Question: I do not take assignment for therapeutic shoes and inserts from medicare.  However, patients still want me to file a claim on their behalf.  The reason I do not take assignment is because of all the paper work and documentation.  When I file a claim, non assigned for the patient, for therapeutic shoes, I can not use the KX modifier because I do not have all the documentation.  But without the KX modifier the claim will be denied.  So it is a waste of time to send claim in without KX modifier.  Can the patient gather the documentation on his/her own and keep it on file and then fight it out with Medicare? Can I use the KX modifier on behalf of patient and not be held liable by Medicare for repayment if they are not sending me any money in the first place?  Or should I just refuse to file claim and let patient do it all?

Previous Response:  If you are a Medicare supplier, you are required to file for the
patients when you have the RX, regardless of whether you accept assignment or not.
The patients cannot file for themselves. That changed years ago. Also,
unassigned doesn't relieve you from documentation requirements or keep you
from losing money. If you do not have your ducks in a row, Medicare will deny,
and you either give the patient their money back and get the shoes back, or
give them the money back and you don't get the shoes back. Either way, you lose
moeny and product because you can't resell worn shoes. No one would buy
them.

The rules are the same for assigned and unassigned. You can't refuse
to file for a patient if you provide the product, unless the patients choses
a "do not file" option. You better get an ABN if you are filing without the
kx to cover your hindside. Medicare has a manual that explains that, but you
can also call their supplier customer service any time at 866-270-4909. Hope

Question: Previously we had purchased sponge rubber (not pedic rubber) neuroma pads, and we are starting to run out of this item. But a search of all our catalogs from various pedorthic and othotic material vendors does not show this item as currently available.  Does anyone have a lead on where to purchase sponge rubber neuroma pads?

Comment: I want to take exception with one assumption made recently in an analysis of the TSD by a contributor.  When speaking of the practice of dispensing six units of inserts "upfront," the writer says: "While this offers an obvious monetary improvement to the provider, it also decreases patient care both immediately and over time."

I disagree that it decreases patient care both immediately and over time.  I understand the theory behind this, but in the real world, I just don't think that is right, especially in light of the stringent documentation and paperwork requirements.  I would argue that in the long run, Medicare and the patients are better off with an "upfront dispensing" system, rather than an "over time" dispensing system.  I agree with the arguments made by the Pedorthic Coding Committee (see page HERE) regarding this issue, and I have some more arguments to add.  I am not taking exception to the original writer, but to this argument-which I hear many people make-so these comments are directed to the underlying argument.
 
Remember-the whole reason that there is a TSD is that the cost of the inserts is pennies on the dollar for what we are avoiding.  A pair of inserts is around $90, the fully loaded cost of an amputation is around $20,000.  If you are the payor, you can be "wrong" a lot on inserts and still come out way ahead.  Again, too, to complicate the issue-and to increase the necessity to err on the side of providing the devices-MANY OF THE PATIENTS HAVE PARTIAL OR COMPLETE SENSORY DEPRIVATION, SO THEY ARE NOT IN A GOOD PLACE TO MAKE JUDGMENTS ABOUT THEIR OWN NEEDS.  The benefit requires a certain level of benevolent paternalism by both provider and supplier, since the patient lacks the sensory input to make an informed decision.

Medicare doesn't cover three sets of inserts because they are nice guys.  They cover three sets because on average, diabetic/plastazote-type devices bottom out in just 3-4 months.  IF every patient could be counted on to religiously return for their follow up appointments and the Rx and SCP doctors could be counted on to update all documents in an error-free fashion, that would be grand.  However, due to the transaction costs to come in for an appointment-arranging transportation, etc., it is not easy for many beneficiaries to come back in unless they truly have a pressing need.  A problem with their foot would be a motivator to come back in.  Just going in to get the "additional" inserts might be rationalized away-and without the feedback mechanisms for their feet-could prove disastrous.

As mentioned before, it is hard enough now to get the documents right ONE time a year.  Can you imagine the outcry amongst the doctors if you were hitting them two-three times a year for Rx, SCP, and Clinical notes (all of these documents expire after a period of time).  That is an unnecessary burden on the entire health care system for very little pick-up in savings or benefit.  The last thing you would get is SCP doctors recommending the program if they know they are going to have to produce this type of paperwork THREE times per year.  That may be morally wrong-but that is the real world.

Is there any C.Ped out there who would refuse to see a patient for follow up visits if the patient came in 12 times a year?  I doubt it.  Legitimate providers are not going to cap their patients on follow up-there is no need to tie follow up visits to the dispensing of the other devices.  They can bring the devices back in with them for you to check and do the switch/rotation.

Why not put the devices in the hands of the patient upfront and tell them, "Hey, these are yours-you paid for them.  To protect yourself the most, you have to rotate them out-I wrote the dates on the bottom of each when you need to swap them out.  To be healthy, you have to take ownership of inspecting your feet and you need to take ownership of swapping these out on the required schedule.  Don't be penny wise and pound foolish-your feet need the protection these inserts provide.  Use them up as you should and you can get three more pairs next year." 

It's like the air filters in your HVAC unit.  If you have a prepaid service contract with an HVAC company-you have the economic incentive to make sure they come in four times a year and change those filters-you've paid for it and you are going to get that service.  If, however, you have to pay each time they change the filter-I'll bet you procrastinate.  I'll bet you delay.  I'll bet you try to go six months on a filter to "save money."  It is human nature-we all do it.  However, the filters need to be changed for a reason and if you don't, you are going to have a much bigger bill over time.  Even though we all know it-most people don't change their filters when required.  The petty annoyance of doing it TODAY seems so much bigger than some potential, uncertain large repair bill TOMORROW.  The same analogy applies with changing your oil.

I say this to all C.Peds:  Look, if the inserts don't work, then cancel the program.  If they have a one year life, then lower the number covered.  However, if you believe the inserts work and have a 4 month life, then dispense them and dispense them with pride.  Quit apologizing for removing the barriers for your patient getting 12 months of coverage.  Be proud that you have protected your patient from a delay in care resulting from either their own human nature and/or an uncooperative document provider.  Is anyone really saving money by skimping on inserts?  It's $90 versus $20,000.  If you still have angst, then call the patient every four months or send them a postcard and say, "Hey, it is time to rotate your inserts.  I also want to see you back in here to check your feet and I can rotate the inserts for you-bring them back in."  You know a large percentage won't come back in.  At least you have put the care in their hands and are not holding the care hostage.  You have given them every economic incentive to apply the care because they have "paid" for it "up front."  In that way-you have done the patient the most good and done the most to protect the payor from the cost of amputations-TODAY AND TOMORROW.  We should not apologize for it.  We should be proud of it.

Study Suggests an Alternative to Foot Amputation for Some Diabetic Patients
