Comment: I’m writing regarding PFA’s latest online newsletter about Therapeutic Shoes Documentation Requirements. In the article, it states that there was a widespread post pay probe for HCPCS codes A5500, A5501, A5512, and A5513. In this probe it was discovered that most of the files failed to provide the proper documentation from the patients’ medical records. According to this article, we are supposed to have in our possession the patients’ medical records from their doctor documenting the need for therapeutic shoes. Never before have I seen it written that anything is required of the prescribing physician other that the Certificate of Medical Necessity with the physician’s signature and the qualifying conditions circled on the form. I can’t believe that this could be correct, that we would need a physician’s notes in our files as well as the CMN. Does a pharmacist need this kind of documentation when dispensing medications? What doctor has time to fill out more paper work? We certainly don’t need copies of all their medical information in our files.

As a pedorthist, it’s none of my business if my patient has hemorrhoids or erectile dysfunction.

I’ve always felt that the Therapeutic Shoe Bill was a preventive maintenance program. We take feet that look pretty good but that are at risk for complications and help keep them healthy. Certainly, we get our share of ulcerations, amputations, charcot feet, etc. but the program was designed to prevent problems, not cure them. The Medicare reimbursement for these basic cases is fair, but when we get into these extreme cases the reimbursement is very low except in the case of toe and forefoot fillers. NOBODY can make an adequate custom orthotic for the Charcot foot or ulcerated foot for $63.00 per pair. I do it when necessary and lose money on it because I have a skill that will benefit people and I can’t turn people away. If Medicare is making changes where only the more critical cases can get shoes, I for one will no longer be able to provide footwear for anyone. Question: As I filled out my application for accreditation for my company, I was asked to include a copy of section 2 and 3 of my last re-enrollment with NSC.   When I had filled out section 2 in 2007, there was absolutely no option or way to indicate that my company was a pedorthist- based supplier as the primary type of business.

My choices were prosthetic personnel, orthotic personnel, medical supply, medical supply with orthotics personnel, optician, pharmacy, home health agency, etc. etc. But no option to say pedorthics personnel or medical supply with pedorthics personnel.   Since we do foot orthotics, I figured orthotics personnel was the closest description, plus we have it set for a certified orthotist to use our facility to provide his services and then have us sell shoes that fit the AFOs he just delivered so patients can start using AFO immediately.

So orthotics personnel was the tallest of the seven dwarfs for me to select from for my Medicare re-enrollment.

Since Medicare has my company listed as being an orthotics personnel as primary type of business and orthotists and prosthetists are exempt from having to be accredited, should my company be considered exempt from accreditation?

And on a related note, why does the amount of technical coursework and education a practitioner has incurred to become a practitioner make that person less likely to commit fraud in Medicare's eyes and thus not require accreditation? Would not a review of OIG records on Medicare fraud for the past 10-15 years be a better way for Medicare to determine which practitioners should be exempt from accreditation.

I would not expect the accrediting organizations to raise this issue as it just potentially reduces the number of businesses purchasing their services. So who should be asking this pointed question of Medicare about who historically has a higher incidence of fraud and who should be exempt from accreditation?

Question: Has your diabetic population decreased due to the Internet? What is your best technique to deal with Internet shoppers trying on footwear for sizing?

Response: Our patient profiles specific to the diabetes market has not gone down in fact it keeps increasing. I believe one of the main reason for the increase is the continued education we provide to the medical community about proper ongoing foot care for their diabetic patients.

We have noticed an increase in people try on shoes and/or want their feet measured in order to purchase footwear via the inter net. We began a fee of $25.00 for proper measuring of a persons foot. I thought people would stop put they do not have a problem paying a fee in order to save some money on the net. I did a research study on fifty people who I measured and only half were satisifed with the footwear and fit they received and purchased shoes within their area or from us. It is not easy in some cases to accommodate an individuals foot in house never mind over the inter net

Response: The Internet is a huge concern for us. MFN's have NO desire to protect distribution anymore. If we don't have a shoe in stock we have a small but noticeable chance that the client will not order it from us. If it is at all on back order with the MFN we might as well toss that order in the trash. Not only is it the Internet but it is also the foot care catalogues. We see this with not only diabetic products but will all foot comfort products. Frankly, I am not sure what my company is going to do about this. I have pleaded, raged with companies. All to no avail. I have written on this blog and others about this. I have since realized that I am beating a dead horse. Zappo's has a 365-day return policy, free shipping/returns from other companies, etc. The reality is that the Internet is slowly killing our business. Yes...we can all talk about "customer service" and "loyalty" etc. But in reality that is just pretty much bull. Older customers 65 plus are about that, but the younger clients are Internet savvy. And Joe Smith is just as happy to sit at home in his boxer shorts surfing the Net and ordering there as he is about coming into my shop. Plus....the "older" client base is dying off.

Also, some clients are more comfortable not having to "talk" with a sales associate for whatever reason. For all who read this, Welcome to the new way of doing business. How the heck am I (or any of you) supposed to have all the Brooks athletic shoes in all the sizes in stock at any given time? Or any other product for that matter? The Internet gives the customer just that. Delivered to their own home. Free shipping and in my case usually no sales tax. Every single brand of shoes I sell, every sock, every foot care product...everything, is available over the Internet. And because of my costs of doing business, they can usually be found somewhere cheaper (always cheaper if they don't have to pay sales tax).

Question: On Jan. 2, the federal Register published a new regulation requiring DMEPOS suppliers to obtain and maintain a $50,000 surety bond in order to keep their CMS supplier number.

I wrote to Mr. Steve Fletcher with ABC questioning whether, in ABC's opinion, Certified Pedorthists would be mandated to meet this requirement or exempted.

His response was, in essence, they didn't know.

My question is this: if the wording of a federal regulation is so vague that an effected, established industry credentialing organization such as ABC cannot determine whether or not it's credentialed practitioner's are required to abide by a regulation, how in the world is the ordinary individual supposed to know? How can you possibly do your job not knowing if you're in violation of the law?

First it was getting an NPI. Then HIPPA. Then Accreditation. Now it's surety bonds. ALL supposed to prevent fraud and abuse. And yet.... we still have people soliciting Medicare beneficiary's on the phone (strictly prohibited by CMS) for diabetic shoes and inserts and allowing those same shoes and inserts to be dispensed by UPS (no final fitting or followup as required).

In the meantime, those of us trying to do things the right way to the best of our abilities are punished by spending more and more time on paperwork requirements and making less and less money.

I wonder if the new administration has any plans to change this?

Response: This is in response to Richard Young's question about the new CMS requirement for DMEPOS suppliers and providers to obtain surety bonds (PNW 295). The regulation that CMS published clearly indicates that suppliers of "extra-depth shoes with inserts or custom molded shoes with inserts for an individual with diabetes as listed in section 1861(s)(12) of the [Social Security] Act." This would include pedorthists. The requirement also extends to other providers and suppliers of DMEPOS. However, a good number of those practitioners are currently exempt from this requirement - as they are from the facility accreditation requirement - until CMS develops quality supplier regulations addressing the other groups. Pedorthists are not currently exempted from either the facility accreditation requirement or the surety bond requirement.

Response: The State of the Pedorthic Union under Bush. We blamed him for everything else, why not this CMS BS. Bush said WMD’s were a good reason to go to war. But when BCP used the scare tactic that the WMD would be “IF” CMS didn’t recognize them as an Accreditation body, C. Peds would be out in the cold; so we needed to merge with ABC. By the time CMS did indeed recognize BCP as an accreditation body, it was too late; but C.Peds didn’t go to war.

When CMS said everybody had to get their facility accredited, they created a level mine field. Then our new friends at ABC sided with the DPM’s to create immunity from persecution for themselves. CMS was stuck with some useless WMD’s, so they decided to discriminate against HALF of the C.Peds. The other half work in O&P facilities and are exempt. ABC said we sympathize, please give us your accreditation money. And C. Peds didn’t go to war.

When CMS & ABC said we should panic because we only had until Jan. 31 to get started on accreditation, it’s really a false alarm. The truth is that CMS regulations require ABC to report to them by Jan. 31 how many have started the process. C. Peds still have until September. Jan. 31 is ABC’s responsibility to CMS, NOT C. Peds' responsibility to anybody. C. Peds need to opt out of that war by doing nothing in January.

The reason CMS has singled out half the C. Peds for accreditation is that the newly created ABC/BOC (shoe fitters) CFT’s are billing CMS as C. Peds. Instead of policing the CFT’s, they are penalizing C. Peds. That’s about as crazy as somebody robbing a bank in your neighborhood and you get arrested instead of the criminal, just because it’s your neighborhood. If it all sounds as upside-down as some of the Bush doctrine, you can understand why this C. Ped is now at war!!!

Response: I have heard that our cost for the amount they are requiring is going to be in the neighborhood of $1500 per year. If you net 10% profit in your business, that will mean you will have will have to do about $15,000 more in sales to break even on the bond's cost. And for what? Where is the intelligent application of its purpose by CMS? Why should they require all suppliers, large and small with no previous history of fraud and abuse to assume the same costs? Is the bond's requirement supposed to give CMS some sense of security that they don't need to be as strict in their enforement of Medicare regulations? If they don't enforce their own regulations for supplying diabetic shoes now, as Mr. Young pointed out, what's the point? If they get any more lax, they will be allowing mail-order shoes directly from China. We need to fight this.

Question: I have a guest who has a son w/ cerebral palsy. He needs kids-sized winter boots that will take his AFO and need to have a front opening and easy closure. Any thoughts? He is about a kids size 3 or 4; hikers are neither full enough nor warm enough. There are a few ladies winter boots that may work (although the AFO is chunky), but we are trying to make sure he doesn’t look like he raided his grandmother’s closet! Any suggestions?

P.S. Does anybody know where to get a surety bond or how much it costs?

Response: KeepingPace Footwear was developed by a mom of a cp kid. She has come up with a shoe to fit the bulky AFO's. You can get them through Pel Supply or directly through SoleTech.

Response: The Neos Overshoe company works really well. It goes over the existing shoe/AFO; provides waterproofability and some styles come insulated.

We use this with our buildup patients as well.

Response: After speaking with a surety bond company located in Phoenix that has a website medicaresuretybonds.com, I found out that the cost of a $50,000 surety bond can be 2-5% of the bond amount and up to 25% if the individual(s) on the bond certificate have poor credit rating. This amount is an annual payment, not a one time payment.

The other issue is that these bonds will have to be personally guaranteed.   The individual(s) on the supplier number, not the corporate entity, will be buying the bond. The corporate entity can pay for the bond but the liability will be to the individual owner(s) of the company.

So if your business is a LLC, subchapter S, or C corp, it would appear that the personal liability protection of having one of these type of businesses will be eliminated to the tune of $50,000. If one of Medicare's bounty hunter organizations (paid based on the amount recouped so being somewhat motivated to interpret rules or gray areas in Medicare's favor) does an audit, your company could find itself at risk for a large recoupment payment.   Did the PCP really document risk factors in the patient's chart? If the patient does not have a podiatrist, does Medicare consider that their PCP qualified to prescribe the benefit? Are 100% of your TSD files perfect?

Yes, there are appeals processes to an audit but if the bottom line is that your company loses the appeal and do not make good on the recoupment within a specific time period, the bond company will be required to pay Medicare and then the bond company will be seeking repayment from the bond owner(s).

Has anyone every asked CMS or the OIG to detail how many certified pedorthists or BOC pedorthists have ever been found to commit Medicare fraud? Is Medicare solving the problem of NSC letting too many crooks into the DME system in certain areas of the country on the backs of certain suppliers?   I would bet $100 that the incidence of fraud by pedorthists (overall incidence or as a percentage of pedorthic suppliers) have fewer cases of Medicare fraud than the other TSD suppliers that do not have to have a surety bond. Any takers on this bet?

Question: Can readers recommend a central fab for shoe modifications? Our key individual for doing shoe mods is suffering through a medical condition that may knock him out of action for a long time, and all of our other pedorthists are totally busy with non-shoe mod customer service responsibilities. We have sent customers over to one orthopedic shoe repair business but he is too busy to take on much more. There seems to be a shortage of individuals nationally to replace the current generation of orthopedic shoe technicians. Any recommendations would be appreciated.

Question: I would be interested in learning how BOC Pedorthists or Certified Pedorthists currently employ or utilize CFts or BOC Footwear Specialists in their pedorthic operations? Has anyone active in the TSD market seen any confirmation from CMS that these credentials are actual qualified practitioners relative the supplying TSD benefits? I was informed by one of the pedorthic precertification program schools that several states had not accepted their certificate. I am working on the assumption that these must be licensure states. Since OP&P licensure has potential to occur in all/most states at some point in the future, does that mean these individuals will no longer be able to supply TSD benefits or need to upgrade their training and certification to BOC Pedorthist or C. Ped.?

Lawsuit filed over prosthetics law

A company that provides artificial limbs, orthopedic braces and prosthetic devices in Louisiana claims in a lawsuit that its business is threatened by a new state law.

George H. Lambert Jr. and Lambert's Orthotics and Prosthetics Inc. are suing the state over the law, which took effect Jan. 1. The law requires companies that provide such services to be accredited in order to be reimbursed from the state Medicaid program. Full Text

Cost-cutting measures are forcing Missouri-based Brown Shoe Company to shut down some of its stores. The company says at least 35 of its 1,000 Famous Footware stores will close due to the economic crisis. Pedorthic Pre-Certification Course: February 2nd to 17th, 2009

In response to the “Experience Requirements” from ABC and BOC, Eneslow Pedorthic Institute will hold the Pedorthic Pre-Certification Training Course from February 2nd 2009 to February 17th 2009 in New York City, in advance of the new ABC requirements.

ABC (American Board for Certification in Orthotics, Prosthetics and Pedorthics) announced that it will be implementing a 1,000 hour pedorthic clinical practice requirement from a patient care facility for all candidates who seek to become a Certified Pedorthist (C.Ped.) to be eligible to sit for the ABC exam effective March 2, 2009. This requirement is designed to help provide students with practical application of the knowledge, skills and competencies gained during their educational program.
