NEW QUESTIONS AND COMMENTS
Question: I do not take assignment for therapeutic shoes and inserts from medicare. However, patients still want me to file a claim on their behalf. The reason I do not take assignment is because of all the paper work and documentation. When I file a claim, non-assigned for the patient, for therapeutic shoes, I can not use the KX modifier because I do not have all the documentation. But without the KX modifier the claim will be denied. So it is a waste of time to send claim in without KX modifier. Can the patient gather the documentation on his/her own and keep it on file and then fight it out with Medicare? Can I use the KX modifier on behalf of patient and not be held liable by Medicare for repayment if they are not sending me any money in the first place? Or should I just refuse to file claim and let patient do it all? - Scott Torppey, CO, C.Ped.
Comment: It is unfortunate that PFA does not have a bulletin board on their web site for Pedorthic discussions and communications. Helps improve communications out of committees - get more involvement. Instead, people are restricted to forums such as this. I think that all Pedorthists would benefit if there was a Pedorthic Bulletin Site for PFA. Bulletin Boards are cheap to add and improves discussions. - PNW Reader
Comment: As a career healthcare professional, I believe the future remains bright, and will be challenging but viable. I expect to see more interdisciplinary skills integration & collaboration; I count on seeing wonderful advancements in our field, while more horizons open. Opportunity knocks and interest remains alive, even as the economy burst and most of us juggle every day, but our greatest vulnerability is our great vulnerability. Comment: I would like to know what "joy" you and or your members receive by posting the conviction of a podiatrist or any other non-pedorthist? This person obviously has some significant "issues" which deserve medical evaluation and treatment. Certainly he also deserves to be punished appropriately. This may include jail time and revocation of his license to protect the public. But that is for the law enforcement and podiatric licensing boards to decide.
I wonder how publishing Dr. Haspel's problem in your newsletter positively promotes your profession?
Podiatry's profession's web postings usually limits itself to posting these sorts of news items only when it effects our own. My time (and that of my podiatric colleagues) is too busy to spend scouring the OIG's sites for pedorthists O&P or MD/DO's or any other health care provider who have either been indicted or convicted of insurance fraud or use of illegal drugs.
To the best of my recollection I have never seen any postings on the O&P or MD/DO websites discussing the nefarious behavior of another professional other than one within their own family.Perhaps if you spent more time policing and promoting your own profession, you wouldn't have the problems your membership is complaining about. 70 to 80 people at an annual meeting is something you should be more concerned about than the actions of one bad apple in another profession. Clean up your own house before you start worrying about another's!

I posted this article because many PNW readers are interested in cases of abuse of the Medicare or other reimbursement systems, and how they affect the overall program. However they are not intended in any way to point fingers at a particular profession or to separate the professions into any categories, or individuals who participate in them -- and in this case the article was not posted to point any fingers at podiatry or podiatrists. The articles are only intended to alert readers who are concerned about reimbursement and fraud to what is happening nationwide in these arenas, so that they an be aware of abuses and how they happen.

Question: Can anyone direct me to a source for golf shoes that are available in wide and extra wide widths, that are also suitable for splitting the sole for a build-up? I historically used the PW Minor Swing on an as-needed basis, but learned this week that they no longer make that shoe.

Response:We carry Tauer & Johnson shoes. They are a made to order shoe company, meaning you get to choose the leather, soling, etc. They fit people from size men's 7 4A to 20 6E. Their pricing system is a little confusing, up charges, etc., but the quality of workmanship is excellent. They do not do lifts for shoes, but you can request that they leave soling off the shoe so you can do the lift and then put on the soling. Tuaer & Johnson does require you to have a "fitting" inventory, but you are allowed to sell your fitting inventory. If your fitting inventory doesn't have the size you need, they will want you to order a trial fit shoe for fitting purposes, before going ahead with production on the final product. - Jesse Fischer, Pedorthist Intern, Comfort Shoe Specialists
Question: As someone who has been suffering on and off with Plantar Fasciitis in the left foot for about a year, I am wondering if any of our readers have known an athletic individual who has been able to completely rid themselves of the condition. If so, how did they do it? Of course, there are many recommended approaches and treatments, but I'm curious to know of any actual success stories. Thank you!

Response: Plantar fasciitis recovery protocol: footwear: longer shoe size, higher heel, more support; stretching regimen for Achilles/gastroc soleus complex; intrinsic foot muscle strengthening using open back, open toe contoured footbed sandal; pick up marbles with toes. Foot orthoses to control pronatory forces, absorb impact forces, reinforce propulsive gait during heel and toe off; rocker sole for apropulsive foot. Patience and perseverance! - Robert S. Response: I'm sure you will receive a great many responses to your query, I treat this condition in all age groups and activity levels and have found that correcting the bio mechanical dysfunction with either a custom made orthoses or a custom designed OTC (over the counter) orthoses and proper footwear is a crucial step, keeping in mind these devices need to be worn literally bed to the bathroom, and I mean literally from the very first step in the AM (no bare feet or sock feet in the home) augmented by a stretching program in the AM. This augmented by ongoing electro and manually therapies and a good home care program of rest, icing, stretching and strength are an integral part of the rehab program.
Treating this condition can take several months pending the cause and severity, but if you do all five things a patient should be doing you will recover and be able to return to your current activity level.

Response: I sympathize with you completely. PF is an onerous condition - very difficult to get rid of. I wanted to share some suggestions with you that are based on both anecdotal and personal experiences. I am a runner and I have had two fairly persistent cases of PF in the last 10 years. I did a number of things, and cannot point to any of them as being what did the trick, but altogether, they helped.
- First, I curtailed my running by about 30 to 40% (both frequency and distance);
- Second, I used some inserts that gave me increased arch support (length); - Third, I took alfalfa supplements on the advice of a pedorthist friend of mine. Alfalfa is purported to have anti-inflammatory effects. It is available in tablet form in the supplements section of drug and department stores. I took about 6 or 7 of those big pills daily.
- Fourth, I slept in a night splint. This, I believe, helped heal the condition as much as anything.
- Fifth, I continued to wear sock products to cushion my heel and help reduce impact that caused me pain. - Sixth, I did stretching exercises that I believe helped stretch both the plantar fascia and the Achilles tendon, both of which are implicated in cases of PF.
Of course I am sure you are aware of other more invasive and higher level treatments, but I believe it is best to try the least invasive methods first, and dial up the treatments only if those don*t work.

PREVIOUS QUESTIONS AND COMMENTS WITHOUT RESPONSES
Question: Does anyone know if custom foot orthotics are excluded in the new healthcare plan or if they are covered? I think if they are excluded it would help the pedorthists that don't bill orthotics, and also would help our businesses so we don't have to compete with other MD, DPM, and PT that bill for foot orthotics. But if they are included in the healthcare plan, then how do we get on the provider list so we can do foot orthotics? Does anyone have any ideas on this? - Rodney Johnson, C. Ped.
Question/Comment: We are not allowed to file paper claims. This started three to four years ago. We are also getting the audits [mentioned in previous newswire discussions] and it is very difficult to get paid on an audit claim. So far we're batting 0...I realize they are trying to eliminate the fraud going on, but it is crippling. The professionals like us have run business according to the rules. How can this go on, while we still have "out of towners" coming into our area to sell diabetic shoes with no "bricks and mortar" business within a hundred miles of us? I thought you have to have an office, as quoted in the rules, within 50 miles of your territory. While I am on the subject, why are drug stores still allowed to dispense diabetic shoes and inserts? Where is there Certified Pedorthist or Certified Orthotist? I was told by a Medicare inspector that they fall under a different category! Question: I thought it was illegal to offer merchandise or financial incentives to diabetics to come in for a fitting. For the last two years in February, a local concern has offered free diabetic socks if they fit you for TSB product. Are pharmacies and/or home health organizations allowed to do so? The socks will be distributed when shoes are delivered.

British Polio Fellowship Leads Discussion On Use Of Orthotics In The Treatment Of Post Polio Syndrome
The British Association of Prosthetists and Orthotists (BAPO) conference (4 - 6 March) featured a joint presentation on the effects of Post Polio Syndrome (PPS), a neurological condition that can occur in those who contracted polio.
The speech, focusing on the use of orthotics in PPS treatment, was given by Dr Mark Edworthy and Dr Robin Luff, representing the British Polio Fellowship, a charity dedicated to the support of those living with the effects of polio and PPS. Full Text

| Dealing with Diabetic Neuropathy

You know that "pins and needles" feeling you get after your foot falls asleep? Imagine having that feeling all the time, along with a burning sensation, and possibly numbness and loss of balance -- and no way to relieve it. For some diabetics, this is the daily reality of living with diabetic peripheral neuropathy, an irreversible complication of diabetes.
"When sugar levels are very high in the blood, the nerves, especially the sensory nerves, get injured or harmed," says Dr. Sonjay Fonn of Midwest Neurosurgeons in Cape Girardeau. "If it goes on for a long period of time, the harm to these sensory nerves is permanent. The only real cure is to catch this before it has become permanent and to prevent it from happening."
Most diabetics feel symptoms of neuropathy first in the lower extremities, especially the feet.
"It can affect any nerve, any number of nerves, any pattern of nerves -- but by and large, most who develop deterioration in the nerve endings feel it in their feet first," says Dr. Aaron B. Koonce of Southeast Neurology. Full Text

Diabetes "Belt" Identified in Southern U.S.
Researchers have identified a "diabetes belt," a cluster of 644 counties in 15 mostly southeastern states that have a prevalence of diabetes of 11% or more.
The belt includes portions of Alabama, Arkansas, Florida, Georgia, Kentucky, Louisiana, North Carolina, Ohio, Pennsylvania, South Carolina, Tennessee, Texas, Virginia, West Virginia, and the entire state of Mississippi. Full Text

Adidas will begin deploying a futuristic digital shopping wall at select stores from next year. The Adiverse virtual footwear wall offers access to all Adidas products and can watch shoppers while they watch it.
"What we're trying to do is give consumers access to the widest range of products that we can possibly offer no matter the size of the store," said Chris Aubrey, Adidas' vice president of global retail, during a news conference at this week's Cebit IT fair in Germany. To provide maximum benefit in a minimum of time, a portion of the level one curriculum will be administered through a distance learning program that includes required readings, interactive CD's and testing of all mandatory topics. Upon passing the level one test, students will attend the remainder of the pedorthic pre-certification course at Eneslow Pedorthic Institute for 2 weeks during August 15th, 2011 to August 28th, 2011.
