NEW QUESTION

Question: I am in the process to request my accreditation and after that apply for a Medicare Supplier number. I was told that while I am waiting for the Accreditation Survey, I have to do business and also see Medicare patients without being able to bill Medicare. Has anybody gone through this in the last year or so and what tips, tricks or advice can you give me to survive those first few months "without income".

I was told I can also not bill either for the Medicare patient I see while waiting. Can I at least file this as a "loss" at the end of the physical year? FYI: I will also sell Retail items. Thank you.

PREVIOUS QUESTION WITH RESPONSES

Question: I know I have seen this question on the Newswire before, but I am wondering if someone can direct me to where I can find vegan made shoes for one  of my patients. Thanks for the help.

-Joe Eads, C.Ped,COF.

Response: My research on Vegan or Vegetarian style comfort shoes keeps coming up with one option. The New Balance MW811, which states that it is made with synthetic leather materials.

-PNW Reader

Response: Although they might not be entirely vegan, the Nobile Shoe Company has excellent quality shoes and they are vegetable tanned. http://www.naturalstepshoes.com

PREVIOUS COMMENT WITHOUT RESPONSES

Comment: CMS recently published a proposed rule in the Federal Register which would call for a 10-year review period for various claims, including DMEPOS. This rule could be alarming because if you, like most suppliers, destroy your patient files after 7 years you could face a recoupment for reimbursements on patients which you no longer have evidence or proof of delivery because you no longer have the patient files. Every supplier needs to make official comments to this proposed rule.

The proposed rule is published in detail by clicking here. This rule is a response to part of the Patient Protection and Affordable Care Act. It is calling for stricter policing of over payments, changing the "lookback" window to 10 years to hunt for over payments that could be recouped.

The 10 year window and other aspects of the proposed rule could cause problematic for providers. Since the current standards require a minimum of 7 years for record retention suppliers could be caught off guard not having the necessary documentation to defend their claims.

Providers can send comments on the rule. The deadline for public comments 5 p.m. Eastern Time, April 16, and providers can submit their questions via:

*    Visiting http://www.regulations.gov and following the ''Submit a comment'' instructions.
*    Mailing written comments to Centers for Medicare & Medicaid Services, Department of Health and Human Services, Attention: CMS-6037-P, P.O. Box 8013, Baltimore, MD 21244-8013.
*    By express or overnight mail at Centers for Medicare & Medicaid Services, Department of Health and Human Services, Attention: CMS-6037-P, Mail Stop C4-26-05, 7500 Security Boulevard, Baltimore, MD 21244-1850.
Everyone should act now and make comments.

HEALTH AND INDUSTRY

A group of five law firms has filed a class-action suit against Vibram USA Inc and Vibram FiveFingers LLC in the U.S. District Court for the District of Massachusetts alleging the company used deceptive statements about the health benefits of barefoot running.
"Given that Defendan'ts advertising and marketing equates barefoot running with running in FiveFingers, Defendants; uniform deceptive statements about barefoot running are also deceptive statements about Five Fingers," alleges the suit.

The lawsuit appears to be the first of its kind filed in the district against Vibram FiveFingers, which was the single hottest outdoor specialty product in the United States from 2007 through 2010. The lawsuit says sales of the shoes have grown an average of 300 percent a year for the last five years and approached $70 million in 2011. The breakout sales led Merrell to partner with Vibram, an Italian company specializing in sole design and manufacturing, to launch its own minimalist footwear line in 2011. Full Text

The two girls window shopping outside the Louis Vuitton store on Bloor Street seem mystified "What are those?" asks one, pointing in the window, her nose wrinkling in amazement as if she has spotted a fleet of LV-embossed UFOs. "Um," offers her companion, "wedge-heeled, patent-leather platform penny loafers?" The girls turn away, laughing at the absurdity of trying to describe shoes so complex in their fusion of materials and styles that they must be worth their designer price tag.Indeed, as has been widely observed, shoes are having a moment, replacing handbags as fashion's big investment accessory. But what a strange moment it is turning out to be. Strolling along Bloor Street's designer-shoe corridor, it's clear there's something more than a little bit weird afoot. Full Text

Many shoppers got a pleasant surprise on Sunday as New York State reinstated its sales-tax exemption on clothing and footwear items costing less than $110. "Oh, wow," Candy Conway, a mother from Pennsylvania who was shopping at Century 21 in Lower Manhattan with a friend, Brenda Alek, and the two women's teenage daughters, said when informed of the exemption. "I wish we'd known that yesterday, because we bought stuff yesterday, too," said Ms. Conway, explaining that the group was here for a "girls' weekend." But the exemption, she added, would "bring us back here." Full Text

DIABETES

GlaxoSmithKline PLC (GSK) Tuesday said it will push ahead with plans to file its experimental once-weekly diabetes drug albiglutide for regulatory approval, following the read-out from a series of clinical trials. The British company said top-line data from seven of eight late-stage Phase III clinical studies had now been received and, when taken together, support advancing albiglutide toward regulatory filings. The new injectable medicine belongs to the same class of GLP-1 therapies as Denmark's Novo Nordisk A/S (NOVO-B.KO) Victoza, which was approved in Europe in 2009 and in the U.S. a year later, and Byetta from Amylin Pharmaceuticals (AMLN) and Eli Lilly (LLY), which was the first drug of the type. Merck taps 'American Idol' judge Randy Jackson for Taking Diabetes to Heart program

By: Allison Cerra

Drug maker Merck has introduced a new program that's designed to provide resources and information to help patients with Type 2 diabetes commit to living a diabetes-friendly lifestyle. The Taking Diabetes to Heart program was developed to help Type 2 diabetics understand that their condition can cause other serious health complications, including heart disease, which is a leading cause of death among people with Type 2 diabetes, Merck said. As part of the program, Merck has partnered with Grammy award-winning music producer and "American Idol" judge Randy Jackson to tour the country and educate patients about complications of Type 2 diabetes, as well as early and effective management of the ABCs of diabetes - A1C, or blood sugar, blood pressure and cholesterol - is a critical part of an effective treatment plan and can help reduce the risk of heart disease. For people with diabetes, foot problems can be common. And sometimes what starts out small can turn serious. But in some cases, there's an easy solution. To Lisa Summers, managing diabetes means staying educated and updated. "There are so many new things that are coming out, not only with medicine but with technology." A year ago, a recumbent bike at the gym turned a normal workout into anything but for Lisa. "I did not realize because of the neuropathy in my feet that my foot was slipping under the strap and it developed a blister the size of a dime." What happened to Lisa because of neuropathy, or dying nerve endings, is common. Full Text

Health and fitness briefs: Tips offered for healthy eating

By: Ken Raymond

Nutrition experts at Oklahoma County OSU Cooperative Extension Service offer these tips for eating well. Fill half your plate with a variety of vegetables and fruit. Dark green, red and orange foods are especially healthy. At least half of your grains should be whole. Choose 100 percent whole-grain breads, cereals, crackers, pasta and rice. Select low-fat or fat-free dairy products. These provide the same amount of calcium and nutrients but less fat and fewer calories. Eat a variety of proteins. In addition to lean meat and poultry, protein can be found in nuts, beans and eggs. Cut back on solid fats. Look for lean cuts of meat with little fat, and use healthy oils such as olive or canola oil for cooking.Full Text

BECOMING CERTIFIED IN PEDORTHICScped
Pedorthics is a professional field covering the design, manufacture, modification and/or fit of footwear. Pedorthics encompasses shoes, orthoses and foot devices that prevent or alleviate foot problems caused by disease, overuse, injury or congenital defect. Certified Pedorthists work with patients and their footwear to conform to a doctor's footwear prescription as part of the patient's treatment

To earn certification in Pedorthics, you must take a pre-determined number of course hours in pedorthics and pass a certifying examination overseen by either The American Board for Certification in Orthotics, Prosthetics & Pedorthics® or Board for Certification/Accreditation, Int'l.  Both the ABC and BOC are independent certification bodies that set standards for the profession and offer certifications that are recognized by the National Commission for Certifying Agencies.
