Question: Since pedorthists are not supposed to diagnose, should BOC Pedorthists or Certified Pedorthists be assessing for Loss of Protective Sensation in self referred clients?  Is the use of the Semmes-Weinstein monofilament a diagnostic test that should not be used by pedorthists?   If it is used by a pedorthist during an encounter with a client, what are the findings termed in their chart, i.e. LOPS but not peripheral neuropathy?

PREVIOUS COMMENTS WITHOUT RESPONSES

 
Comment: The Pedorthic Footwear Association (PFA) has recently issued a call to action suggesting that their members contact ABC to ask us to get in touch with CMS in support the PFA’s proposal regarding the mandatory accreditation requirement for pedorthists.  ABC agrees that the short deadline imposed on pedorthists by CMS was burdensome.  We have contacted CMS about this deadline on several occasions, but they remain steadfast in their adherence to the set deadline.  ABC has worked very hard to educate pedorthists about the mandatory accreditation deadlines, the standards for accreditation, and the steps necessary for accreditation compliance.  ABC has also worked closely with CMS on the proposed quality standards and revisions of the 855S form.  We have spent numerous hours communicating to CMS the different types of orthotic, prosthetic and pedorthic credentials and the education, training and competency assessments required for each professional.
ABC disagrees with PFA’s erroneous assertion that CMS rescinded the exemption because facilities staffed by Certified Fitters of Therapeutic Shoes (CFts) are being accredited as pedorthic facilities. 
ABC does not accredit facilities as pedorthic facilities unless a pedorthic professional is responsible for patient care.   Those facilities where a CFts is responsible for care are accredited in the Non Custom Therapeutic Shoe accreditation program and the CFts must be working within their defined Scope of Practice.  CMS relies on Deemed Authorities such as ABC to appropriately accredit facilities and relay that information back to CMS.  If the 855S form indicates “pedorthist” but there is no one appropriately credentialed or licensed on staff, ABC will not accredit that facility as a pedorthic facility.  As mentioned above, ABC contacted CMS several times to ask that all orthotic, prosthetic and pedorthic provider types be listed on the revised 855S form, however these measures were not adopted by CMS. 
 
We believe it is important to clarify another incorrect statement made by the PFA. The assertion that certified fitters are somehow exempt from both mandatory accreditation and the surety bond issue is incorrect. Further, the PFA stated that orthotic fitters can bill pedorthic codes.  ABC’s accreditation and certification programs do not allow orthotic fitters to provide diabetic shoes or comprehensive pedorthic services. We pay strict attention to the qualifications of the facility’s care providers and if it is discovered that an organization is providing services that exceed those qualifications we will revoke their ABC accreditation. 
 
ABC continues to work closely with CMS on the issues surrounding facility accreditation, qualified provider regulation, appropriate reimbursement criteria and other issues related to orthotics, prosthetics and pedorthics.  While we appreciate the opportunity to hear from the pedorthic community, we suggest that the PFA’s call to action would have been more effective if generated before the 1/31/09 deadline and if PFA members had been directed to contact CMS, and not ABC—an organization dedicated since 1948 to establishing and promoting the highest standards of organizational and clinical performance in the delivery of orthotic, prosthetic and pedorthic services.

Comment: Hi! My name is Crystal and I am a medical biller for a C. Ped. I have been a medical biller for several years now. My boss had shown me your most recent issue and brought to my attention the required documentation content. It seems that most people are thinking that you now are required to obtain medical records from the physician. I remembered getting information on a letter to send to the physicians explaining what was required of them for us to be able to bill our services to Medicare. The letter simply stated what had to be in the patients records that are at their office and what we required. In the letter it states that the patient's medical records must be made available if requested. (See the information HERE:) And it gave links to the website where you could find more information.
 
I went to the Web site and pulled up the "documentation inventory form." It states that:
 
"All medical information—except for the CMN—may be
maintained in the patient’s medical record (not
necessarily in the supplier’s file), but must be available
to the DME MAC upon request."
 
That said, as long as the documentation is in the physician's records, you do not need it in your files. If DME MAC requests it, then you can request it from the physician at that time. And only the record for where the physician wrote that the patient needs your products. Hopefully this clears up the confusion!

Comment: There has been a strong negative reaction by C. Peds in PNW to the AOPA report showing that 100% of 96 TSD claims analyzed in region B failed to meet Medicare requirements for a clean claim.  Looking at the AOPA data about why certain claims were denied, it brings up a series of questions about who filed the claims.  The mistakes made show a very poor understanding of basic documentation for a claim to be paid.  Further information would be useful to understand what this 100% failure rate means.  Were some suppliers dabbling in the TSD supply?  Were some suppliers new to being a supplier and had never been trained in what Medicare requires of a claim to be reimbursed?  
 
So, any hysteria about this 100% denial rate needs to be tempered with "if you do not understand how to be a supplier, you deserve to have claims denied and have to pay back an extrapolated amount for all previous similar claims paid during the period surveyed (not repay just that denied claim but a percentage of all claims that your denied claims represent over the audited time period)."  
 
All but two of the reported denial issues were 100% valid and under the control of the supplier to perform with every claim submitted.  Read the rest of this comment HERE .

Comment: The hidden cost behind CMS' new rules & regs is the time wasted worrying and corresponding about them. This is my third, and I think last, letter in as many weeks as I really do have much better things to do; like see patients and trying to make enough money to pay my bills.
 
I understand that if a Doc sends me a CMN stating "foot deformity", I can probably SEE the bunion, charcot, hammer toes, etc. he's referring to which I can confirm in my eval notes. Many times a patient's inability to relax their foot while I'm palpating can help confirm neuropathy if that's indicated by the physician in the CMN. Of course, it could just as easily indicate they are afraid I'm going to tickle them. Read the rest of this comment HERE .

Comment: I think that the time has come for C. Peds to band together and start fighting for their survival.  In the light of events today, if something is not done the C. Peds will be gradually extinct. None of the organizations out there is willing, in my opinion, to take up this fight for C. Peds.
My observation is that: the prosthetists want to overtake C. Peds, the orthotists want to overtake C. Peds, the fitters want to overtake C. Peds.  C. Peds are not allowed to do anything above the ankle, but all other guys are allowed to do everything above
and beyond the ankle. People are feasting on the pedorthic profession.
I think we should come out with a new organization called: American Association of Certified Pedorthists (AACPed).

The optimism that upcoming big conventions could help jump-start the local economy has darkened as some of the largest meetings and trade shows are estimating lower attendance equivalent to Las Vegas losing a major show.
 
Among four major shows — the World of Concrete, MAGIC Marketplace and the World Shoe Association in February and the National Association of Broadcasters in April — attendance is expected to be down 64,000 people from last year’s events, the size of one big convention. Full Text

Heelys Inc. Announces CEO Change

The board of directors of Heelys, Inc. has accepted the resignation of Donald K. Carroll, Heelys' CEO since May 20, 2008, effective today. Michael W. Hessong was named Interim President and Chief Executive Officer until the board designates a full-time replacement. Mr. Hessong formerly served as the company's Chief Financial Officer for many years until leaving in May 2008.

JJB Sports footwear stores head for administration

British sports retailer JJB Sports said Tuesday it intends to place two loss-making footwear subsidiaries into administration.

JJB said its lifestyle division, which operates 64 Original Shoe Company Ltd. stores and 13 stores under the Qubefootwear Ltd. brand, continues to trade at a substantial loss.

Administration is a form of bankruptcy protection. The administrators' job is to salvage as much of the company as possible to repay creditors, which can involve trying to keep the business as a going concern, or breaking it up and selling it off. Full Text

Time to replace those athletic shoes

If you are a walker, jogger or runner, now is a good time to select a new pair of athletic shoes for spring. Although last year’s running shoes may look fine and feel even better, if you are a regular exerciser they have most likely outlived their usefulness.
 
Your running shoes are composed of essentially three layers of sole. The inner sole is soft and comfortable, but has little benefit as far as absorption of landing force.
 
The outer sole is hard and constructed to contact the road surface without wearing out or breaking down. Like the inner sole, it does not play a major role in shock absorption.
 
That leaves the mid-sole layer, which is designed to absorb some of the landing force and lessen the impact to the feet, ankles, lower legs, knees, thighs, hips and lower back. Full Text
