NEW QUESTIONS AND COMMENTS Comment: In the latest edition of Current Pedorthics, there is a good article about pedorthists being suppliers SCFOs. I particularly liked seeing the photo of the person's leg that referenced the exact 'scope of practice' anatomy for pedorthists according to ABC's rules. Obviously, BOC's scope of practice for its pedorthists allows for the supply of full length AFOs. The SCFO designation for AFOs that fall within the scope of practice of ABC pedorthists seems designed to get around the political issue of not threatening ABC's large dues-paying membership of orthotists. As a BOCPD, my scope of practice was never limited to SMOs or SCFOs. Thanks to PFA for putting this clinical info into Current Pedorthics and for giving this non-diabetic shoe direction for its pedorthic members to grow their revenues and to service patients needing more than foot orthotics to control gait or deformity conditions. It is pedorthists that do AFOs/SCFOs who can now come out of the closet. - John Mishasek, BOCPD, CPed Question: I've asked this question in the past and I still can't seem to get a satisfactory answer. Some of the major running shoe companies have, for some reason decided to make neutral cushion shoes that actually function as pronation control shoes. My idea of a neutral cushion shoe is that it should be neutral and provide more cushion via lower durometer materials. What I am seeing is shoes that are thicker soled on the medial v lateral side. The most puzzling part is they are using very soft durometer material on the lateral side, especially in the crash pad portion of the shoe. As any buyers guide will show, a neutral cushion shoe is typically suited for supinators, cavus or under-pronators. As a result, I am seeing many patients that will prematurely crush and break down the shoe and in some cases they will grossly invert in a brand new one right out of the box. This is also occurring in spite of having them in a cavus orthotic with lateral posting and a lowered medial arch. I have had to return/swap several pairs in one brand but I have seen it in some Asics, Nike, Brooks and New Balance models over the past 1.5 years or so. My only guess is that some testing or theory I am not aware of, dictates making the crash pad and lateral border much softer to attenuate shock. However, doing so in an underpronator/cavus person, only encourages inversion and supination.....precisely what we are trying to mitigate. I also realize, in true running scenarios, there is less time spent in pure heel contact before it transfer to forefoot loading. That said, I would imagine that the large majority of running shoes are not actually used for any significant running. It's not only low durometer EVA. I've also seen this issue in some shoes that utilize pods made from visco-elastic polymer type gel material that is not robust enough to control inversion. I would hope this trend is corrected soon because it makes absolutely zero bio mechanical sense to market these as neutral shoes - Brian Graham, C.Ped Comment: I have been reading some of your articles about charting and find it very interesting that some people are creating their own chart notes, dba forms, etc. to get the Doctors to chart effectively so that Medicare will not deny their claims. Another really exasperating thing with chart notes is who are we to question the Doctor? I know they are feed up with all of us questioning their capabilities to chart. And now a PA has to have a Doctor sign off on orders they write? We also have been getting cert letters for well over a year and work very closely with our Physicians to get the chart notes before we give the shoes to the Clients. Every time we bill we do get one of the cert letters, I use to cringe but now it is just the way we do business. We have to wait for payment after it is submitted to the Audit team. Medicare states they will not accept chart notes that we have prepared and had the Physician sign. Maybe if you received chart notes and they were not good enough for you to bill, an addendum might work, if so consider yourself lucky or not if you are in a 10% audit. Medicare is looking for a lot more than just the chart notes. Recently we had one denied because we did not have in writing that we saw the client walking in the shoes (we did), so now we have added that to our delivery document that the Pedorthist signs off on that says we saw the patient walking in the shoes. Hopefully, all Pedorthists make sure the shoe fits. But here is a new spin on walking in the shoe: What if the patient is in a wheel chair, how did you see them walk in the shoe? Is this creating denials on your behalf? Remember Medicare has all the Patients Chart notes from all sources such as hospital physical therapists. What if your Patient got a powered wheel chair, one of the stipulations to get a powered wheelchair is they are non ambulatory (can't walk). Contradicts the walking thing. Just wanted to keep you all on your toes, as Medicare is constantly thinking of ways to deny our claims. We have this on our delivery documents and still have received two denials because the auditor "must not be able to read." After resubmitting this and bringing the error to Medicare Auditors behalf, we get paid. I wish I could put them on a 10% error rate. I wonder how that would work. Any suggestions? I was looking at why this statement is even needed, and then I heard one of the "DME's" that is heavy in the nursing home business came by our store and said "I'm not getting paid on my accounts, do you have any suggestions?" All of a sudden it became clearer as to why Medicare is requesting this statement be answered for this issue. "Did you see Beneficiary walk in the shoes?" Well if the Beneficiary can't walk, or is bed ridden, quit putting shoes on them because they will not be able to use them and you are not going to get paid for them. No longer will Medicare just pay because the Patient has Diabetes and a condition they have to "Walk also", or at least scoot with their feet in a wheelchair. So maybe that is why Medicare started the Cert's and Audits they felt justified. It is coming from some DME's that are putting the shoes on comatose patients and we are all having to suffer the repercussions from these unscrupulous people that claim to be Pedorthists who really are just money hungry shoe fitters that have caused a lot of problems in our industry. One thing for sure, the License and Accreditation has stopped all the people coming into our town selling shoes in hotels, senior centers, etc to our Diabetics. I love the one who gave my Mom a pair of shoes after having her stand in the Custom Insert Box, (she weighs 180 lbs). Boy did she bottom out, and yes you can guess her shoes did not fit. Not only did they not fit her, they shipped the shoe and no one ever tried them on her. Anyway thanks for letting me vent. Wishing you all luck with the certs and audits as they probably will be around for awhile. So the best advice I have is get your chart notes upfront and the client can wait. Audit every order you get so you get paid and don't get put into that 10% charge back. Good Luck - MJ at Wellness Healthcare, Tennessee PREVIOUS QUESTIONS WITH RESPONSES Question: Has anyone, the ADA, ABC, PFA etc. bothered to point out to CMS that the new policies are doing serious damage to the "at risk" diabetics access to protective footwear? Do they not remember that in 1992 medical cost dollars; we proved that "expert fitting" of diabetic shoes and Inlays saved the CMS/Medicare money. Since 1992 our average per patient reimbursement has risen a whopping 50%. If we are lucky, how much has the cost of 4 days in a hospital on IV antibiotics risen? 1-2,000.%? Is CMS/Medicare making it more difficult for women to have breast cancer screenings? The TSB was supposed to be a preventative health program. Those type of programs should be expanded and promoted, not strangled. Do they have any figures on the amount of Fraud/Over payments from TSB providers versus any other provider group? I can't imagine that their financial losses were high enough to warrant the current crack down. How much has their costs of ingrown toe nails, toe infections and hospitalizations grown in the last 18 months? Is anyone asking these questions of our Healthcare officials, and our legislators? - PNW Reader Response: You are working from the assumption that all of this is done to actually provide patient care. This may have been the case at one time but now Medicare and indeed all government provided services are done primarily for political not practical reasons. The politicians and bureaucrats that make these rules are for the most part concerned only with increasing their chances of re-election or improving their job security. None of this is designed to improve patient care. If the primary goal of any of this was patient care you would not be held responsible for the Doctor not having proper notes or be denied for the slightest technicality, and Medicare wouldn't have auditors that are paid bonuses based on they amounts they "recover". How much of what is listed as fraud is in fact deserving patients that have been given service without the proper paperwork? I have a case pending where the Doctor has simply ignored my repeated attempts to get the notes and I will undoubtedly lose this case because of the doctors refusal to co-operate, despite the fact that this patient most definitely qualifies and benefits from the program. And yes, CMS is making it more difficult for patients to have testing and screenings done for anything. In my opinion these things are being done to cause the very frustration we all are experiencing as a means to justify the single payor system that the current administration really wants. As less and less of us accept Medicare, the narrative you will hear from the politicians will be all about how greedy we are as health care providers, and that the government takeover of health care is the only answer. When you come to realize that this is all about money and control and has very little to do with the actual health care of the patient you'll understand why they are doing the things they are doing. If you think it's bad now, wait till you see what happens if the new health care law is actually enacted. - Russell Dotson, C. | Former Dr. Comfort CEO Gets Year in Prison for Mail Fraud
Rickey Kanter, the former majority owner and CEO of Dr. Comfort of Mequon, has been sentenced to a year and a day in prison after being convicted of mail fraud, U.S. Attorney James Santelle said Friday. Kanter, who was also ordered to pay a $50,000 fine, was convicted of selling diabetic shoe inserts beginning in 2004 that failed to conform with Medicare's requirements even though they were being marketed as Medicare compliant. Despite being advised that the inserts did not conform to Medicare's requirements, Kanter continued to sell the non-compliant inserts in 2006. Under a separate agreement, Kanter sold his interests in the company and paid $27 million federal government to resolve civil claims against Dr. Comfort

A Prosthetic Limb That Lets Amputees Ride Bikes

A prosthetic limb and bike pedal that allows amputee cyclists to experience a full range of motion has been named as the U.S. winner of the James Dyson Award. Interestingly, for the second year in a row, the winning design is bike-related--last year's finalist was the Copenhagen Wheel. Cadence is a concept by Art Center College of Design student Seth Astle, who wanted to focus on helping below-the-knee amputees. Since about 47% of amputees are below-the-knee amputees, he knew his solution would be able to help the largest potential audience possible. As he began his research, he learned that although many below-the-knee amputees are able to use custom limbs designed for particular sports, there were many shortcomings when it came to prosthetics for cycling. | Using Smartphones to Manage Diabetes

The Department of Health and Human Services' Office of Minority Health will participate in a pilot project to evaluate the use of smartphones to deliver diabetes self-management training within an underserved minority community in Dallas. The pilot will measure the effectiveness of evidence-based interventions delivered to participants by diabetes educators using mobile health programming. Medicare will reimburse diabetes educators if a beneficiary's provider prescribes participation in the program. Full Text

Study looks at risk of gestational diabetes in women over 35

The number of women delaying pregnancy is steadily climbing in Canada, and a new national report suggests that diabetes, hypertension and giving birth prematurely are just a few of the complications these women face. Almost one in five births in Canada is to a mother over the age of the 35, but it's at that age that risks involved with childbirth and pregnancy start to increase. Mothers older than 40 are three times more likely to develop serious conditions compared to their younger counterparts while their babies could face chromosomal disorders, warned a Canadian Institute for Health Information report released Thursday. Although it wasn't significant, postmenopausal diabetes patients had a 31% greater risk of breast cancer compared with premenopausal women, but only within the first three months of diabetes diagnosis, Samantha Bowker, PhD, of the University of Alberta in Canada, reported during a scientific session at the European Association for the Study of Diabetes meeting here. | Mass. ranks number one for gym membership

When it comes to working out, Massachusetts comes out on top for gym memberships. One out of four state residents belonged to a health club last year -- more than in any other state. Whether that correlates to actually being the most physically fit in the nation is unknown, but it's probably some sort of indicator of our overall interest in fitness.
Gym membership nationwide in 2010 reached an all-time high of 50.2 million members, according to the International Health, Racquet & Sportsclub Association, which surveyed nearly 40,000 individuals on their gym habits. Gym members used their health club an average of 98 days in 2010 -- slightly less than twice a week, which is pretty good if spread over the course of the year rather than compressed into the first few months after making that New Year's resolution. Whether it's about politics, business, science, technology or health, most of us have easy access to the information that exists on any given subject. Before the Internet - if you are old enough to remember that there once was such a time - things were different. You had to go to a bookstore or a library and study up if you wanted to know about something in greater detail. Now, it's all literally at your fingertips. We are all experts now. While there is nothing wrong with a better-informed society - to the contrary - these changes have certain consequences we need to be aware of. Expertise and authority are being much more questioned now than they used to be. Not long ago, if you went to the doctor, he told you what to do to cure your ailment - and that was that. Today, it's more the other way around. My own clients bring me stacks of printouts from websites they've browsed through before scheduling their next consulting session.
