Comment: Below is a very interesting notice that I received from VGM about the policyholders of Medicare surety bonds now being hit for recoupment shortages. The language in this notice should give great concern to anyone who is a Medicare TSD footwear supplier that is mandated to have a surety bond to be a supplier. It seems that after mandating that certain types of suppliers (pedorthists for one) have to purchase a surety bond to be a Medicare supplier, the OIG found out that the DMEPOS contractors were failing to notify surety bond companies that the bond company needed to cover recoupment shortages. This failure to request payments from surety bond companies is now history. As one can read in this VGM notice, the surety bond company will go after the policyholder to repay what the bond company paid the DMEPOS contractor. No money in bank to pay back surety bond company? Not a problem. Sell your home (oops, not a good housing market), sell your cars, cash out the kid's college fund; just pay up is what the bond company will be saying. Also, it appears that it will become difficult to get a surety bond in the future and without having a surety bond during renewal process for a Medicare number; one would no longer be able to be a supplier. With audit rates of diabetic footwear claims at all time highs and recoupment rates even higher, one would have to imagine that this surety bond issue will be the final nail in the coffin for all diabetic shoe suppliers except those that used their political lobbyist at the last minute to avoid surety bond requirement to be a supplier.

Comment: There is news about laws being introduced that would drastically cut the scope of practice for the pedorthist. Our scope of practice (if you want to call it that way) would be fitting shoes and inserts.
I looked the other day at the Accreditation Standards of ABC & BOC. It seems that we, the pedorthist, are only listed for Therapeutic/diabetic footwear and inserts. Nowhere does it state that we are allowed and/or get accredited to fabricate, fit or dispense custom foot orthoses, ankle gauntlets etc. for diabetic or non-diabetic patients.

Skechers Posts Loss in Q1 on Sales Decline
Skechers USA, Inc. reported first quarter sales were $351.3 million compared to $476.2 million in the first quarter of 2011. The loss from operations for the first quarter of 2012 was $4.4 million compared to earnings from operations of $15.3 million in the first quarter of 2011. The net loss for the first quarter of 2012 was $3.7 million versus net earnings of $11.8 million in the first quarter of 2011. Type 2 diabetes, a chronic disease which can lead to amputation, loss of vision, kidney failure and many other health problems, requires a person to be extremely vigilant in caring for themselves when it comes to medication, treatment and caring for their symptoms. Physical education teachers Cotrena Liggon and Janice Megginson started the lifetime fitness course at E.C. Glass High School last school year as an alternative to the school's weight-lifting or sports-based physical education classes. Each student must have two physical education credits to graduate. "I would say it's an incredible healthy activity," said runner Michael Drabenstott, when asked if running is a healthy activity.Drabenstott said he's been running up to 13 miles a day, five days a week for the past 13 years. Pedorthics encompasses shoes, orthoses and foot devices that prevent or alleviate foot problems caused by disease, overuse, injury or congenital defect. To earn certification in Pedorthics, you must take a pre-determined number of course hours in pedorthics and pass a certifying examination overseen by either The American Board for Certification in Orthotics, Prosthetics & Pedorthics® or Board for Certification/Accreditation, Int'l.
