Question: I have neuropathy CMT with drop foot that
makes walking difficult. I wear braces whenever I'm going to walk
outdoors for a while. I have difficulty keeping my balance if the
surface is slightly uneven and it's hard for me to walk up a slight
incline. I would like to know - whenever I'm not wearing
braces, would it be of any help to wear orthotics to walk around the
house or when going for short walks? I asked this question to a doctor, who said, "Wearing
orthotics for the above reasons would not help." I would very much appreciate any information
you can give me. - Frank Biondo Question: I was wondering
what the regulations on prescription are regarding RX/DX information on the
prescription. I get several prescriptions for Therapeutic footwear and all that
is written on the prescription is "Diabetic shoes." Most of the time
there is no DX at all or it may say "diabetic." Is this enough to go
ahead and see/evaluate the patient (covered under Medicare) and order footwear
under the therapeutic footwear bill? Is
the prescription or the physician statement for therapeutic footwear the
priority document when providing diabetic footwear? -

PREVIOUS QUESTIONS AND COMMENTS WITH RESPONSES
Question: Here in rural Oklahoma one of my challenges is fitting diabetic shoes
and socks for patients with severe edema and/or obesity. We want lots of volume
across the instep and forefoot area, but a shoe cut low around the heel to
accommodate the ankle girth. The only one I've heard of is by Apis Footwear.
Does anyone have any other suggestions? Does anyone know of some seam-free
diabetic socks that can accommodate lower legs with a circumference of 23" and
over?? - P. Mitchel, C. Ped. Response: Severe Edema and obesity are normal problems for the
Diabetic population. For this reason, Dr. Comfort focused much of its design
effort on how to make socks that provide the necessary protection, but
comfortably accommodate over-sized, what we call "Extra Roomy" legs
and feet. It is quite difficult to manufacture socks with the extra size and
also keep the normal appearance of socks. So, most over sized socks look
unattractive to say the least. Dr. Comfort has invested in specially designed

Comfort Question: I know I have
seen comments on this subject in the past, but I think it is a gray area.
What are some thoughts on billing for L5000? Some will only bill for this
code if the patient has a complete transmet amputation. Others will bill
for complete transmet amputation as well as hallux amputation. Does a
hallux toe filler meet criteria for an L5000 (Partial foot, shoe insert with
longitudinal arch, toe filler)? - Joe Eads, C. Ped., COF Response: After speaking with
several of my colleagues (in Pedorthics as well as O&P) about this subject
in the past, the consensus seemed to be the following list of amputations
that would qualify for Medicare reimbursement under the L5000 billing
code: - complete hallux amputation only - complete 5th toe amputation only (including
the metatarsal) - complete hallux plus 1 or more lesser toes - complete 5th (incl. the metatarsal) plus 1 or
more lesser toes - TMA The amputations that do not qualify are: - partial toe amputations (e.g.- DIP
joint amputations) - 5th toe NOT including the metatarsal This list was not obtained from CMS however.
When I called and asked them in regards to this, the person I spoke to seemed
to think that the list was appropriate for L5000. I have used these
guidelines ever since that conversation. To answer your question: yes, the hallux toe
filler does meet the criteria for L5000 billing. The L5000 code does, however,
get abused a little bit so it is always good to fully document the level of
amputation that you are presented with. L5000 (Partial foot, shoe insert with
longitudinal arch, toe filler) as it is written here provides a pretty big gray
area as partial foot/ toe filler is not specifically defined. If anyone
has a clearer definition with specific amputations that qualify for this

Question: We have had
several requests as of late for pedorthic related products that will run on an
I-Phone/Pod/Pad or Blackberry. These are generally Pre-cert or CE in nature. We
have several CE apps that will run in that environment but are always looking
for ideas to develop more. My first question is how many practitioners out
there are utilizing current technology (iPhone/Pad/Pod, Blackberry, etc) in
their work environment, and secondly, who would if they only knew how to better
utilize this technology? -

Comment: Well, Region C finally
received the all expected prepayment reviews. I thought that we had prepared
our business to deal the progress note issue based on the prepayment review in
Region B. However, in the last section regarding the progress note required,
Region C essentially negated our plan. In response to the new criteria, my
business had to redefine our shoe program. I always thought that the best way
to run a shoe program was to have patients walk in and get fitted. From a
business standpoint, I have changed my view. I have not been able to deliver any shoes to my
diabetic patients since the prepayment review was initiated. My patients are
left wondering what's happening. The physicians are upset that they have to
provide more documentation after they have already signed a prescription and a
certifying statement. Now we're back asking for proof that what they signed is
essentially documented by a third party. It's RIDICULOUS! It will take time to launch the new strategy and
I have no choice but to add several of my employees to the ranks of the
unemployed. If the Federal Government wants to re-instill public confidence in
our economy, CMS has to be realistic about the "Change" that our
current administration promised. Our TSD programs were originally set up by
government to help prevent amputations. This change is choking the life this
public confidence program. CMS is being very shortsighted.

Previous Response: I will share my comments that I made directly to Tony. Early in our
endeavors as a Medicare supplier, we determined that one's attitude about
supplying Medicare covered DME technology had to be one of
thinking like the Pony Express. That is, you better have a fresh pony
available every 20 miles to dismount off the exhausted pony and jump onto the
fresh pony for the next 20-mile journey. When it was
published 7-8 years ago that the OIG was putting TSD benefits in the top
10 list of items to investigate, we determined that ramping up retail sales was
the sanest approach to stay in the TSD supply business but to hedge our
involvement with Medicare by growing non-Medicare revenues.
Yes, a retail customer can come back with buyer's remorse (or lower pricing
found on the internet) and request a refund. At least, we can find
compensation for time invested with this type of customer by using our store
policy of assessing a restocking fee and a sterilization of
shoes fee if the customer does not want to exchange our shoes for
another pair of our shoes. A Medicare
audit involves increased costs of copying files and of tracking Medicare's
response. With TSD's slim margins destroyed by chasing primary care
physician charts notes that still miss one element of Medicare's requirements
after multiple communications by our customer service staff, there is no longer
any reason to be a Medicare TSD supplier. Why risk a recoupment of money
that had no profit margin? As of June
17th, when the CIGNA email showed up that TSD claims would be subject to a
pre-payment audit before payment, we stopped accepting Medicare
referrals. These referrals became "self pay" as the only option
on June 18th. Are we losing revenues? Maybe. But at
least we know on the spot if it is money that will stay in our checking account
or not. No putting out inventory only to find a letter in our mail a
month later that the claim is subject to a pre-payment audit and worse
that the PCP left out one arcane element that the auditor could use to
deny payment for that claim. Being
indignant, upset, and righteous does not pay the overhead and employees'
payroll. Let it go, Tony. Move on. It is a frightening, new
world of politicians and bureaucrats and insurance executives controlling our
health. But that is really not new. It is just new to those who
have not seen it coming for many years and put all their eggs in the TSD
basket. The other
frightening thought for ABC and PFA is this: Why incur the costs of
being a Certified Pedorthist if most of your competitors in your
market are not certified but giving out business cards that say
"Pedorthist?" There is zip branding of Certified
Pedorthist versus pedorthist in our community and I imagine many other
communities across America. At the one-on-one level of customer service,
it is your knowledge, not your title, that keeps the customer coming back and
telling their friends, neighbors, and co-workers to come to you. So ABC and PFA
may reap what they have not sown if one does not need to be a
C. Ped. "qualified practitioner" to make a living after dropping out
of Medicare. - John

The beaucoup problems with Medicare not withstanding, your assessment of how to
actually run a pedorthic practice/business is spot on. But, you went off
the rails at the end by stating that your title has nothing to do with your
knowledge. Without your certification training and the mandatory
continuing education; you wouldn't have gained as complete of a body of
knowledge by sitting within your own four walls. I've
always maintained that pedorthics is so much greater than just diabetes.
A lot of C. Peds are guilty of not utilizing their full scope of practice and
falling into the "TSD Trap." Pedorthics existed 30 years before there was
a TSD and the demand for pedorthics will continue to grow long after the
TSD. I hope all C. Peds are realizing the growth I've seen in my practice
as the population ages and the news of my qualifications expands. -

Question: An article about "toning shoes" recently appeared
in USATODAYthat has a potential impact on pedorthists as
providers of toning shoes by "experts who can advise and train customers on
their proper use and application." What are PNW readers doing to capitalize on
this "revolution?" - Robert S. Schwartz, C. Ped., Eneslow Pedorthic Enterprises, Inc.
Question: No, really? Just received the latest PFA Magazine. There is an
advertisement for High Heel orthotics on page 17. Is this for real? I cannot
see how any orthotic would do any good in any high heel (especially in those
"exquisite spikes" shown). How can any orthotic give any support in a
high heel shoe. Didn't "Oprah" have something like this on one of her
shows? This brings me to the following question: should there be advertising
for very questionable products in a health related magazine? As a C. Ped. I see
myself as a footwear specialist who works toward long-term
maintenance of healthy feet and the prevention not the promotion of foot

BOC Revises
Requirements for Orthotic Fitter Certification After
a recent review and analysis of assessment and testing procedures for
certification as an orthotic fitter (COF), the Board of
Certification/Accreditation International (BOC), has updated its COF
requirements. Like the BOC Mastectomy
Fitter and BOC Pedorthist credentials, the COF designation will be awarded
based upon three requirements: completion of a required course of study,
experience in patient care under appropriate supervision, and passing a
three-hour multiple-choice examination that is conducted four times each year
in more than 150 cities. "The
demand for certification in orthotic fitting is growing," says BOC president
Claudia Zacharias, MBA, CAE. "When several respected education providers
suggested we re-evaluate the criteria for the COF, we launched an analysis of
the program requirements. Our Board strongly believes it is important to
increase the number of qualified health care providers available to patients.
Through the review and analysis process, we have been able to establish a
certification level that allows practitioners whose work focuses on fitting the
most-in-demand devices - orthotic, mastectomy and pedorthic - to follow similar
qualification stages in education, experience and examination requirements.
This will streamline the certification process and encourage practitioners to
consider learning to fit multiple devices, enhancing their value to patients

Women
who wear high heels daily might be signing up for more than a little foot pain.
Habitual high-heel wearing can lead to changes in the calf muscle and tendons,
according to a new study. So much so that these women actually experience
discomfort when they walk around sans stilettos.
The
high-heel habit can cause fibers in the calf muscle to shorten, and the
Achilles tendon, connects the calf muscle to the bone, to stiffen and become
thicker. While this set-up doesn't pose problems when the heel is propped up,
it can lead to discomfort when standing or walking around flat-footed because
the muscle and tendon are stretched beyond their normal range of movement. Full

Sales of Fashion
Footwear Are Up
If the trend in recent sales of
women's fashion footwear is any indication, the economy is starting to get a
spring in its step.
For a three-month period ending in
April, the women's shoe market was up almost 24 percent, according to the NPD
Group Inc., a leading marketing research company.
The biggest jump in sales has come
in the walking shoe category, which is up more than 100 percent since the same
time in 2009. The sales of casual shoes are up 25 percent and the shift into
the warmer seasons hasn't cooled women's interest in boots -- those sales are

Hemingway's
Son Approves New Footwear Line
The
82-year-old son of writer Ernest Hemingway says his famous father would approve
of a new line of shoes named after the Pulitzer and Nobel prize-winning author
that are divided into angler, literary and sportsman collections. Bozeman
resident Patrick Hemingway tried on a pair of loafers Friday at Schnee's Boots
and Shoes and says the best part is he can wear them without socks, and that

Study: Economy + Technology = 'XTreme Shoppers'

Think of them as robo-consumers: A
new study from GfK Consumer titled "Future Buy" reports that a full
31% of the U.S. population now falls into a category it calls "the Xtreme
Shopper," characterized by the amount of time they devote to finding the
best deals on everything.
"It's not so much that these
shoppers do anything that different than other consumers," Lew Paine,
VP/Gfk Consumer, tells Marketing Daily,
such as relying on Internet research, especially through mobile devices, using
multiple retail channels, and checking product reviews. "It's just that
this 31% do so much more of it. They are using many more touchpoints and more
resources. They visit more Web sites, and are more likely to participate in

New
Study Proves Care by Podiatrists Dramatically Decreases Lower Limb Amputation
Essential foot care by a podiatrist
has now been statistically proven to reduce hospitalization and amputation in
adults with diabetes, according to a first of its kind study conducted by Thomson
Reuters. The study will be presented by Vickie R. Driver, MS, DPM, during the
American Podiatric Medical Association's (APMA) 98th Annual Scientific Meeting
in Seattle, July 15-18, 2010. The presentation will highlight the dramatic
impact that as few as one visit to a podiatrist can have on patients with
diabetes.
The study, which was sponsored by
APMA, examined records for more than 32,000 patients with diabetes, ages
18-64, and compared health and risk factors for those who had podiatry
visits to those who did not. Researchers found that care by a podiatric
physician (defined as at least one preventative, pre-ulcer visit) was
associated with a nearly 29 percent lower risk of amputation and 24 percent
lower risk of hospitalization. Diabetic foot complications are the leading
cause of non-traumatic lower limb amputation in the U.S. Full

Diabetes Breakthrough, New Insulin Discovered

Diabetics, who need insulin injections daily, may
now hope for some relief with Indian scientists having discovered a novel form
of the hormone that can keep blood glucose levels down for up to three months.
A team of scientists of the National Immunology Institute of India, led by
Avdesh Surolia, has developed a fresh approach to insulin injection wherein
'Supramolecular Insulin Assembly-II (SIA-II)', a form of the hormone, is used
for a sustained treatment of diabetes mellitus type-I.
The studies constitute the first work of its kind where a single administration
of SIA-II to animal models of diabetes, such as rats, has been experimentally
demonstrated to lower blood glucose levels to normal values for as many as for

Season
The
Debris Inhibitor has been approved by the National Federation of High School
Associations for wear by players during high school football games in 2010.
Developed by Southern Sport, Inc., the cleat covering prevents debris found on
artificial turf fields from entering athletic shoes and socks.
Citing
the NFHS Football Rule 1-5-3k on uniform adornments, the Equipment Subcommittee
ruled that under the current language, "The Debris Inhibitor did not
constitute a violation of adornment."
According
to Eddie Parker, Southern Sport director of marketing, debris within the shoe
can lead to discomfort, distraction and possible injury for the player. The
athlete simply pulls on The Debris Inhibitor like a sock, but over the shoe.
