Comment: CMS recently published a proposed rule in the Federal Register which would call for a 10-year review period for various claims, including DMEPOS. This rule could be alarming because if you, like most suppliers, destroy your patient files after 7 years you could face a recoupment for reimbursements on patients which you no longer have evidence or proof of delivery because you no longer have the patient files. Every supplier needs to make official comments to this proposed rule.
The proposed rule is published in detail by clicking here. This rule is a response to part of the Patient Protection and Affordable Care Act. It is calling for stricter policing of over payments, changing the "lookback" window to 10 years to hunt for over payments that could be recouped.
The 10 year window and other aspects of the proposed rule could cause problematic for providers. Since the current standards require a minimum of 7 years for record retention suppliers could be caught off guard not having the necessary documentation to defend their claims.
Providers can send comments on the rule. The deadline for public comments 5 p.m. Eastern Time, April 16, and providers can submit their questions via:

Comment: Last week I placed an order with New Balance for 3 specials. All 3 were back ordered until April 6th. As always, I notified my customers hoping they were willing to wait. A day later one of the three customers called me bewildered about the back order because he had gone to the company website and found he could get the shoes at once directly from online. Not to mention at the minimum allowable advertised price which is $10 less then their suggested retail price and of course free shipping and no sale tax. After hearing this I went on the company website, and to my amazement, all 3 of the back ordered shoes were available directly from them. Just a few days earlier, I remembered ordering a special from Saucony that was back ordered until June, so I went to the Saucony company website and, again, the shoe was available for immediate purchase. So today, I ordered another 3 specials and once again all were back ordered until April, but when I checked all were available for at once purchase from the company website.
Of course, I wrote and called my reps, customer service and management for both companies, and all had the same answer, that the websites have their own inventory that was not accessible to the retailer. They did do everything possible to help me with this issue, and luckily I managed to get 4 of the 7 specials. So, after spending time sitting and fitting these customers, I can expect to complete a sale on 57% of them? At this rate I should easily be able to stay in business for a few more months!
I perfectly understand why vendors have direct to consumer sites. Many of us smaller retailers only carry a small sampling of what these companies make, and the consumer should have access to the vendor's complete offering. However, when they offer free shipping, sell at MAP instead of suggested retail, have promotional days and weeks, tax free, and have exclusive inventory that we can't access, then they have become direct competitor to all of us.
Sure, the vendor can afford to have a large inventory position for their site... they get it at first cost! Most of us retailers will never have the OTB to compete with that. Don't you think that running out of core inventory that supports the retailers is in the best interest of these vendors? We retailers set up the consumer by sitting, fitting, explaining the product features and benefits, and after convincing the consumer, the only access to that product is from the vendor? Of course....they cut out the rep commission, the retailer, and just increased their margin by 300%!
It's bad enough that these companies can't protect us from the internet only sites that are selling their products for $20 to $30 below their MAP once the consumer "adds to cart", but now the vendors themselves have become part of the problem! If we don't band together as independent retailers with the support of our professional association, I see a future of manufacturers selling directly to consumers with no more independents. Then, no more NSRA as well!

Response: I just wanted to say, Steven, I feel your pain. We too have been running into walls when dealing with different shoe companies (seemingly more-so lately). We are an O&P facility and while we do have some stock, we aren't large enough to buy in bulk "future orders" like an online or big box store. Many times when trying to order shoes, the previous season's catalog is too old and the shoes are no longer available; or the current season's catalog is for future orders and they are not yet available. It's getting quite frustrating. We had these same struggles with Birkenstock and VANS in the past. With Birkenstock, it got to the point that our orders were being back ordered for 6 months! We finally gave up and closed the account. With VANS, they cut most of their pediatric line and since we weren't ordering in bulk (the ones we ordered weren't available anyway) we gave up and closed it as well. I thought I read something like 80% of U.S. shoes are made in other countries. We've run into back orders with shoes being held up by customs in Mexico and sometimes we're waiting on a boat shipment from China. I've had 11 years in Pedorthics (10 as a C.Ped.) and don't remember it ever being this bad. Voicing complaints to the companies is sometimes good in that, if they care, they will use the criticism constructively. I recently had this with New Balance over the re-design of the 811 to the 812. Many years ago I found their 811 to be an awesome upgrade to the 810 and began using it as my go to athletic shoe for most of my patients. Unfortunately the 812 presents with a more shallow heel and an increase of padding around it. When using a custom FO in the shoe, it has become the perfect heel slippage storm. I recently had a diabetic patient rub blisters on her Achilles and have since stopped recommending this shoe. I sent a complaint to New Balance and they told me to look to their future shoes and that they will take this into consideration when designing. My fingers are crossed for the future. Until then I have taken to suggesting other shoes to my patients instead. I appreciate that I got a human response and that they will, indeed, take my complaint into consideration. | Barefoot Running Less Efficient Than Lightweight Shoes
According to a study conducted by researchers at the University of Colorado in Boulder, running shoes make running physiologically easier than going barefoot. The study, published online in the journal Medicine & Science in Sports & Exercise, began by recruiting 12 well-trained male runners with extensive barefoot running experience. The New York Times indicated that a few previous studies have indicated that it's easier to go barefoot in terms of physiological effort since more effort is required to handle the extra weight of a shoe. Local shoe experts focus on runners' fit
Every day, more people lace up their sneakers and set out on the open road. But new runners might not realize that if their shoe doesn't fit or provide the right support, it could hurt their feet, knees and hips in the long run. Local sock and shoe retailers said people often buy the wrong kind of shoe or wrong size, which can literally throw their bodies off balance and cause foot problems down the road. | Alzheimer's disease and diabetes may be related
Alzheimer's disease may be associated with insulin resistance, constituting a third type of diabetes, according to two new studies. This Model is based on several observations including an increased risk of developing Alzheimer's disease for diabetic patients, and reduced insulin levels in the brain tissue of Alzheimer's disease patients.Though intriguing, the existing evidence does not reveal if defective insulin signalling is causative of Alzheimer's or how insulin resistance impacts cognitive function. Two back-to-back research articles led by Konrad Talbot, Steve Arnold and colleagues at the University of Pennsylvania and by Fernanda De Felice, Sergio Ferreria and colleagues at the University of Rio de Janeiro, address the connection between insulin resistance and Alzheimer's disease. Type 2 Diabetes which affects nearly 26 million Americans, may have met its match. And Cris Iaboni, a 48-year-old mother of two from Bethany, Conn., may be one of the first victors. Diagnosed when she was 38 years old, Iaboni was fighting a losing battle with her diabetes. With the help of her endocrinologists, she did everything she could, aggressively limiting carbohydrates, exercising and taking her medications. But her diabetes only got worse. Rates of stroke and kidney failure in people with diabetes have reached record levels, according to a new analysis. The conditions - which are complications of diabetes - jumped to their highest level in 2009/10, Diabetes UK said.
More than 16,000 people with diabetes in England are estimated to have had a stroke in 2009/10, based on an incidence rate of 0.69%.
This represents a 57% rise since 2006/07.
More than 8,800 people with diabetes are also thought to have suffered kidney failure in 2009/10, based on an incidence rate of 0.38%. This is 31% higher than in 2006/07.
In the UK, there are currently 2.9 million people diagnosed with Type 1 or 2 diabetes. Full Text
