Question: I wonder if anyone else who files to Medicare with paper claims is having the amount of mini audits we are getting? Every one I talk to that files electronically has not had the first mini audit from Medicare. We just got two more in the mail today, which takes the total to 27 audits we have received. Out of those, eight have been denied.

 

The denials coming back are due to the family physician not documenting the conditions in the patient notes. We now get the notes up front, and if the conditions are not documented in their notes, back they go to the primary physician. Then we have to contact the podiatrist to have them write a new RX, because it now has to be dated after the Certifying Physician Form.

 

So, what does Medicare have in store for us next? And will we be in business long enough to see it?

Question:
I was wondering how the C. Ped. community is reacting to the Medicare TSD. It seems to me that CMS is being penny wise and pound foolish by making the TSD almost impossible to implement safely. I recently read what PFA had suggested, and I don't agree with most of PFA's suggestions. I am wondering about the reaction from the Pedorthic community on the following:

 

1. Is TSD going the way of the dinosaur?

2. Do you see PFA providing leadership?

3. Have you thought of the possibility of entering into the O and P market?

4. Will you seek to diversify your practice into more retail?

 

These are just some questions that may provoke discussion.

Response: You are asking the wrong questions. How about querying, "How/what are you doing to comply with the new rules?"  "When you receive chart notes in response to an audit request, are the notes relevant ONLY to the diabetes diagnosis, or have you found - as we have - that prescription notes for such things as Viagra are included? "  Is that not a HIPPA violation?  How much time - and therefore - money - have the mail audits cost you?  Are the physicians responding in a timely manner, with the documentation that you requested?  Today we received chart notes describing a heart condition, with no mention of diabetes. 

 

How do you tell a first-time shoe patient who came in during early December wearing Crocs that were too short, who is now wearing a good, well-fitting shoe that she likes wearing, that she cannot get another pair of shoes now, in the new calendar year?  We told her in December that she could come in anytime after the first of the year.  Now we have to tell her she must wait until her only pair of shoes are sufficiently worn, or at least 9 months. As C. Peds, we know that wearing the same pair of shoes every day is an invitation to fungus, as well as rapid deterioration of the shoe.

 

Have you developed a system to make certain that the doctor's visit, the doctor's signature on the CMN and the actual delivery date/service date are within the new rules time frame?

 

On top of all of this, how do you deal with the myriad of insurance companies who change procedures constantly, requiring, for instance, prior approval of filling a physicians order for diabetic shoes? Hours spent on the "press 1 for English, press 4 for pharmacy locations, etc."  phone, only to finally reach someone's voice mail.  How rapidly is your call returned, if at all? 

 

Finally, Is PFA and/or ABC or BOC doing anything to educate our legislators regarding the insanity of these new procedures?  I would guess that the cost of the mail audit process far exceeds any gains. The physicians have no reason to comply with our requests, they are not "charged back" or penalized in any way for not having complete chart notes (and we know that they don't always even look at a patient's feet...).  We are somehow being held responsible for the physicians' actions. 

 

We're not planning to stop participating in the TSB program anytime soon.  But they're sure making it hard......

Question: What are the most successful pedorthic modalities used to relieve neuromas? What are being prescribed and dispensed in terms of footwear, and orthotic and shoe modifications?

Response: They are usually wearing shoes that are too short and/or too narrow. First, they need to get in the right length and width for their foot.  Metatarsal lifts on orthotics spread the forefoot enough to relieve the pressure.  We've done this a lot, and followed up with the customers to verify whether it works.  It does.  Nothing more than that is needed.

Question: How are other pedorthic retail stores dealing with the growth in Internet sales of shoes?  Has your business started doing e-commerce?  And if so, is it adding profitable revenues to your business?  Our business is feeling price pressure from customers who buy online for other items.  While we can justify pricing based on professional services rendered on the initial purchase, we wonder how to handle the customer that then goes online and when repurchasing the same shoe, asks us to match the online price.  We do offer a repeat customer discount but even with this discount, the Internet sites offer lower prices that do not reflect our overhead and inventory carrying costs.

Response: I must say, that until we are on a level playing ground, we will have difficulty competing.  As more and more get use to shopping on the Internet, we become less important to the consumer.  As for buying brands that are new and not yet on the Internet, by the time we have built the line to mean something, the Internet folks will have the product and then where do we go?

 

Should we decide to match the Internet prices, as I see it, we will become self-service.  So here is my slant on what could be done.  One, what the manufacturers are doing with the MAP program helps with the advertised prices.  What with the laws as they are, this is about all that they can do except not to sell the Internet companies.  And we all know that will not happen.  What they can now do is to put all of their shoes on the MAP list instead of just a few. 

 

Second, all of us independents need to contact our state and federal politicians and insist that a sales tax be applied to every transaction done on the Internet.  We need to get our organizations involved with this quest, such as NSRA and PFA.  We have to collect sales tax-why don't they?  Furthermore, since our local, state and federal government is having such bad financial problems, why would they not want to collect the billions of dollars they are losing because they don't make the Internet companies collect sales tax?  Now, the services that we, as independents, offer become of greater value.  Put me on a level playing ground with the Internet companies and I will kick butt. That is my opinion.

Question: We are getting an increasing number of GPs who are signing both the Diabetic Rx and the Statement of Certifying Physician (SCP) for Therapeutic Shoes for Diabetics (TSD).  Up to now, we have been sending two separate documents and requiring two separate signatures.  Of course, there is a lot of duplicate writing involved (name, address, diagnosis, etc).

 

Does anyone have experience with combining these two documents into one demarcated document to improve efficiency for GPs (i.e. on one page but with a line down the middle to show that there is both an Rx and an SCP on the one page)?  By experience, I mean have gone through an audit or a pre-payment review and either been successful with such documentation or specifically failed with such documentation?  Since logic seems to have little to do with the TSD, I am really intent on hearing from people who have been tested through an audit.  If you want to respond directly, please e-mail me at brett.richey@richeyco.com.

Holiday Sales Rose 5.7 Percent, Top NRF Forecast

 

U.S. retailers rang up their best holiday sales in six years, with the 2010 season's sales up 5.7 percent, according to the National Retail Federation. The sales, which combine November and December's tallies, totaled $462 billion, the retail trade group said on Friday. The NRF had forecast a 3.3 percent increase.

In a survey of 9,200 shoppers, Zappos.com took top honors in the sixth annual NRF Foundation/American Express Customers' Choice survey, conducted by BIGresearch. Thermometer to Save Diabetics Losing Limbs

A new handheld device could greatly reduce the number of ulcers and limb ­amputations in people with diabetes.  The device provides early ­warning of complications which, if left untreated, can lead to the limb becoming so ­damaged it needs to be removed.  Around 100 Britons a week undergo an amputation as a result of diabetes. Diabetic Neuropathy: Nerve Damage or Morton's Toe?

 

Enough diabetics suffer from foot problems to warrant a strong association between diabetes and nerve damage. "Diabetic neuropathy is nerve damage caused by diabetes and is described as a loss of sensation that starts in the tips of the toes and gradually works its way up the legs. Diabetic neuropathy is sometimes referred to as a stocking glove neuropathy because it progresses as if one was pulling on a stocking. Schuler, a podiatrist practicing for 36 years in Panama City Florida, a member of the American Diabetes Association, and Director of the Ambulatory Foot Clinic in Panama City, Florida ), claims it is easy to mistake neuropathies for another common foot problem. New Balance Funding Boston Snow Removal

 

New Balance is again helping out Boston-area runners this winter. According to an article posted on Boston.com, the footwear manufacturer is renewing its partnership with the city's Department of Conservation and Recreation (DCR) to fund the removal of snow along the 17 miles of Charles River basin pathways.
