Response: After speaking with a surety bond
company located in Phoenix that has a website medicaresuretybonds.com, I
found out that the cost of a $50,000 surety bond can be 2-5% of the bond
amount and up to 25% if the individual(s) on the bond certificate have
poor credit rating. This amount is an annual payment, not a one time
payment. The other issue is that these bonds will have to be personally guaranteed. The individual(s) on the supplier number, not the corporate entity, will be buying the bond. The corporate entity can pay for the bond but the liability will be to the individual owner(s) of the company. So if your business is a LLC, subchapter S, or C corp, it would appear that the personal liability protection of having one of these type of businesses will be eliminated to the tune of $50,000. If one of Medicare's bounty hunter organizations (paid based on the amount recouped so being somewhat motivated to interpret rules or gray areas in Medicare's favor) does an audit, your company could find itself at risk for a large recoupment payment. Did the PCP really document risk factors in the patient's chart? If the patient does not have a podiatrist, does Medicare consider that their PCP qualified to prescribe the benefit? Are 100% of your TSD files perfect? Yes, there are appeals processes to an audit but if the bottom line is that your company loses the appeal and do not make good on the recoupment within a specific time period, the bond company will be required to pay Medicare and then the bond company will be seeking repayment from the bond owner(s). Has anyone every asked CMS or the OIG to detail how many certified pedorthists or BOC pedorthists have ever been found to commit Medicare fraud? Is Medicare solving the problem of NSC letting too many crooks into the DME system in certain areas of the country on the backs of certain suppliers? I would bet $100 that the incidence of fraud by pedorthists (overall incidence or as a percentage of pedorthic suppliers) have fewer cases of Medicare fraud than the other TSD suppliers that do not have to have a surety bond. To become a certified pedorthist, you must take a
pre-determined number of course hours in pedorthics and pass a certifying

Certification, Int’l. Both the ABC and BOC are independent certification
bodies that set standards for the profession and are recognized by the National
