring all NEW scenarios, topics include: special conflicts of interest for former and current government officers and employees; trial publicity; confidentiality of information; client with diminished capacity; organization as a client; candor towards the tribunal; fairness to opposing party and counsel, and more.
There will be a short Committee meeting starting at 2 p.m. followed by the playing of the CD. The Committee hopes this last minute chance to earn ethics CLE credits will also serve as an enticement for government lawyers to join the Committee. Seating is limited, so first come, first served. The CD CLE has been approved for 1.80 audio ethics credits.
 
LAWYERS IN OUR SCHOOLS - To assist educators in locating attorneys who are willing to go into classrooms and/or work with after school and/or summer educational programs, The West Virginia State Bar is re-establishing its School Mentor Program.  Attorneys who are willing to assist educators will appear on a separate database. When someone uses the "School Mentor Search" tab found under the Public Information heading, they may select participant in the areas of elementary, middle and/or high school and the county(s) in which they need assistance.
