Under this new guidance, all isolated wetlands and drainage ditches will likely become jurisdictional again, similar to the situation prior to SWANCC and Rapanos Supreme Court Decisions and subsequent guidance. The EPA and Corps have said that they will honor current JDs until they expire and will consider honoring JD applications that have been submitted but not issued yet.
Without a JD or a JD Application, you will likely fall under this new guidance very soon.
