NEW QUESTIONS


 
Question: On Jan. 2, the federal Register published a new regulation requiring DMEPOS suppliers to obtain and maintain a $50,000 surety bond in order to keep their CMS supplier number.
 
I wrote to Mr. Steve Fletcher with ABC questioning whether, in ABC's opinion, Certified Pedorthists would be mandated to meet this requirement or exempted.
 
His response was, in essence, they didn't know.
 
My question is this: if the wording of a federal regulation is so vague that an effected, established industry credentialing organization such as ABC cannot determine whether or not it's credentialed practitioner's are required to abide by a regulation, how in the world is the ordinary individual supposed to know? How can you possibly do your job not knowing if you're in violation of the law?
 
First it was getting an NPI. Then HIPPA. Then Accreditation. Now it's surety bonds. ALL supposed to prevent fraud and abuse. And yet.... we still have people soliciting Medicare beneficiary's on the phone (strictly prohibited by CMS) for diabetic shoes and inserts and allowing those same shoes and inserts to be dispensed by UPS (no final fitting or followup as required).
 
In the meantime, those of us trying to do things the right way to the best of our abilities are punished by spending more and more time on paperwork requirements and making less and less money.
 
I wonder if the new administration has any plans to change this?

Question: I have a guest who has a son w/ cerebral palsy.  He needs kids-sized winter boots that will take his AFO and need to have a front opening and easy closure.  Any thoughts?  He is about a kids size 3 or 4; hikers are neither full enough nor warm enough.  There are a few ladies winter boots that may work (although the AFO is chunky), but we are trying to make sure he doesn’t look like he raided his grandmother’s closet!   Any suggestions?

Response: One item to check for a removable safety toe product is OSHATOES   (they have their own web site).  They are basically rubber pull-ons with safety toes easy on, easy off and ASTM approved.

Question: Does anybody have any recommendations for a custom shoe lab?  We need a source for orthopedic and arthritic problems as well as foot deformities. There are several listed in the back of Current Pedorthics, however I would prefer feedback from practicing pedorthists that have experience with a particular lab.  FIT, finish and aesthetics are paramount! Question: I would be interested in learning how BOC Pedorthists or Certified Pedorthists currently employ or utilize CFts or BOC Footwear Specialists in their pedorthic operations? Has anyone active in the TSD market seen any confirmation from CMS that these credentials are actual qualified practitioners relative the supplying TSD benefits? I was informed by one of the pedorthic precertification program schools that several states had not accepted their certificate. I am working on the assumption that these must be licensure states. Since OP&P licensure has potential to occur in all/most states at some point in the future, does that mean these individuals will no longer be able to supply TSD benefits or need to upgrade their training and certification to BOC Pedorthist or          C. Ped.?

Footwear Retailers’ 2009 Outlook Cautious
 
Though many footwear retailers fared well during the holiday shopping rush, the outlook for 2009 remains uncertain for most.
 
According to the monthly ForecastIQ service from Prosper Technologies LLC, department and specialty stores continue to be most likely to see a decline in same-store growth going into January and February, while discounters should see an increase.
 
"Looking toward 2009, I’m still not sure, said Chuck Gordon, owner of Gordon Shoes in Pittsburgh. Just because we’re getting a spike right now doesn't mean it will carry over into January or February." Full Text

Against All Odds Files for Chapter 11 Protection
 
Against All Odds USA Inc., the operator of urban apparel and footwear filed in U.S. Bankruptcy Court in Newark, NJ attained by SportsOneSource, the chain has about $38 million in assets, and $35.9 million in liabilities.
 
The chain operates 64 stores in shopping malls in eight Eastern and two Western states, and had estimated sales of $114 million in 2008, according to court documents. The company had about 1,038 employees as of the filing. Full Text

Discounts Fail to Stem Declines in Retail Sales
 
Sharp discounting in the weekend following Christmas didn't prevent big declines in key retail categories including the luxury sector, according to new data from MasterCard Inc.'s SpendingPulse unit.
 
"The situation got a little bit better as we went through the month," said Michael McNamara, vice president of SpendingPulse, noting that even though nearly all categories posted year-to-year drops in sales, the rate of decline stabilized somewhat compared with November. SpendingPulse compiles macroeconomic spending data based on credit card purchases as well as estimates for cash and checks. Full Text

Anxieties about how rampant discounts have affected shoppers' psyches and stores' profits are running high ahead of expected dismal December sales figures on Thursday. Early Recognition of Diabetes Complications

The primary goal of diabetes management is to prevent end-organ complications. Most diabetes-related visits with a health-care professional focus at least in part on blood sugar levels and hemoglobin A1c (HbA1c). As a diabetologist, I try to put things into perspective from time to time. I tell patients that a blood sugar level of 200 or 300 mg/dL or an HbA1c of 9% is not bad in and of itself; it's the long-term consequences on the microvascular system that we must work to prevent. I next explain that the damage to the body caused by diabetes occurs on a microscopic level. Long before a patient experiences deficits in visual acuity, burning or stabbing foot pain from neuropathy, or symptoms of end-stage renal disease or uremia, it is my job to detect the earliest manifestations of these conditions. This article will focus on when and how to screen for and treat retinopathy, neuropathy, and nephropathy from the perspective of a health-care professional providing primary diabetic care. Nothing Better than Happy Feet

Christmas is over, and we hope you received something other than coal in your stocking because that is certainly uncomfortable. If you live in Buellton, you can fill your stockings comfortably every month thanks to a local Rotary Club and the senior pedicure program at the senior center.

Foot health is a serious concern for seniors. The Santa Ynez Valley Senior Citizens Foundation’s Happy Feet program provides free pedicures to qualifying senior citizens with the help of Buellton Rotary Club, which has donated $2,000 for the program.

Colleen Klein, executive director of the foundation, said the center began the program when Medicare stopped covering pedicures several years ago. Full Text

Air Jordans often retail for more than $200, and Kobe Bryant and LeBron James signature shoes demand more than $100 on various web sites. The Stephon Marbury line has made up for its paltry bargain basement price in sales volume, though it comes only in two sizes: swollen and bloated.
 
During the past few months, awaiting a new team after his Knick buyout, Marbury has been busily at work, designing some new footwear for his many twinkle-toed fans.

Pedorthics is a professional field covering the design, manufacture, modification and/or fit of footwear. Pedorthics encompasses shoes, orthoses and foot devices that prevent or alleviate foot problems caused by disease, overuse, injury or congenital defect. Certified Pedorthists work with patients and their footwear to conform to a doctor's footwear prescription as part of the patient's treatment

To become a certified pedorthist, you must take a pre-determined number of course hours in pedorthics and pass a certifying examination overseen by either The American Board for Certification in Orthotics, Prosthetics & Pedorthics® or Board for Orthotists/Prosthetists Certification, Int’l.  Both the ABC and BOC are independent certification bodies that set standards for the profession and are recognized by the National Commission for Certifying Agencies.

Pedorthic Pre-Certification Course: February 2nd to 17th, 2009
 
In response to the Experience Requirements from ABC and BOC, Eneslow Pedorthic Institute will hold the Pedorthic Pre-Certification Training Course from February 2nd 2009 to February 17th 2009 in New York City, in advance of the new ABC requirements.
 
ABC (American Board for Certification in Orthotics, Prosthetics and Pedorthics) announced that it will be implementing a 1,000 hour pedorthic clinical practice requirement from a patient care facility for all candidates who seek to become a Certified Pedorthist (C.Ped.) to be eligible to sit for the ABC exam effective March 2, 2009. This requirement is designed to help provide students with practical application of the knowledge, skills and competencies gained during their educational program.

ABC (American Board for Certification in Orthotics, Prosthetics and Pedorthics) announced that it will be implementing a 1,000 hour pedorthic clinical practice requirement from a patient care facility for all candidates who seek to become a Certified Pedorthist (C.Ped.) to be eligible to sit for the ABC exam effective March 2, 2009. This requirement is designed to help provide students with practical application of the knowledge, skills and competencies gained during their educational program.
