Question: What is the best slip resistant shoe for culinary field customers who have plantar fasciitis?   Typically the prescription from the podiatrist will request the supply of a running/walking shoe to be used with the orthotic that we are to supply, but none of the running/walking shoe brands we carry have proved to be really slip resistent on wet, greasy kitchen floors.  We carry Sanita clogs that seem to work well after their plantar fasciitis has gone away, and we just picked up Klogs that are labeled slip resistant, but neither meet the requirements of the podiatrist's Rx for the initial treatment phase.  Help!

Comment: I would like to know what "joy" you and or your members receive by posting the conviction of a podiatrist or any other non-pedorthist? This person obviously has some significant "issues" which deserve medical evaluation and treatment. Certainly he also deserves to be punished appropriately. This may include jail time and revocation of his license to protect the public. But that is for the law enforcement and podiatric licensing boards to decide.

I wonder how publishing Dr. Haspel's problem in your newsletter positively promotes your profession?

Podiatry's profession's web postings usually limits itself to posting these sorts of news items only when it effects our own. My time (and that of  my podiatric colleagues) is too busy to spend scouring the OIG's sites for pedorthists O&P or MD/DO's or any other health care provider who have either been indicted or convicted of insurance fraud or use of illegal drugs.

To the best of my recollection I have never seen any postings on the O&P or MD/DO websites discussing the nefarious behavior of another professional other than one within their own family.Perhaps if you spent more time policing and promoting your own profession, you wouldn't have the problems your membership is complaining about. 70 to 80 people at an annual meeting is something you should be more concerned about than the actions of one bad apple in another profession. Clean up your own house before you start worrying about another's!

Response: Did I miss something here? If there was only 70-80 people at the last annual meeting, who were the other 800-900 people that showed up to the Congress (Which, in my humble opinion, was one of the best I've ever attended) in November?  ? ?Sure, there are those few Pedorthists who seem to complain but that is the exception, not the rule and I would even go farther and state that this would also be the case in the majority of professions. I too (as well as the majority of my pedorthic colleagues) am FAR too busy to even check my email throughout the day much less surf the web for those people who break the law. I personally take no joy in hearing of Dr. Haspel's problem and I truly hope he gets the help he needs.  I actually spend a considerable amount of time making sure I dot my i's and cross my t's so that I am in compliance, especially with all the new regulations that have come about. I agree with the editor that the article wasn't meant to point the finger at Podiatry, it just so happened that it was a DPM in the spotlight. It could have been a CPed, CPO or MD just as easily...

I respect the Podiatry profession and am fortunate to be able to work closely with several great DPM's in my area. What I do take joy in is the exchange of ideas that we share and ultimately, the positive progress of treatment of OUR patients. I respect your defense of your profession as I'm sure you would respect me for the defense of mine. Your post, however, is just another example of the "us against them" attitude rather than trying to find a positive way to work together towards a common goal, which happens to be....proper patient care!!!?

Response: I have not seen or read the article but I can tell you where I stand on issues like this: "You do the crime, you do the time." And if it was Medicare fraud, it should make the news just as any other fraud and abuse. I do not care if it was a physician or any other professional. These frauds are the reason why we see tighter and tighter restrictions on how to do our jobs.

PREVIOUS QUESTIONS WITHOUT RESPONSES




Question: I do not take assignment for therapeutic shoes and inserts from medicare.  However, patients still want me to file a claim on their behalf.  The reason I do not take assignment is because of all the paper work and documentation.  When I file a claim, non assigned for the patient, for therapeutic shoes, I can not use the KX modifier because I do not have all the documentation.  But without the KX modifier the claim will be denied.  So it is a waste of time to send claim in without KX modifier.  Can the patient gather the documentation on his/her own and keep it on file and then fight it out with Medicare? Can I use the KX modifier on behalf of patient and not be held liable by Medicare for repayment if they are not sending me any money in the first place?  Or should I just refuse to file claim and let patient do it all?

Question: Does anyone know if custom foot orthotics are excluded in the new healthcare plan or if they are covered? I think if they are excluded it would help the pedorthists that don't bill orthotics, and also would help our businesses so we don't have to compete with other MD, DPM, and PT that bill for foot orthotics. But if they are included in the healthcare plan, then how do we get on the provider list so we can do foot orthotics? Does anyone have any ideas on this?

Question/Comment: We are not allowed to file paper claims.  This started three to four years ago. We are also getting the audits [mentioned in previous newswire discussions] and it is very difficult to get paid on an audit claim.  So far we're batting 0...I realize they are trying to eliminate the fraud going on, but it is crippling.
 
The professionals like us have run business according to the rules. How can this go on, while we still have "out of towners" coming into our area to sell diabetic shoes with no "bricks and mortar" business within a hundred miles of us?  I thought you have to have an office, as quoted in the rules, within 50 miles of your territory.
 
While I am on the subject, why are drug stores still allowed to dispense diabetic shoes and inserts?  Where is there Certified Pedorthist or Certified Orthotist?  I was told by a Medicare inspector that they fall under a different category!  Where did they get their Orthotist or Pedorthic training?

Question: I thought it was illegal to offer merchandise or financial incentives to diabetics to come in for a fitting. For the last two years in February, a local concern has offered free diabetic socks if they fit you for TSB product. Is this something that is allowed? The socks will be distributed when shoes are delivered.

Even in relatively healthy people, it occurs if people sit or stand for any length of time. Gravity pulls fluid out of the circulation, and it accumulates in the feet and ankles. Two years ago, doctors closed a longstanding hole in Susan Dennington's right foot using a skin graft manufactured from infant boys' donated foreskin. Dennington, 52, suffers from neuropathy so she couldn't feel the pain from her diabetic foot ulcer, but the gaping wound made it hard for her to function. She spent much time and money keeping it clean and bandaged to protect it from infection. Several infections happened anyway during the 10 years her ulcer persisted, and there were times she thought the ulcer was finally going away only to have it return again.

"It was completely frustrating," she said. "My wound was on my mind every day."
 
Her doctor, Quyen Ha of Ada, Okla., said at first Dennington was skeptical about a wound-care product called Apligraf but was determined not to face amputation. "My job as a wound doctor is to save as many legs as I can," he said. Full Text

Ankle Sprains: Knowing When to Return to the Field

An ankle sprain is one of the most common orthopaedic injuries. In fact, approximately 25,000 people in the U.S. suffer an ankle sprain every day. Although ankle sprains are more common in athletes, they also affect those with sedentary lifestyles.

A sprain is actually an injury to the ligaments of the ankle joint, which are elastic, band-like structures that hold the bones of the ankle joint together and prevent excess turning and twisting of the joint. An ankle sprain occurs when there is an unnatural twisting motion. This can happen when the foot is planted awkwardly, the ground is uneven (stepping in a hole), or an unusual amount of force is applied to the joint. Such injuries happen during athletic events, while running or walking, or even during everyday activities such as getting out of bed. Full text

In cooperation with ABC requirements, Eneslow Pedorthic Institute (EPI) is offering the three-level competency training course for aspiring CPEDS. To provide maximum benefit in a minimum of time, a portion of the level one curriculum will be administered through a distance learning program that includes required readings, interactive CD's and testing of all mandatory topics. Upon passing the level one test, students will attend the remainder of the pedorthic pre-certification course at Eneslow Pedorthic Institute for 2 weeks during August 15th, 2011 to August 28th, 2011. This class completes required education prerequisite to sit for national certification exam. It does not satisfy the requirement of 1000 documented hours of field experience.
