Toxic Mold/IAQ Lawsuits on the Rise

Mold and IAQ cases are on the rise and are occurring all over the country totaling in the billions of dollars. There have been over 10,000 mold/IAQ related law suits pending in the nation, a 300 percent increase since 1999 and with the Cornell New York appellate court ruling that indicated recent studies were "statistically significant" and demonstrated "that exposure to mold caused the identified ill-health effects" you can expect the number of mold/IAQ law suits to rise.

Washington - In a report prepared for the Secretary of the Department of Healthindoorairtest.com sck formaldehyde and Human Services (HHS), scientists warned that people with higher exposure to formaldehyde were more at risk for nasopharyngeal cancer, myeloid leukemia and other cancers. Formaldehyde, a chemical used in embalming fluid and in consumer products is known to cause cancer, according to a new report from the federal government. The Occupational Safety & Health Administration (OSHA) reports that in 2006 the U.S. production of formaldehyde was at 10 billion pounds.

A New York appellate court has overturned a lower court ruling, allowing a toxic mold lawsuit to go forward. Brenda Cornell had sued the owners of her former apartment building, seeking compensation for the dizziness, rashes and respiratory ailments she acquired after being exposed to mold for nearly six years.

Toxic mold lawsuits have historically been met with speculation. Much of this was the result of the science - differing opinions on causation and whether visible mold automatically implies the presence of toxins. Some even went so far as to claim mold litigation was based on "junk science and hysteria."

 

However, a recent ruling from a New York appeals court suggests that prevailing opinions about mold science may have changed. At least when it comes to the courts.
