Question: Does anyone know if custom foot orthotics are excluded in the new healthcare plan or if they are covered? I think if they are excluded it would help the pedorthists that don't bill orthotics, and also would help our businesses so we don't have to compete with other MD, DPM, and PT that bill for foot orthotics. But if they are included in the healthcare plan, then how do we get on the provider list so we can do foot orthotics? Does anyone have any ideas on this?

Question/Comment: We are not allowed to file paper claims.  This started three to four years ago. We are also getting the audits [mentioned in previous newswire discussions] and it is very difficult to get paid on an audit claim.  So far we're batting 0...I realize they are trying to eliminate the fraud going on, but it is crippling.
 
The professionals like us have run business according to the rules. How can this go on, while we still have "out of towners" coming into our area to sell diabetic shoes with no "bricks and mortar" business within a hundred miles of us?  I thought you have to have an office, as quoted in the rules, within 50 miles of your territory.
 
While I am on the subject, why are drug stores still allowed to dispense diabetic shoes and inserts?  Where is their Certified Pedorthist or Certified Orthotist?  I was told by a Medicare inspector that they fall under a different category!  Where did they get their Orthotist or Pedorthic training?

Question: I thought it was illegal to offer merchandise or financial incentives to diabetics to come in for a fitting. For the last two years in February, a local concern has offered free diabetic socks if they fit you for TSB product. Are pharmacies and/or home health organizations allowed to do so? The socks will be distributed when shoes are delivered.

Question: Can anyone direct me to a source for golf shoes that are available in wide and extra wide widths, that are also suitable for splitting the sole for a build-up? I historically used the PW Minor Swing on an as-needed basis, but learned this week that they no longer make that shoe.

Question: Had the 4th patient this month presenting with a prescription for diabetic shoes and inserts. Evaluated, fitted, shoes on order, requested physician statement. Patient has diabetes and foot evaluation shows 2nd toe amputation on the right. Hallux is deformed, healing ulceration mid-foot left.

Certifying physician statement comes back from patient's primary MD stating that "None of the above conditions apply."

I call the patient and (even I had seen it with my own eyes) tell her that according to the statement, she does not qualify. I get an earful of the patient's opinion and am also told that I just lost a customer. The other 3 patients were similar cases. Each patient also stated that their primary had never looked at their feet.

Can anybody explain to me why it is that only a MD or DO can fill out and sign the Physician Statement? I understand why the MD or DO may have to certify that the patient has diabetes and is treated under a comprehensive plan of care for his/her diabetes (which is already not true if this physician is not evaluating the patient's feet).

Why can a DPM, a.k.a. "Foot Doctor" not be the one signing the certification form? Who are those people at CMS that come up with all these ridicules rules and criteria? What can we do to change this?

Response: Medicare is trying to clean up the fraud in the diabetic shoe industry. Let's face it, we all have seen the diabetic shoes at the flea market, or the guy selling them out of his trunk. I think they have done away with these people due to accreditation.
 
Now they are after the the abuse in the system. These are people who hear free shoes and want their pair. The reason for the CPF is to make sure the diabetic has one of the conditions that makes them eligible for shoes and orthotics. I have added to my CPF form a 7th line that states No Conditions Apply, for the doc's to circle. We have all seen the patient who has been diagnosed a diabetic for a month and want their shoes. Typically they have no conditions that apply! These are the people Medicare wants to stop this practice for.
 
I get it, it sucks! I spoke with a Medicare rep at the Conference in Orlando and was told they have tried over and over to get the MD's and DO's to check their diabetics' feet. They are not doing it, so it has been passed down to us to tell the docs what is required of them. By the way they (MCR) also want legible signatures from the docs. What a hoot!
 
When I do an evaluation for diabetic shoes, I tell the patient up front it all depends on their doctor that treats them for diabetes. I ask if this doc has looked at their feet in the last 6 months. If so I fax the information to the doc, if not they take the paperwork with a full explanation to an appointment with this doc. Be careful now, how many have had the family doctor fill out the CPF and take responsibility, when they have actually sent their patient to a diabetic doctor? When we ask for the notes there are none, so they contact the diabetic doc and think his/her notes are OK. They're not! The diabetic doc didn't sign the CPF! It took several phone calls to make the doctor's office staff understand why this would not work. It ultimately got denied by Medicare. (2010)
 
So, we either play the game or go sell widgets. I will play the game because if I give up the insurance part of the business, I will then give up my doctor referrals. They want to send their patient to someone who will accept insurance and many times (non-diabetic) insurance will not pay anyway. I have many cash pay patients and thank goodness for them, they keep me in business!

Response: I feel your pain! All week long I have been dealing with doctors not wanting to provide the proper documentation needed in order to provide  shoes for my patients.  Now, as of Jan. 2011, we are responsible for obtaining physician progress notes on top of an RX and the Satement of Certifying Physician for Therapeutic Shoes. When is this going to fall in the hands of the doctor? How often do you get a patient in your office who has a hand written prescription, and has not seen the doctor in 6 months or so? The doctor never charts the patient records to reflect that he dispensed an Rx, much less the diagnoses pertaining to the need of said equipment. How in the world can you obtain proper documentation under these cercumstances? I think Medicare needs to target the doctors, not the providers.

Comment: It is my opinion, based on my experience in the Pedorthic industry, that one major factor threatening our survival as a profession is the number of good, available Pedorthic jobs. I think this has to do with a crucial point wisely discussed at the 2010 North American Pedorthic Congress in the session 'Don't Just Move a Stone, Build a Cathedral,' where older generation C. Ped's were urged to consider what will happen when and if they can no longer work, decide to retire, get sick or die.
 
As a younger generation C. Ped., I urge the older generation C. Peds to open the doors to us. I cannot tell you how hard it is to find work as a Pedorthist. On behalf of the younger generation pedorthists, I urge you to mentor us, teach us, appreciate our skills and experience, and take us on as employees. Consider it a wise investment...insurance. We want your legacy to continue, we want Pedorthics to continue. We want your store to continue to be successful. We want to learn and add to our skill set.

Comment: Our industry is very disorganized, and if it is to survive, we will have to rethink how we fit into healthcare. We are still basically an unrecognized healthcare provider. PFA has not been able to create a strong long-term vision for our profession as it relates to CMS. Our industry is at the mercy of organized practitioners who do not care about the interests of the pedorthic community.I am referring to DPMs, the Pharmacists, and the O and P community.

I believe that we should try to work with the O and P community and join their associations, both nationally and on a state level. The O and P community is better organized and have much better funding than any pedorthic-based group. We should approach ABC and seek their endorsement.ABC is in a position to look at our industry with more depth. They credential C. Peds as well as fitters for shoes. It will be difficult to convince many C. Peds of this idea, but I don't see where we have a choice. PFA has done a miserable job and our industry is in peril.

I also think that the shoe industry should work together. My understanding is that they helped create PFA and slowly their input was weakened. The shoe industry has as much to lose as we do. I know that my shoe sales are down, and that can't be good for my vendors.The vendors should put their competitive nature aside and work collectively towards re-energizing the pedorthic community.

This statement was not made with malice, but with frustration. We have to get some positive traction soon. If we wait another year to start reorganizing, we will be in a deeper hole than the one we are in now, and in a more vulnerable position.

Federal Task Force Boots Medicare Shoe-Insert Crime Ring

Before we get into the guts of the criminal prosecution, let me give credit where credit is due. This case was brought as part of the Medicare Fraud Strike Force, supervised by the United States Department of Justice's (DOJ's) Criminal Division's Fraud Section and the U.S. Attorney's Office for the Eastern District of New York.

The case was investigated by:

    * The Federal Bureau of Investigation (FBI)
    * The Department of Health and Human Services (HHS) Office of the Inspector General
    * The New York State Office of the Medicaid Inspector General.

Also, the case was prosecuted by DOJ's Criminal Division's Fraud Section.

Official pronouncements inform us that since their inception in March 2007, Medicare Fraud Strike Force operations in seven districts have obtained indictments of more than 850 individuals who collectively have falsely billed the Medicare program for more than $2.1 billion. In addition, the HHS Centers for Medicare and Medicaid Services, working in conjunction with the HHS-OIG, are taking steps to increase accountability and decrease the presence of fraudulent providers. Footwear, Fashion Driving RFID Growth

Retailers are rapidly deploying systems that support item-level RFID tagging of apparel and footwear, according to an ABI Research report released earlier this month. The radio frequency identification systems "allow apparel retailers to get a better handle on inventory, [thereby] reducing costs and preventing out-of-stock situations that result in loss of sales," said ABI analyst Bill Arnold in a statement.

"The growth in retail item-level tagging is huge, both in shipments and in total spending. The average growth rate is close to 60% for the next three years," he said. Full Text

Girls' Knee Problems Are Often Foot-Related

Hey wait a minute, not only girls, but everyone! Persistent knee pain, especially when it's not related to trauma or specific injury, is often aggravated by foot mechanics. Whether it's the youth athlete, baby boomers, or senior citizens, foot type (flat feet, high arches, etc.) affect the knees. By the way, since most foot types are inherited, it's not unusual to see generations with the same mechanical foot-related problems - back problems included!

The startling amount of knee injuries in women and girls has puzzled doctors, therapists, and trainers for decades. Estimates are that females are five to seven times more likely to injure or tear the anterior cruciate ligament than their male counterparts. The ACL is one of the main knee stabilizers. High impact sports with lots of running, jumping, and direction changes like basketball, volleyball, soccer, or softball, are notorious for these injuries. The question remains as to why. Full Text

Sanofi-aventis and Toronto-based Sunnybrook Health Sciences Centre have entered into a research agreement and licensing option for vasculotide, an investigational compound to treat chronic wounds such as neuropathic and neuroischemic diabetic foot ulcers. Vasculotide is a synthetic peptide-based growth factor which targets Tie2, a receptor on specialized cells of the hematopoietic and vascular systems.

Diabetes Treatment Doubles

The number of US individuals receiving treatment for diabetes doubled to about 19 million (8.5% of the population) in 2007 compared with 9.1 million (4.6% of the population) in 1996, according to a new report from the Agency for Healthcare Research and Quality.

Along with substantial increases in the numbers of individuals treated for diabetes have come substantial increases in the costs of the disorder, for both the country and affected individuals. Based on data from the Medical Panel Expenditure Survey, a nationally representative survey of the noninstitutionalized US population that is sponsored by AHRQ and the National Center for Health Statistics, spending on diabetes increased during the same period, from $18.5 billion to $40.8 billion. Villanova's Stokes Plays with Insole, Footwear Adjustments to Protect Turf Toe

The boot that has protected the ailing big toe on Corey Stokes' left foot was nowhere to be found when 15th-ranked Villanova took to the floor for practice Sunday afternoon at the Davis Center. The 6-5 senior has missed the last three games with turf toe, but said he will play when the Wildcats (21-6 overall, 9-5 Big East) take on No. 17 Syracuse (22-6, 9-6) in a huge Big East showdown tonight at the Wells Fargo Center (7 p.m., ESPN).

"It feels good," Stokes said. "I'll be able to play."

Stokes is wearing a special insole to protect the toe. The shoe on his left foot also is one size bigger to give him a little more room. Stokes will come off the bench, Villanova coach Jay Wright said, and how much he plays remains to be seen. Full Text

In cooperation with ABC requirements, Eneslow Pedorthic Institute (EPI) is offering the three-level competency training course for aspiring CPEDS. To provide maximum benefit in a minimum of time, a portion of the level one curriculum will be administered through a distance learning program that includes required readings, interactive CD's and testing of all mandatory topics.
