Wetlands Guidance Right Around the Corner

We have been talking about the Wetlands Guidance proposed by EPA and the Corps of Engineers since last summer, but it looks like it is finally going to be issued in the very near future.  The Guidance has gone to OMB for review and will likely be released very soon for use by EPA and Corps personnel.

Under this new guidance, all isolated wetlands and drainage ditches will likely become jurisdictional again, similar to the situation prior to SWANCC and Rapanos Supreme Court Decisions and subsequent guidance.  The EPA and Corps have said that they will honor current JDs until they expire and will consider honoring JD applications that have been submitted but not issued yet.

Without a JD or a JD Application, you will likely fall under this new guidance very soon.
