NEW QUESTIONS AND COMMENTS
Question: In a recent discussion between DME students working nursing homes and Retail Students, two different perspectives came into debate. One perspective was that the "DME" company could "drive" the prescription by completing the CMN form for the physician using the patient's nursing home facesheet as the means for obtaining the primary and secondary diagnoses, and that the physician was responsible for verifying the information on the CMN form completed by the DME provider. The second perspective was that the "DME" company was performing an illegal action by completing any aspect of the CMN form, other than the beneficiary's (patient's) name, date of birth and Medicare number. Typically, in a retail setting the attending physician will usually complete the forms where the nursing home attending physician usually leaves them blank, with only his signature. Thus, the DME perspective is to assist the physician with completing them, and the DME student felt this was legal, while the Retail student said this was illegal. In my clinical experience and as an educator, I agree with the Retail Student.
Another consideration: Can a DME company have the attending physician sign a document stating that he (the physician) gives permission/allows the pedorthist who is assessing, fitting and dispensing the shoes, to assist with completing the form on his behalf; as long as he has agreed and approves of the primary and secondary diagnoses on the form completed by the pedorthist and then followed up with his (the physician's) signature on the CMN?
If anyone knows where there might be a formal document from Medicare defining any of these topics, I would appreciate receiving a copy. If anyone feels there is a person of authority that we could ask this question of and obtain some form of written validity, I would appreciate receiving their contact information.

Question: There was an article in the recent LER magazine's special educational series supplement that caught my attention. It was regarding diabetic orthotics. Without making this long and drawn out, I will get to the point. Some of the healthcare practitioners that were interviewed stated that custom diabetic orthotics (A5513) are only needed occasionally. A quote from Bill Meanwell states, "The A5513 is needed occasionally." He goes on to say "The problem that we have in our industry is that we get paid more for the custom device than the OTS (off the shelf). You are thinking with your wallet and not with your head." There were also other healthcare practitioners quoted who stated that OTS or A5512 were appropriate for the majority of their patients. I know that in my practice, I see alot of diabetics, and the majority of them have at least moderate nueropathy, boney prominances, high pressuure areas with callusing, wide feet, etc. The majority of these patients will require more than an OTS heat moldable orthotic. In my experience, the OTS orthotics that are available are cheap, mostly only dual lam. They generally wear out quickly. The other issue I have is that these devices never contour 100% to the patient's foot when heat molded. You also will have to add a scaphoid pad to the medial/longitudinal arch to make a total contact orthotic. What happens to the lateral longitudinal arch? It will just flatten. Then, adding a metatarsal pad takes time to get in the correct location. Adding any further modifications like heel lift, adding a reverse Mortons extension as proposed by Marybeth Crane, DPM, takes even more time. The big question then is: is this the correct orthotic for someone requiring all these modifications? The other question is: how do you get paid to do all of this work? A custom diabetic orthotic can be manufactured with almost all of the features listed above. If a practitioner is going to put that much work into the orthotic, they need to be paid for the work. I don't have time to try to make a Cadillac out of a Pinto and get reimbursed poorly for it. The time spent "customizing" the orthotic could be spent seeing other patients or charting. It concerns me that one of the Pedorthic profession's educators is being quoted in a highly reviewed journal as saying that pedorthists are "thinking with their wallet and not with their head." This is not the impression we want other allied professionals to have of us. I don't want my local referral sources thinking that I am fabricating custom orthotics for their patients simply to make more money. Does anyone else have an opinion on this? - C. Ped.
Question: Flat feet--some are born with the condition, and it often causes no problems. But flat feet in children are often overlooked. Arches that disappear when standing and ankles turning inward are signs. We believe flat feet should be checked out to prevent problems later. What are some strategies to increase awareness and provide help for flat feet?

Comment: Interesting photo advertisement - in issue #410; anyone notice the model's hallux extending (nearly) over the end of the shoe promoted? Makes me wonder what message we are sending as foot health providers to consumers and other healthcare providers. Am I old fashioned or am I too conservative in shoe fitting? I thought we were to have 3/8 to 1/2 inch from the longest toe to the end of the shoe; perhaps it is her leaning towards the mirror, that has made her foot slide forward in the shoe? Finding the positive in a negative situation or making a positive out of a negative is a win-win situation either way! With all the negative conversation in the PNW posted; I thought a little pedorthic humor and reflection might be uplifting and inspiring as we all try our best to make the right choices in our business' and relationships; and perhaps educational at the same time. - Pamela Haig, C. Ped. PREVIOUS QUESTIONS AND COMMENTS WITH RESPONSES Question: What is the best slip resistant shoe for culinary field customers who have plantar fasciitis? Typically the prescription from the podiatrist will request the supply of a running/walking shoe to be used with the orthotic that we are to supply, but none of the running/walking shoe brands we carry have proved to be really slip resistent on wet, greasy kitchen floors. We carry Sanita clogs that seem to work well after their plantar fasciitis has gone away, and we just picked up Klogs that are labeled slip resistant, but neither meet the requirements of the podiatrist's Rx for the initial treatment phase. Response: To be compliant with OSHA for food service, etc., shoes have to be permanently labeled or marked as such. Worker would have to be sent home (or out for another pair of shoes). An advertisement or claim alone would not suffice.

Question/Comment: We are not allowed to file paper claims. This started three to four years ago. We are also getting the audits [mentioned in previous newswire discussions] and it is very difficult to get paid on an audit claim. So far we're batting 0...I realize they are trying to eliminate the fraud going on, but it is crippling. The professionals like us have run business according to the rules. How can this go on, while we still have "out of towners" coming into our area to sell diabetic shoes with no "bricks and mortar" business within a hundred miles of us? I thought you have to have an office, as quoted in the rules, within 50 miles of your territory. While I am on the subject, why are drug stores still allowed to dispense diabetic shoes and inserts? Where is there Certified Pedorthist or Certified Orthotist? I was told by a Medicare inspector that they fall under a different category! Question: I thought it was illegal to offer merchandise or financial incentives to diabetics to come in for a fitting. For the last two years in February, a local concern has offered free diabetic socks if they fit you for TSB product. Are pharmacies and/or home health organizations allowed to do so? The socks will be distributed when shoes are delivered.

Response: The Anti-Kickback Statute (42 U.S.C. 1320a-7b(b)) states that it "Prohibits the offering, paying, soliciting or receiving any remuneration in return for: business for which payment may be made under a federal health care program, or, inducing purchases, leases, orders or arranging for any good or service or item paid for by a federal health care program." PREVIOUS QUESTIONS WITHOUT RESPONSES Question: I have some concerns of my own, but I'd be very interested in knowing what the rest of the Pedorthic Newswire readership feels is lacking or could be improved as far as the pedorthic industry's educational offerings - both pre-cert and post-cert.

Question: I do not take assignment for therapeutic shoes and inserts from medicare. However, patients still want me to file a claim on their behalf. The reason I do not take assignment is because of all the paper work and documentation. When I file a claim, non assigned for the patient, for therapeutic shoes, I can not use the KX modifier because I do not have all the documentation. But without the KX modifier the claim will be denied. So it is a waste of time to send claim in without KX modifier. Can the patient gather the documentation on his/her own and keep it on file and then fight it out with Medicare? Can I use the KX modifier on behalf of patient and not be held liable by Medicare for repayment if they are not sending me any money in the first place? Or should I just refuse to file claim and let patient do it all? - Scott Torppey, CO, C.Ped.
Question: Does anyone know if custom foot orthotics are excluded in the new healthcare plan or if they are covered? I think if they are excluded it would help the pedorthists that don't bill orthotics, and also would help our businesses so we don't have to compete with other MD, DPM, and PT that bill for foot orthotics. But if they are included in the healthcare plan, then how do we get on the provider list so we can do foot orthotics? Does anyone have any ideas on this? - Rodney Johnson, C. Ped.
ANNOUNCEMENT Pedorthic Standards Approved by NCOPE
The National Commission for Orthotic and Prosthetic Education (NCOPE) is pleased to announce that its board approved the Standards and Guidelines for Accreditation of Educational Programs in Pedorthics at its March 15 meeting in Orlando, FL. The Committee on Accreditation of Pedorthic Education (CAPE) and NCOPE have been fully committed to revising the standards and bringing the minimum education level for the pedorthic profession to a certificate level housed within an academic institution since coming under the NCOPE umbrella in 2009 and the April 2010 Education Summit meeting. NCOPE also acknowledges the generous support and funding from the American Board for Certification in Orthotics, Prosthetics, and Pedorthics (ABC), the Board of Certification International (BOC), and the Pedorthic Footwear Association (PFA) for the education meeting.
