Comment: Here is the link to the latest Medicare announcement about surety bonds. Orthotists and prosthetists that practice in states with licensure are not required to buy a surety bond (within certain rules of what else they supply or who actually owns the supplier entity). From the language of this announcement, it appears that even in licensure states, pedorthists still have to buy the $50,000 bond. If someone can read this announcement and come up with a different interpretation, would you please share? Also if anyone has found a Medicare approved surety bond company that does not require a personal guarantee, would you please share with me at jmishasek@earthlink.net.

Previous response: In a previous life I was a commercial insurance underwriter, and my spouse now underwrites Surety bonds for a large commercial insurance company. Neither one of us understands why this bond requirement is needed. We are the provider of durable medical supplies-shoes and orthotics- and will invoice Medicare, a medicare HMO and /ora secondary insurer for payment for our services. What obliations do we have which would expose us to up to $50,000 in exposure through this procedure.

If anyone should be requesting protection via issuance of a bond in "our" favor, it should be the pedorthist providing the goods and services. Can anyone explain the exposure we are deemed to have created for ourselves?

New Response: The reason that some Medicare DME suppliers have to buy a surety bond is because there is a federal law that mandates that certain suppliers have to buy a surety bond to continue to have a supplier number.

The original Medicare legislation (7 years ago?) to have HME and HHA companies buy surety bonds had the dollar amount of the mandated surety bond significantly higher, and none of the independent DME suppliers and home health agencies in the industry were able to purchase a bond. The DME/HHA industry told Congress "enforce this legislation and you (Congress) will have effectively eliminated most of the entire home health industry as none of the independent suppliers will be able to meet this mandate. And when the seniors who voted you into office ask us why they can no longer get their oxygen, home health nurse, and other DME services, we will tell these voters to call their elected representative to get an answer." So the legislation was never implemented. It took a legislative revision last year to the original legislation to lower the amount to a level that smaller suppliers could swallow. Question: I have a question to pose to the Pedorthic community. I have decided it is not worth my time and energy to be accredited for Medicare purposes. Is anyone else out there thinking this way?

I do not see reimbursement improving in the future or the government actually doing anything which will help PROVIDERS with their healthcare changes. It seems to me there are going to be fewer and fewer providers. I know two people who have been accepted to Medical school but are not going because of the direction things seem to be going. And look at our profession, where are the new pedorthists? It appears no one wants to join our profession as it is unsure where it is going right now.

I have moved my business to more cash based in the last few years and will continue as a Pedorthist, but I will no longer spend all the hours filling insurance unless it is private insurance (out of network of course) and then there will be a fee each time we file the forms.

I just wondered if I am the only one who is tired of all the requirements and fees coming from Medicare and no Pedorthic supporting entity seeming to be able to stop the snowball. IE: Some providers exempt from Surety Bonds if they own their own business but not us?

Response: When we started in business 7 years ago my former employer had stopped doing the Therapeutic Shoe Bill due to re-reimbursement issues and loosing a ton of money. So, we did not do Medicare, or any insurance, the first 5 years of business. 2 years ago we decided to take them on and try to be smart about it. Our sales jumped $30,000 that first year. Granted, the foot orthoses we make for them are not top of the line, but we make them 3 pair custom per year, using the same cast. This helps because we don't have the expense of another evaluation and a box cast, we just have them come in for a fitting and they either bring another pair of shoes or they buy a pair from us. I think it has been well worth it! Yes, we have some expenses with the Accreditation and now this Surety bond, but our increased sales far outweigh the money spent. Response: I would think that there are quite a few pedorthists that will be re-examining whether or not to stay a Medicare supplier. Not only because of the initial costs of accreditation and the re-occurring annual fee but also because of the personal guarantee requirements of the mandated surety bond which has a re-occurring annual premium also. It would seem that one would need to get big or get out of being a TSD supplier with these new fixed costs. If a pedorthic business is doing minimal Medicare billings (20-25 patients a month), then a cost-revenue analysis (product, labor, overhead, footwear adjustment costs, billing costs, annual cost of accreditation and surety bonds versus actual collected revenue) should help one determine the break even point in volume of TSD patients.

However, the big financial unknown to being a TSD supplier is the impact of a RAC audit (Recovery Audit Contractor) that could result in a recoupment of some or all of the payments made over a multiple year time frame. If the AOPA report that 100% of a batch of TSD claims failed to met TSD payment requirements, then there could be many TSD suppliers out there that have a big financial risk hanging over their head. So even if one does a standard cost-revenue analysis, one cannot put a pencil to the risk factor of a RAC audit and what would be the financial outcome to your business when the surety bond company asks the supplier to repay the personally guaranteed bond.

Remember: the recoupment amount is calculated on the percentage of claims that failed the audit and then extrapolated (multiplied) against all the payments made to your company for similar HCPCS claims during the audit time frame. If 25% of your TSD claims are determined not to be valid (delivery ticket not filled out properly, risk factor on Certifying Physician statement not documented in patient's chart, couple of delivery tickets the patient failed to date the delivery ticket, etc.), then your company owes Medicare a refund of 25% of the all money paid during that two year period if the audit is of a sampling of claims during a two year period. Ouch. Do not have that kind of cash laying around to pay back the recoupment. Boom, surety bond company has to cough up the money, then the bond company comes knocking on your door for its repayment and probably will not issue you a new bond. Double ouch.

Should one base their decision to stay a TSD supplier based on whether or not their TSD business can be wrecked by a RAC audit? Depends on one's comfort level with risk. As it stands, Medicare has upped the risk with the creation of the RAC program and lowered the reward (net profit) by increasing the cost of doing business. If you prefer to manage your business risk, then you have your work cut out for yourself. This sounds like a key topic for a PFA meeting session. Google CMS RAC if you want to learn more about this Medicare program.

Question: Do any owners have non-compete contracts with employees? What are parameters for owners who have non-competes?

Response: It has been my experience these contracts just run the best people right out of town. If you can't be employed in your home town doing what you are trained to do, it's a shame! Mostly these contracts have been in the O&P industry not so much in Pedorthics. I have a C. Ped. who comes in one day a week to learn fabrication, I haven't even considered having a contract drawn up. He took all the courses required to be C. Ped. and basically had no idea how to fabricate anything. His business is going to people's homes and fit diabetic shoes. I guess I am a little different, I want to help C. Peds in my community grow and be all they can be, it will only help our profession! And besides there are a lot of feet out there to go around. Competition is a good thing! We all refer to each other because we all have different skill levels. So, no, I wouldn't have a non-compete contract with my employees. But if you must, 50 mile radius and 2 years is the standard.

PREVIOUS QUESTIONS WITHOUT RESPONSES

Question: The new ABC Pedorthic Patient Care Experience Requirement mandates that the aspiring pedorthist to complete 1,000 hours of pedorthic patient care experience prior to applying for certification. These hours can be obtained at either accredited or non-accredited facilities; may be a combination of patient care and retail experience and may be obtained prior to, or after, completion of an approved pedorthic course. Serving as the clinical training portion of a pedorthist's education, this requirement provides students with practical application of the knowledge, skills and competencies gained during their education programs.

BOC requires “1,000 hours of supervised patient fitting experience." It does not further define these. BOC does say that some hours may occur before attending the fitting course." This requires experience, but leaves enough room that all candidates, retail and clinical, can achieve it. Many therapeutic shoefitters have used their experience to fill this requirement and move up to Pedorthist, all while remaining at their current place of employment.

How will these requirements affect our pedorthic practices and the pedorthic profession going forward? What affect is it having on your decision making about your future needs and options?

Question: Just wondering if anyone knows what sort of HIPAA compliancy issues, if any, would be involved with emailing back and forth with your patients?

Question: Does anyone know where to purchase the old tailor's bunion pads that were discontinued by Pedifix a number of years ago? Doesn't anyone still make these or something like it? These devices worked fantastic for relieving pressure at lateral 5th metatarsal. I don't see them in any catalogues. Thanks.

Brown Shoe Company Inc. has completed its 350,000-square-foot Famous Footwear distribution center in central California. The aim is to add time savings and cost efficiencies to the process of shipping footwear to the chain’s stores and FamousFootwear.com customers west of the Rocky Mountains.

The Famous Footwear distribution center is located within Tejon Industrial Complex, a 1,450-acre business park anchoring California’s central trade corridor. A Perfect Fit: Danny DiPrima Finds Success Beyond Just Selling Shoes

Danny DiPrima figured Groover’s Shoe Renewing had reached its maximum earnings potential, so he and his wife, Debbie DiPrima, started researching, looking to expand the shoe shop with a logical new business.

What he found was pedorthics, a field that was still unknown in much of the medical community but was recognized by Medicare.

A pedorthist is somebody who works hand in hand with a doctor, DiPrima said. When people need modified shoes because of injury or amputation, a pedorthist is trained to fit the shoes to the condition. Full Text

Diabetes Sufferer Joins with Amputees in "Silent Assassin" Campaign

A U.K. man who came close to losing his leg through diabetes is campaigning for better treatment for sufferers of the “silent assassin”.

Enfield resident Philip French, 42, is prone to developing ulcers on his feet has had to have 30 operations in the past 20 years to prevent them from becoming infected.

He broke his foot playing football in 1995, which led to an abscess which covered the sole of his foot and gangrene which threatened to engulf his lower leg, but was saved by surgery.

Diabetes, nicknamed the silent assassin because it can lead to conditons such as strokes and heart attacks, can damage the nerve supply and blood flow, which can result in ulcers and slow healing wounds. Full Text

In cooperation with the ABC and BOC requirements, Eneslow Pedorthic Institute (EPI) is offering the three-level competency training course for aspiring CPEDS. To provide maximum benefit in a minimum of time, a portion of the level one curriculum will be administered through a distance learning program that includes required readings, interactive CD’s and testing of all mandatory topics.
