Therapeutic Shoes - In-Person Fitting and Delivery

 

Appendix C of the DMEPOS Quality Standards published in October 2008 addresses specific requirements for orthoses, prostheses, prosthetic devices, and therapeutic shoes. Those standards include requirements for "an in-person diagnosis-specific functional clinical examination" by the supplier to determine the need for a

particular item as well as "face-to-face fitting/delivery" by the supplier. Therefore, in order for therapeutic shoes, inserts, and shoe modifications to be covered, both of the following criteria must be met:

 

1. Prior to selecting the specific items that will be provided, the supplier must conduct and document an

in-person evaluation of the patient; and,

 

1. At the time of delivery of the items selected, the supplier must conduct and document an in-person visit with the patient to ensure that the shoes/inserts/modifications are properly fit and meet the beneficiary's needs. Read more here:

Comment: Healthcare reform was passed amid much controversy. Whether you are Republican or Democrat or Tea-Party, does not matter. Healthcare reform is here. What we know is that more than 32 million Americans will be insured. So how is the system going to insure previously uninsured Americans while still holding down the costs of healthcare? The answer is prevention. Healthcare Reform is set to waive the annual deductibles and co-pays for preventative healthcare. As an industry, the therapeutic shoes for diabetics, TSD has always been discussed as preventative. But what is TSD preventing?

Our shoe programs are really NOT about shoes. Our programs are about identifying high-risk patients and attempting to prevent foot ulcers. A diabetic foot ulcer is the leading cause of a lower limb amputation. Lower limb amputations are expensive to our healthcare system. In addition, statistics indicate that within 3 years of an amputation half of the amputees will die. We know that dying in the United States is expensive. Last year Medicare paid hospitals and doctors $50 billion dollars during patients' last two month of life.
 
Medicare is well aware of this statistic. In fact, Medicare has established a program via the Physicians Quality Reporting Initiative, PQRI that allows therapeutic shoe programs to perform foot ulcer prevention foot exams and to measure diabetics' feet for proper shoe sizing. Medicare's rationale for this, shoe trauma leads to foot injury that leads to ulceration that leads to amputation.  CMS is also aware that physicians do not make time to exam diabetic feet. These examinations are part of what TSD is designed to do. 

So, why would Medicare, CMS, the OIG, LCD and all the other governing bodies want to harm the one industry that was created to help prevent the costly amputation? Why are we being required to have physician progress notes. The medical industry is well aware that physicians are notorious for their lack of documentation. How many physicians have ever had their hospital credentials placed on hold until they signed off on their inpatient charts?

We need to defend our diabetic shoe industry as we part of the solution in the war for prevention.  But who should take the lead in defending the pedorthic industry?

Response: Tony, I may have missed something, so if you will please, bring me up to date:

 

1.  Tell me more about the CMS provision under PQRI that allows "non-MDs" to perform basic foot ulcer prevention examinations.  Who gets paid for this--the doctor at his/her office? And, must the exam take place in that office?

 

2.  What is the nature of the threat from CMS, OIG and the local coverage determination edicts that would harm "the industry" (I'm assuming you're speaking of the C. Ped. community of practitioners) with regard to the physician progress notes requirement?

Response: At this point PFA might be our only choice, but we need to rely on ourselves to protect our industry and get this preventative clause settled in our favor. I am putting together groups to get information and outcome-based information. It is up you -- the practitioners -- to do your part, and the manufacturers must do their part. We should have already had double-blind studies in place just for just this eventuality. I know it sounds like hindsight, but nothing involving the government should ever be taken for granted and we cannot be complacent. Any studies, data, etc. needs to be sent  to help build a case; PFA only had one to my knowledge but more recent studies and information have been sent to us. We need to mobilize immediately. Question: Has anyone had any success treating a Baxter's nerve entrapment/irritation with an FO?  If so, what type of FO was used...any special modifications?

Response: I am in the early stages of treating a patient (two weeks) with symptoms consistent with Baxter's Nerve Entrapment, and the initial results seem promising. I used a piece of material taped to the plantar surface of the plaster model of the patient's foot and molded EVA multi material to the model. The taped material left a channel (in theory to leave space so as not to compress the nerve) in the orthotic material. So far the patient seems to have pain relief. I can keep you updated if you would like as the treatment progresses.

PREVIOUS QUESTIONS AND COMMENTS WITHOUT RESPONSES




Question: Has anyone else had this happen yet?

 

We received four of the Prepayment Reviews from Medicare, we called the doctors and received the notes for the patients and sent them all back for review. Three went through fine and we received payment. The fourth is a lady from the Air Force Base Hospital in town; this one did not get approval because the base physicians do not follow Medicare guidelines and do not test their patients for neuropathy yearly, and there was no documentation for poor circulation or foot deformity that they circled on the CPF. Now we have to bill the patient, and this is a regular yearly customer, for the shoes and custom foot orthoses -- which means we have lost a patient because they won't be back next year, and I don't blame them. So, is my only option here to not accept patients from the base hospital just in case Medicare decides to do this again? Many of my patients are from this military hospital.  

It sure is tough making a living in this profession. We did a cost analysis for custom molded diabetic foot orthoses made in our lab. Cost is about $70.00 a pair for materials, salaries, and time. This does not include fitting, adjustments and follow-up appointments. Aetna pays $32 a pair, the same amount they pay for A5512's. They don't cover our costs on shoes either. Who can afford to lose money for each Aetna patient? We can't and won't.

 

Is it worth it? I wonder.

Question: With the recently announced meeting between NCOPE, ABC, PFA, BOC and the Pedorthic Educators, it seems that "formal" pedorthic education (which we all know translates into "associates degree") is finally looming on the very near horizon. As one of the 30 people invited to this function, I heard from many of the organizational heads of state that they thought this was the way to go.  So, what do you think? Is this a good idea? If so, are you willing to upgrade your skills to match (Anatomy/Physiology/Biology/Physics)? What is this going to do to the already slim supply of pedorthists in conjunction with all of the new patients entering the system through the new Healthcare setup? Can you afford to send your employee to school in another State for 2 years, and help pay their student loans off over the next 10 years? Good questions, and this is a great forum to let the organizations know what the men and women on the street think.

ASICS Seeks Injunction and Damages From Skechers USA

 

ASICS America Corporation (Irvine, Calif.) and ASICS Corporation Japan (Kobe, Japan) announced last week that they have filed a lawsuit in the U.S. District Court, Central District of California against Skechers USA, Inc. (Manhattan Beach, Calif.) for trademark infringement, unfair competition, trademark dilution and false advertising. ASICS is seeking a permanent injunction against Skechers to prevent any future sales and distribution of shoes that bear a stripe design similar to ASICS' famous stripe design. In addition, ASICS seeks damages, including profits and attorney fees.

 

This will be the second suit in three years filed by ASICS against Skechers based on Skechers' infringement of the ASICS' Stripe Design mark. The first lawsuit was settled [ASICS Corp. et al v. Skechers U.S.A. Inc., Civil Action No. 8:07-cv-00103-AG-PJW (C.D. Cal. 2007)].  Full Text

Pricing Mistake Costs Zappos $1.6M

Zappos.com created a lot of buzz this weekend, due to a pricing mistake on sister site 6pm.com.

From midnight to 6 a.m. Friday, the majority of items listed on the site - which typically sells products at discounts of up to 70 percent off - had a price cap of $49.95. The problem was eventually corrected, but the company still suffered a loss of more than $1.6 million in sales during that six-hour time frame, according to a blog posting by Aaron Magness, director of brand marketing and business development for Zappos. WTO Agrees to Probe EU Duties on Chinese Footwear

World Trade Organization judges agreed to investigate whether European Union anti-dumping tariffs on Chinese shoes unfairly harm China's exporters. China asked the WTO to rule after months of consultations with the EU failed to resolve the dispute. China lodged the complaint in February, two months after the EU said it would prolong levies on leather shoes from China and Vietnam for 15 months to help southern producers compete against lower-cost footwear imported by companies such as Nike Inc. and Adidas AG.

The EU slapped duties as high as 16.5 percent on 9.7 billion euros ($12 billion) of Chinese and Vietnamese leather shoes in 2006 to counter below-cost or "dumped" imports. Four- fifths of the EU's leather shoes come from Italy, Portugal and Spain, where producers are trying to become more competitive, according to the 27-nation bloc. Full Text

Pedorthic Pre-Certification Training Course July 26th - August 8th, 2010

In cooperation with the ABC and BOC requirements, the Eneslow Pedorthic Institute (EPI) is offering a three-level competency training course for aspiring CPEDS. To provide maximum benefit in a minimum of time, a portion of the level one curriculum will be administered through a distance learning program that includes required readings, and testing of all mandatory topics. Upon passing the level one test, students will attend the remainder of the pedorthic pre-certification course at the Eneslow Pedorthic Institute. The course includes the required tests for competency to sit for the ABC or BOC exams.
