CMS Is trying to put us out of business!
Why haven't the PFA,
ABC, BOCO,ADA, AADE,and the major diabetic footwear manufacturers filed a
federal lawsuit and or federal injuction against Surety Bonds, and even
more damaging Mandatory Pedorthic Facility Accreditation?
Just got
a flyer (see it here) from CMC/NSC/Palmettogba. Occupational
therapists are exempt from accreditation. So are Physical Therapists,
Orthotists, Prosthetists and Pharmacists and Podiatrists' and their
staffs, None of these Therapeutic footwear providers need to be accredited, but
a Pedorthist with 20 + years of experience needs to be?
Orthotists/prothetists,occupational therapists,physical
therapists, and doctors are also exempt from surety bonds.
Where is
the reasoning for this? Has CMS found massive fraud in pedorthic footwear -TSB
billing? I did not see any headlines!
This policy is blatantly
unfair and precudicial against the small independent pedorthic footwear
store. Accreditation requires hundreds of hours of paperwork and thousands
of dollars, and the end result is that small companies can't afford it and are
driven out of business.
Many thousands of diabetics do not know
about or use the Therapeutic Shoe Benefit. Many that do are forced to go
to Brace & Limb companies that offer no more than 2-3 brands, styles, and
colors. If the patient does not like the looks and feel of the
Diabetic Footwear, THEY WILL NOT WEAR IT. How will this reduce the
risk of toe and foot infections, ulcers, and amputations?
Please,
somebody help us to stop this absurd policy. Please pass this along to the
correct person/committee that can act on this. Someone must have a federal
attorney who can get an injunction. Please. I Know there are hundreds of
stores like mine that in this economy cannot survive this added level of
government b.s.

Question: Now that all pedorthic candidates are
required to devote 1,000 clinical hours in order to become a C. Ped., do you
feel that the profession will shrink in size?
- Robers Schwartz, C. Ped., Eneslow Pedorthic Enterprises
Response: I think we will see a decline, but as
long as the student can gain internship in their present employment, we will
still see individuals getting into the business. Most of them will be working
anyway, so the only difference is that they must wait to take their exam until
they have worked 1000 hours. The real concern will be when the ABC/NCOPE
requires it to be a well-rounded internship, meeting the criteria of
numerous products and services, or if they require that a student migrate to
various locations to complete all the requirements of experience. Time will
tell.

Question: In addition to charging for
orthotics, physicians are reimbursed by insurance companies and the government
for fees related to evaluations and casting. Pedorthists are not eligible for
the casting and evaluation fees as far as I know. Are any pedorthists charging
for evaluations and casting? Are third party payers paying these fees? How
should pedorthists handle assessment fees to improve revenue and margins?

Previous Response: I was wondering,
would you want to take on the role of wanting to be like a physician's office?
In my practice, I charge one fee that is $250.00-$350.00 depending on if it is a
plain sport orthotic to improve sport performance, or an orthotic treating
a medical condition. That one-time fee includes a 6-month
guarantee for workmanship and any mods like met pads, first ray cutout,
etc. and a lifetime guarantee on the shell for breakage. In my
practice the patient and customers that I see are a lot happier
to know that it's a one-time fee and you are not nickel-and-diming the
patient or customer to death.
A lot of doctor's offices are charging for an Evaluation,
Casting, and a Disp. fee and then, after that,, you have the cost of the
orthotic so your patient is looking at $500.00-$700.00, depending on who
pays what. That's great, but for me I can't sleep at night very well
knowing that someone had to pay that. For your podiatrists they get paid
only like $55.00 bucks on avg. per device and that is why they want a pair for
$50.00-$65.00 bucks at wholesale. The orthopedists get paid
around $175.00 on avg per device. I only know this because I
have a wholesale/retail orthotic business, but I also work with a podiatry
office, orthopedic office, physical therapy office, and a chiropractic
office. Every one of them has a different fee schedule for orthotic
reimbursement. Insurance sucks and they never treat the practitioners the
same even though they are billing the same L codes.
I think that it should be the same with orthotics as it is with
shoes and insoles -- it does not matter if you are a DPM, MD, or a C.
Ped. Reimbursement is the same on shoes and insoles. Also Insurance
does not pay for evaluation, casting, and disp fees. I think it;s just
for orthotics, if that. To improve your margins you have to be
efficient and be able to automate your pedorthic business.

New Response: I am not quite sure what
experiences the writer [above] is referring to w/respect to foot orthotics and
physicans (DPM and/or MD), but my experience has been quite different.
C. Peds and Orthotists may not be paid for an E/M, but your fee
schedules are generally higher for the orthotic devices
themselves because the insurance carriers typically bundle the
initial E/M and subsequent fitttings into their fees. Unlike Medicare, many
private carriers do not bundle all this into their orthotic fee schedues for
physicians. Physicians are paid separately for E/M because we are usually NOT
just seeing the patient for orthotic casting and fabrication. This
is especially true w/a patient who is presenting with initial or
change in their symptoms.Therefore, physicians may be reimbursed less for the
device, but they be able to recover other fees from E/M, fittings etc.

Response: We have always billed for casting for
custom orthoses, but not for custom shoes, as the casting fee is covered in the
price of the custom shoes. We use casting code A4590 for STJ neutral or biofoam
- originally in 1975 $50.00. In 1999, I raised my fee since there hasn't been
any cost of living/business increase. Thus I now bill $75.00 for casting.
Most traditional or managed care plans pay the casting fee. Medicare does not
pay the casting fee.
We charge $425.00, but we do a thorough
pedorthic biomechanical exam, case history, gait analysis, pedigraph, shoe
analysis, and cast at the initial visit. We offer three months of no-charge
visits unless we are under contract with your insurance; then you are provided
only two follow up visits, such as Anthem BCBS -- which, now, does not always
cover adjustments, yet they will pay for a new pair of feet orthoses per year. I
rarely dispense second pair. I am more conservative and cost conscious for
my patients, but the end choice is theirs to make, and their referring
physician's.

Question: I thought I remembered reading
something about a facility dispensing shoes to the diabetic public needed to
maintain a certain dollar amount of shoe stock. This may not be correct, but if
it is, could someone please point me to the place it was written? I've searched
the Web for quite awhile on it and nothing seems to come up. I checked DME, PFA
and MCS and couldn't find any info. I have people that want to get rid of most
of our stock and want to double check before they attempt to purge it.

Comment: This is in response to Rob
Sobel's comment in PNW 329 relative to PFA's lobbying
activities.
In addition to PFA's current Executive Director also
serving as Director of Government Affairs, PFA has retained a lobbyist active at
the federal level for the past 11 years. Over the years, PFA's federal
lobbyist, Bill Applegate, with Bryan Cave Strategies, has cultivated access and
built pedorthic awareness for PFA and its membership with key Members of
Congress and the Administration, CMS and other necessary decision makers
impacting pedorthics. While working with Applegate at the Federal level,
PFA's Executive Director has also taken the lead on expanding pedorthic
awareness at the state level, providing testimony supporting pedorthic licensure
in numerous states over the years, educating state legislators and their staff
on pedorthics at the National Conference of State Legislators, etc.
Together, PFA's two lobbyists have almost 40 years combined experience lobbying
federal, state and local government.
The biggest issue that PFA has
tackled since December, AND CONTINUES TO WORK ON, is CMS decision to rescind
the facility accreditation and surety bond exemption for pedorthists. Not
only is this a significant issue, but, despite our best efforts in reaching the
highest levels at CMS and key decision makers in Congress, it has also been an
issue that CMS REFUSES TO BUDGE FROM. According to CMS, their decision to
rescind the pedorthic (along with several other practitioner groups) exemption
didn't have to do with waste, fraud and abuse. The pedorthic exemption was
rescinded because of educational concerns. What's next? PFA
continues to push the issue, and we are working towards a meeting with the White
House Health Policy Advisor. Our goal is still to force CMS to reinstate

a sign consumers may be turning the corner, according to the National Retail
Federation. Retail sales rose 0.7% in August over July, but fell 4.3% from the
same month last year.
Those figures do not include auto, gas and restaurant sales, a news release
said. Retail sales including autos, gas and restaurants rose 2.7% for the month,
but declined 5.9% for the year, according to the U.S. Commerce Department. Full

glucose-lowering medications metformin and insulin don't appear to reduce the
inflammation associated with heart disease, new research suggests.
Even though these medications helped reduce glucose levels, the
researchers found they didn't affect inflammatory markers any more than a
placebo drug did, according to a study published in the Sept. 16 issue of the

Statistics say that the greatest absolute increase in the number
of people with diabetes will be in India, thanks to the title our country holds-
the diabetic capital of the world. It has been estimated that upto 50 per cent
of all non-traumatic lower limb amputations are performed on diabetic patients.
Foot problems are important contributory factors to the high-morbidity and
mortality observed in diabetic patients, and the economic impact of foot disease
is substantial. The cost of treating this complication is much higher than renal
or heart problem. Hence, aggressive primary and secondary prevention strategies
are very essential and important.
"Foot problems are a major cause of admission to hospital for
people with diabetes. One in every six diabetic worldwide will have a foot ulcer
during their lifetime: that is four million people each year. Worldwide, half of
all leg amputations happen to people with diabetes. Poorly treated or untreated
foot ulcers can lead to the need for amputations. Through good healthcare and
informed self-care, it is possible to prevent diabetes-related amputations in
the majority of cases," says Dr Ajit Kumar Varma, Department of Endocrinology

The first night I tried to fall asleep with a plantar fasciitis
night splint strapped around my left foot and calf, I felt like I was wearing a
downhill ski boot to bed. "You've got to be kidding me," I thought as I reclined
flat on my back and looked down at my painted pink toenails jutting out from
their plastic prison.
Plantar fasciitis is pain and inflammation of the plantar
fascia, a thick band of tissue which runs across the bottom of your foot and
connects your heel bone to your toes.
My mom suffered for years from plantar fasciitis; she stopped
taking walks because of it. I have friends who can't play tennis, backpack, and
hunt because of unbearable heel pain. When I went to purchase my night splint at
the local pharmacy, I met a construction worker who said he had to crawl to the
bathroom in the morning because his heel "hurt like hell." Full

Comment: Help! Help! Help!
Why haven't the PFA, ABC, BOCO,ADA, AADE,and the major diabetic footwear manufacturers filed a federal lawsuit and or federal injuction against Surety Bonds, and even more damaging Mandatory Pedorthic Facility Accreditation?
Just got a flyer (see it here) from CMC/NSC/Palmettogba. Occupational therapists are exempt from accreditation. So are Physical Therapists, Orthotists, Prosthetists and Pharmacists and Podiatrists' and their staffs, None of these Therapeutic footwear providers need to be accredited, but a Pedorthist with 20 + years of experience needs to be?
Orthotists/prothetists,occupational therapists,physical therapists, and doctors are also exempt from surety bonds.
Where is the reasoning for this? Has CMS found massive fraud in pedorthic footwear -TSB billing? I did not see any headlines!
This policy is blatantly unfair and precudicial against the small independent pedorthic footwear store. Accreditation requires hundreds of hours of paperwork and thousands of dollars, and the end result is that small companies can't afford it and are driven out of business.
Many thousands of diabetics do not know about or use the Therapeutic Shoe Benefit. Many that do are forced to go to Brace & Limb companies that offer no more than 2-3 brands, styles, and colors. If the patient does not like the looks and feel of the Diabetic Footwear, THEY WILL NOT WEAR IT. How will this reduce the risk of toe and foot infections, ulcers, and amputations?
Please, somebody help us to stop this absurd policy. Please pass this along to the correct person/committee that can act on this. Someone must have a federal attorney who can get an injunction. Please. I Know there are hundreds of stores like mine that in this economy cannot survive this added level of government b.s.
Question: Now that all pedorthic candidates are required to devote 1,000 clinical hours in order to become a C. Ped., do you feel that the profession will shrink in size?
We charge $425.00, but we do a thorough pedorthic biomechanical exam, case history, gait analysis, pedigraph, shoe analysis, and cast at the initial visit. We offer three months of no-charge visits unless we are under contract with your insurance; then you are provided only two follow up visits, such as Anthem BCBS -- which, now, does not always cover adjustments, yet they will pay for a new pair of feet orthoses per year. I rarely dispense second pair. I am more conservative and cost conscious for my patients, but the end choice is theirs to make, and their referring physician's.
PREVIOUS QUESTIONS AND COMMENTS WITHOUT RESPONSES
Question: I thought I remembered reading something about a facility dispensing shoes to the diabetic public needed to maintain a certain dollar amount of shoe stock. This may not be correct, but if it is, could someone please point me to the place it was written? I've searched the Web for quite awhile on it and nothing seems to come up. I checked DME, PFA and MCS and couldn't find any info. I have people that want to get rid of most of our stock and want to double check before they attempt to purge it. Thanks!

Comment: This is in response to Rob Sobel's comment in PNW 329 relative to PFA's lobbying activities.
In addition to PFA's current Executive Director also serving as Director of Government Affairs, PFA has retained a lobbyist active at the federal level for the past 11 years. Over the years, PFA's federal lobbyist, Bill Applegate, with Bryan Cave Strategies, has cultivated access and built pedorthic awareness for PFA and its membership with key Members of Congress and the Administration, CMS and other necessary decision makers impacting pedorthics. While working with Applegate at the Federal level, PFA's Executive Director has also taken the lead on expanding pedorthic awareness at the state level, providing testimony supporting pedorthic licensure in numerous states over the years, educating state legislators and their staff on pedorthics at the National Conference of State Legislators, etc. Together, PFA's two lobbyists have almost 40 years combined experience lobbying federal, state and local government.
The biggest issue that PFA has tackled since December, AND CONTINUES TO WORK ON, is CMS decision to rescind the facility accreditation and surety bond exemption for pedorthists. Not only is this a significant issue, but, despite our best efforts in reaching the highest levels at CMS and key decision makers in Congress, it has also been an issue that CMS REFUSES TO BUDGE FROM. According to CMS, their decision to rescind the pedorthic (along with several other practitioner groups) exemption didn't have to do with waste, fraud and abuse. The pedorthic exemption was rescinded because of educational concerns. What's next? PFA continues to push the issue, and we are working towards a meeting with the White House Health Policy Advisor.
