Question: I
fitted and dispensed a pair of diabetic shoes in December of 2009. In September
of 2010 the patient came back irrate, stating he could not wear the shoes. He
had not notified us of any problems with the shoes prior to this.......and 9
months had passed. He returned the shoes (not in the original packing) and one
set of inserts (instead of 3) and it was obvious they had not been worn. I
was out of the office at the time, but was told no reasons were given as to why
he could not wear them. He was argumentative, defensive, and rude to the staff. What are our obligations as a DMEPOS supplier to rectify his 2009 diabetic shoe
through Medicare's Therapeutic Shoe Bill?

Comment: I received a mailer today from the PFA regarding
board nominees and voting for the 'Class of 2012 PFA Board of Directors', and
it reminded me of a recent response submitted by Shane Hayes, C.Ped, in the
August 18, 2010 PNW Issue #378, and its relativity to the upcoming PFA
elections.
Faith Ballard, C.Ped, 2010 Nomination Committee
Chair writes in the PFA letter on behalf of the Nomination Committee; " Every
attempt has been made to provide a balance of representations by selecting
pedorthic professionals who represent a variety of pedorthic affiliations,
differing geographic locations, cross credentials and strong depths of
experience in the various activities of PFA. I am grateful to the entire PFA
Nomination Committee for their conscientious work."
Of the 5 nominees listed for consideration, 4
have had extensive involvement with the PFA in some capacity or another, or are
current board members. How far does the nominating committee look for its
nominees, across the table? As far as differing geographic locations, there are
States and qualified PFA practitioners west of the Mississippi! Why does a
nominee need 'strong depths of experience in the various activities of PFA'?
What's wrong with youthful exuberance and fresh ideas?
Mr. Hayes recent critique of John Mishasek,
C.Ped's, 'puerile' comments included the following statement; "I would
propose that those C. Peds with limited skills set a new goal to get seriously
involved in pedorthics, expand their skill/educational base, and maybe even run
for the board to actually make a difference; verses standing in the corner
talking loud." I agree with Mr. Hayes on this point. However, it seems the PFA
has different criteria (see above), preferring to select from members of its
inner circle that have consistently supported the same PFA mantra. Would those that
talk loud and are willing to volunteer ever be considered?
I applaud those who volunteer for leadership
positions within our allied organizations; ABC, BOC, PFA, CAPE, COPE, etc., and
AM IN NO WAY QUESTIONING THE CREDENTIALS, NOR THE WELL INTENDED COMMITMENT,
OF THE PEOPLE NOMINATED OR THOSE CURRENTLY IN OFFICE.
In my opinion, the PFA could look a little
further for new volunteers, fresh ideas, and a larger selection of nominees, in
an effort to ameliorate our PFA, the member's organization, during these
difficult economic times.

QUESTIONS AND COMMENTS WITH RESPONSES
Question: There is an
interesting discussion taking place on Podiatry Arena about the effects and
advantages of Barefoot Running. Yet another new footwear explosion. Has anyone
had an experience with them? Since we (Pedorthists) are the foremost experts in
shoes and feet, what are your thoughts? -
Althea Powell, C. Ped.
Response: The barefoot running movement is here to stay. In addition, many shoe companies
are changing their footwear lineup to offer shoes that are minimalist in design
and structure. The majority of runners I have had contact with do not run
barefoot. They are a small element of the running population. Some may try it
only to discover their feet need some degree of protection. Anyone wanting to
run barefoot or in minimalist footwear needs to start very slowly, as little as
five minutes to start - on soft surfaces such as grass or dirt. The different
footstrike, on the forefoot, requires a changed stride. Barefoot and minimalist
runners typically run with a shorter stride with a quicker cadence, landing on
the midfoot or forefoot, with a slight forward lean so the center of gravity is
over where the forefoot strikes. The body should be relaxed rather then tight
or tense.
There are now four categories of what runners put
on their feet: nothing (barefoot), Vibram Five Fingers, minimalist shoes, and
the "normal" shoes offered by most footwear companies. I have talked to many
runners who have made the switch to Vibram FiveFingers and can now run without
the pain and afflictions that have bothered them for years. The FiveFingers
followers love the unique shoes. Many are switching to a minimalist shoe that
provides protection and a small degree of support. The Newton Running shoes are
a great example of an innovative shoe made for a forefoot strike.
Because of the changes in stride and footstrike,
running barefoot or in minimalist shoes can lead to injuries. Tendons and
ligaments need to be strengthened. Bones need to adapt to the new demands
placed on them. Flexibility needs to be developed. None of this happens
overnight - but many runners ignore the advice to start slowly. They need to
ease their way into it. Muscle tears, tendinitis, strained tendons, and stress
fractures could result. Common injuries are to the calf muscles and Achillies
tendon.
I am not a pedorthist, but am the author of
Fixing Your Feet: Prevention and treatments of Athletes (4th
edition, 2006, Wilderness Press). The 5th edition will be released
late 2010 or early 2011.

Response: I have had a lot of
conversations with people surrounding barefoot running here in Colorado. I've been confused by this concept being endorsed by so many
professionals. It seems like a move in the wrong direction, unless
"barefoot running" is clearly defined as such: Running/walking
on SOFT/Natural surfaces such as grass, dirt, sand, and the like. Anyone
who knows the natural gait cycle of a human being can't possibly come to the
conclusion that running barefoot on asphalt is going to be beneficial. I
hope that this new trend doesn't bring a whole group of people in to the
doctor's offices, because that would be a pity. You can't reinvent the wheel,
and you can't reinvent the gait cycle either. It is what it
is. Use your head when you see some new concept come around. Chances are it's either a gimmick, or it has a few conditions that come along
with its use.

Comment: I just wanted to take a minute and wish all of my former students good
fortune in the coming year. I will not be seeing you in Orlando this year as
the PFA has disbanded the Pedorthic Educators Committee and discontinued a very
long tradition of providing the educators a community table at the event. I
understand that traditional educators no longer hold as much importance to them
as they move forward with lobbying efforts towards a two-year degree program,
on your behalf. You might even get a chance to vote on a bylaw change to
officially do away with the Committee (and the educators' input to the Board),
then, maybe not. If you have an opinion on this matter, you may want to let the
PFA leadership know before the symposium. Their number is (800) 673-8447. Ask
for Brian. If not, please enjoy the flight, taxi ride, hotel and symposium. It
looks to be just about as good as it was last year.

Previous Response: All pedorthic pre-certification organizations were present at April's
educator stakeholders meeting to discuss the future of pre-cert education. At
that meeting, all of the stakeholders reached a majority and agreed
that pedorthic pre-certification education needed to be taken to the next level
in order for future pedorthists to compete on a level playing field with the
rest of O & P. The traditional educators will play a key role in
delivering the future AA degree in pedorthics that is envisioned. Pedorthists deserve the same opportunities as the rest of the O & P
community to practice to the fullest extent of their scope of practice;
be less burdened with government regulations; provide their
patients/clients with the highest level and widest range of pedorthic services;
enhance the respect and awareness of the pedorthic community of
practitioners amongst other allied healthcare professionals, state and federal
government decision makers, the credentialing organizations and the general
public.
This year's 2010 North American Pedorthic
Congress, jointly produced by PFA and the Pedorthic Association of
Canada, will be the largest pedorthic educational event in history. The lineup of general and breakout session speakers is extraordinary, as are
the networking opportunities, social events and location. This is
reflected in the tremendous international response to exhibit and
sponsorship opportunities and attendee registration.
Finally to correct Mr. Sevier's comments about
voting on bylaws changes, the PFA Board of Directors voted in April to
disband its Pedorthic Educators Committee because it was not fulfilling the
needs of the membership or the organization as the rest of PFA's standing
committee structure does. All of the educators were notified of this
move shortly after the board vote. Furthermore, the decision to put this
before a board vote was done after a majority of the educators
themselves expressed that the committee was not working as originally
envisioned, and overall participation on the committee was poor. This
in no way reflects a lessening of the relationship between PFA and the
pedorthic educator community.

New Response: As the PFA BOD liaison for the pedorthic educators committee, I feel it
is my responsibility to reply to Brian Lagana's posting in Pedorthic Newswire.
A few individuals who have a desire to change the education requirements for
pedorthists created a forum to accomplish their mission. This is nothing close
to achieving a majority vote of issues that affect all pedorthists. The agenda
of the meeting was specifically to increase the education requirements. So the
vote was pre-determined. The majority of educators did not agree with the
determination of the "majority." It is the belief of most pedorthic educators
that the current education and training formula is not broken and should not be
discontinued. There is no indication that increasing the education requirements
will level the playing field with the rest of O&P. The educators do not
believe there is sufficient audience to justify a future AA degree in
pedorthics. Most of us believe that practicing pedorthists are the highest
potential candidates for an advanced course, not entry-level aspiring
candidates. We are not against the idea of an advanced course. We believe there
will not be enough candidates to take the AA degree program.
As far as PFA dissolving the pedorthic educators
committee, this was decided by a few who do not believe that pedorthic
educators should sit at the education table with PFA's COPE committee. We spent
many years requesting a voice in the delivery of PFA sponsored education. When
we formed our own "Alliance of Pedorthic Educators" (http://www.pedorthicalliance.org/)
PFA came to us and asked us to disband and become a PFA committee. The decision
to dissolve our committee was done without sitting at the table with the
pedorthic educators. There was no discussion with the pedorthic educators about
how the Pedorthic Educators Committee should be
fulfilling the needs of the membership or the organization. The conclusions and
action taken by PFA was arbitrary, in my opinion.
We applaud the work of PFA and look forward to
participating in the 2010 North American Pedorthic Congress. We cannot sit
by while a few PFA individuals use their authority to exclude the group that is
responsible for training all of the pedorthists practicing today.

Rick, you are a great teacher and I know that the board is making a mistake,
and I will call to try to make a difference. I hate that people always
want to fix something that is not broken. That is like fixing a tire that is not flat, it is just stupid or you're
just sitting around being a bored C. Ped. Also, how many schools are we going
to put out of business with this new 2-yr degree plan, and who is going to
offer this at the university level?

Question: Does anyone out there have a preprinted form that
can be presented to the certifying doctor to fill out, that satisfies the
"valid written order" requirement? One would think that the
certifying statement form the physician has to also sign would be
enough. Why doesn't Medicare come up with a standardized form that
would incorporate all these requirements they are now enforcing?

| Retailers Planning to Hire About Same or More Holiday Workers
Retail holiday hiring appears headed
up this year. A survey of major retailers from the Hay Group finds 83 percent
of respondents plan to hire more or about the same number of seasonal workers
this year, up from 60 percent who said that last year.
The percent of retailers who said
they plan to reduce hiring fell to 17 percent from 40 percent last year.

Germantown Man Pleads Guilty to Medicare Fraud

Federal authorities didn't think the way a Germantown man
ran his diabetics shoe-insert business was a good fit for Medicare. Michael E.
Cohen acknowledged as much this week and pleaded guilty to government
allegations that since 2006 he improperly collected Medicare and Medicaid
payments totaling nearly $650,000.
Cohen, 61, ran a company in Cordova called NewGen Advance
Orthotics Laboratory that sold the special inserts to diabetics in Tennessee,
Texas and Florida, but used unlicensed private citizens to fit and measure the

Issues Label Change for Tigecycline (Tygacil)
Drug tied to higher risk of death compared to other
antibiotics used for serious infections
The U.S. Food and Drug Administration has updated the
Warnings and Precautions and Adverse Reactions sections of the drug label for
tigecycline (Tygacil), as the antibiotic has been associated with an increased
risk of mortality compared to other antibiotics used to treat serious
infections. The FDA issued the label changes based on a pooled analysis of 13
clinical trials with patients administered tigecycline for both approved and
unapproved indications. While the cause of the excess deaths in these trials is
uncertain, it is likely that most deaths were associated with infection
progression, according to the FDA.
Tigecycline is FDA approved for the treatment of complicated
skin and skin structure infections, complicated intra-abdominal infections, and
community-acquired pneumonia but is not FDA approved for the treatment of
hospital-acquired pneumonia or diabetic foot infection. Full

Squat in the Right Shoes By Phil Wagner, M.D.
Footwear seems to be a hot topic these days, whether it is
the proponents of barefoot training, five finger shoes, or newer designs that
promote better muscle activation and caloric expenditure. Unfortunately, all of
these trends focus more on running while exiling the power sports -- such as
baseball, football and volleyball -- which should avoid any cardiovascular
activities for fear of negatively affecting their performance (see Sparta Point
12/31/08). Unless used for walking to the refrigerator, power athletes should
not even own running shoes because of the high, rubber heel which poses several
problems in their training.
At Sparta, during squats and Olympic lifts, our athletes
wear entirely different footwear, commonly known as weightlifting shoes.
Weightlifting shoes have a much less compressible sole, significantly harder
than the running shoes mentioned above. This harder sole allows you to
efficiently transfer greater force into the floor, the most important
determinant in athletic movement (see Sparta Point 1/27/10). Softer shoes will
dampen this transfer of force into the ground and cause a loss of energy that
was created in your torso and legs. Most weightlifting shoes have either dense
rubber or wood, as the wood may even provide an added benefit of forming to

Pedorthic
Pre-Certification Training Course January 24th - February 7th, 2011
In cooperation with the ABC and BOC
requirements, the Eneslow Pedorthic Institute (EPI) is offering a
three-level competency training course for aspiring CPEDS. To provide maximum
benefit in a minimum of time, a portion of the level one curriculum will be
administered through a distance learning program that includes required
readings, and testing of all mandatory topics. Upon passing the level one test,
students will attend the remainder of the pedorthic pre-certification course at
the Eneslow Pedorthic Institute. The course includes the required tests for
competency to sit for the ABC or BOC exams.
Upon completing the course and successfully
passing the competency tests, and fulfilling the 1,000 hour "Clinical practice
Requirement" students are eligible to sit for the ABC or BOC exam to earn their
Pedorthic Certification (CPED or BOC Pedorthist). For detailed information on
