COMMENT: I don't know about you out there but, I am tired of doctors and patients yelling at me! Because of this, and other issues, we have decided to stop providing diabetic shoes to the diabetics in our area. After April we were done with that and I must say it is much calmer around here! We had a doctor who refused to go along with the TSB. He has yelled at me, my staff, and his patients when they ask for the form for their shoes. Getting the notes from him was impossible. He is from the diabetes center in our town. You would think he would take the time to understand what we were asking for, and why. He would not listen when I tried to talk to him. Other doctors have yelled at me when I tried to explain the new rules. One doctor kept saying, "I didn't order these, call the Podiatrist." I couldn't make her understand, so I ended up telling her to just say NO and Winifred will not get her shoes! Sorry Winifred. Honestly, when I looked at the numbers over the last few years that we have been providing shoes to diabetics, I was surprised. In 2010, 75% of our patient load were diabetics, which brought in 41% of our gross sales. On the other side of that, 25% of our patients, cash pay, brought in 59% of our income. Any good business person would tell you this is the business to build! I may be way off base here, but I truly believe Medicare will pull the plug on diabetic shoes in the next 5 to 10 years. I have heard that England has already done it. They would rather pay the for the amputation than the millions/billions paid out in shoes and inserts. I would say about 10% of our diabetic patients have already said they will pay for shoes and inserts themselves because they know I will do a good job for them, as I have in the past. The diabetic wanting their "free" shoes can go across town and get their "free" shoes. Actually, these patients yell the loudest and are the biggest pain in the neck! I let two part-time people go, downsized to one unit in our building instead of two. I am hoping this will keep us in business. It is amazing, the people coming through our doors now have money in hand. We don't have to wait for insurance to pay the paltry sum they determined was enough for our shoes and orthotics. Which, in reality, almost closed our doors for good! The Foot Solutions in our area closed last month. What a shame. The more Pedorthists out there, the more the public will recognize we are a growing profession and we can help them. I was really sorry to see them go. I hope we are here in a year. COMMENT: In response to several postings [in previous issues] about filing claims for Medicare beneficiaries when a supplier does not accept assignment, I wonder why a business would want to be a Medicare supplier and not accept assignment. The beneficiary is going to have to pay the full amount under this arrangement, so the beneficiary has lost the advantage of paying only the coinsurance amount at delivery. Yes, the supplier and beneficiary can agree on selecting more costly shoes that meet Medicare's TSD shoe specifications, but in reality, how often is that an issue, since the majority of patients are completely satisfied with good walking or casual shoes that retail for $100-$140? And if the supplier was to charge several hundred dollars for a true custom made insert, how many beneficiaries on a limited income are going to agree to pay this charge plus the cost of the shoes up front? Doing only non-assigned claims means to me that the business does not want to be a Medicare TSD supplier in its marketplace. So why be a Medicare supplier? All the risk (can still be audited) and very little revenue volume. Yes, the supplier can be more profitable on the occasional transaction, but when you factor in the risk of an audit, it does not make good business sense. Once we decided to terminate our supplier number when PCP chart notes became the method favored by RAC/ZPIC/Cert auditors to audit TSD claims, we started offering TSD "customers" the CMS-1490S form to help them to file a claim directly with CIGNA DMEPOS. Unfortunately, it appears that there may be an internal policy at CIGNA to stiff beneficiaries using this Medicare form for direct reimbursement, and to pay only the least expensive item on the receipt. Over the 40+ claims filed, CIGNA has paid something on every claim. But in every case, it was only 80% of the Medicare fee schedule for the item (80% of one insert, or 80% of a $10 heel wedge that was on receipt). The letter with the check tells the beneficiary that they can appeal the payment if they disagree with it. I guess CIGNA counts on the idea that the majority of beneficiaries will roll over and accept the underpayment Unfortunately for CIGNA DMEPOS, many of our previous TSD beneficiaries are retired military that have been used to fighting for their health care benefits all their lives. So most are appealing (some all the way to the Administrative Law Judge level of appeal) and winning on either the first appeal or the ALJ appeal. This makes CIGNA spend money with their outside subcontractor to handle the first appeal process, or they have to process the ALJ ruling and pay up, which makes both the beneficiary and us delighted to beat CIGNA at the game it is playing. Of course, the delay in payment is shameful, and should be a subject of investigation by 60 Minutes to reveal this suspected internal policy of failing to pay fully on legitimate self-filed claims using a legitimate Medicare form. Perhaps if more TSD suppliers dropped out and used this form, we would get enough beneficiaries to make it worthwhile for a class action law firm to get involved and file a suit against any DMEPOS that is harming beneficiaries in this way. - John Mishasek, BOCPD, C. Comment: I think the Therapeutic Shoe program is a farce. I know the studies showed that it would save Medicare money over the long haul, but that was before it become a scam. It does not serve this patient population well, and I won't compromise my patient care to operate within it.

India: Ignou, FDDI Launch Courses in Footwear Technology

Indira Gandhi National Open University (Ignou) has launched five undergraduate and three postgraduate full-time courses in the field of footwear, leather and other allied products this admission season. The programmes will be offered in collaboration with the Footwear Design and Development Institute (FDDI) across six cities.
According to the vice chancellor of Ignou, professor VN Rajasekharan Pillai, "These are professional programmes aimed at opening new avenues for students. | Treatment of Ankle Fractures in Patients with Diabetes

Patients with diabetes mellitus have a higher risk of complications after sustaining an ankle fracture, including fracture displacement, superficial and deep infection, hardware failure, and neuropathic arthropathy. With the increased incidence of diabetes among the aged, the increased incidence of complications due to diabetes mellitus and its sequelae are important to keep in mind when treating ankle fractures.
Ankle fractures are one of the most common orthopedic injuries. More than 260,000 ankle fractures are diagnosed annually in the United States, and these numbers are increasing as the population ages. Approximately one-quarter of all ankle fractures are treated surgically. With the increased incidence of diabetes among the aged, the increased incidence of complications due to diabetes mellitus and its sequelae are important to keep in mind when treating ankle fractures. It's no surprise that many Major League Baseball players wear tony sneakers --- but the umpires? Maybe tax collectors and dentists are more reviled than umps, but that hasn't deterred New Balance Athletic Shoe Inc. from signing on to become the official on-field footwear provider of Major League Baseball Umpires.
Through a multi-year agreement, Boston-based New Balance said it will supply all turf shoes, plate shoes and other athletic footwear used on-field. New Balance added that it will also support "Reviving Baseball in Inner Cities," or RBI, with a $50,000 product donation. Full Text
