Texas Board of Orthotics and Prosthetics Board Statement Regarding Diabetic, Orthotic, and Certified Shoes Fitters

In recent weeks, the Texas Board of Orthotics and Prosthetics has fielded many questions regarding Diabetic, Orthotic, and Certified Shoe Fitting. As a result, we have prepared this statement to address this emerging field and the practitioners within it.

The Texas Orthotics and Prosthetics Act (Texas Occupations Code, Chapter 605) includes in its definition of the practice of orthotics, the fitting of a custom-fitted or custom-fabricated device.

These definitions are outlined in Sections 605.002 (3), (4), (12), and (14).

Any individual who custom fits a diabetic or other shoe through means of moldable inserts or other methods, regardless of where the final shoe is manufactured, is practicing orthotics and must be licensed under the Texas Orthotics and Prosthetics Act, unless exempt (see below).

Professional certifications from private educational companies do not constitute Texas licensure. Any unlicensed individual who is discovered to be practicing orthotics in this manner will be subject to enforcement action which may include administrative, civil, and criminal penalties.

The Act does recognize several professions that are exempt from these provisions. Exempt professions are limited to licensed podiatrists, chiropractors, occupational therapists, physical therapists, and pharmacists. Certified pedorthists are also exempt from licensure under the Texas Orthotics and Prosthetics Act.

Furthermore, the sale of retail shoes, over-the-counter or out of the box, is not subject to the Texas Orthotics and Prosthetics Act. Any questions or concerns regarding this matter may be referred to the Board through the contact information provided below.

NEW QUESTIONS AND COMMENTS

Question: As the Kentucky General Assembly comes to the end of the 2008 session, it seems that the efforts to protect not only the pedorthic profession but all of OP&P from the kind of restrictive practice act that exists in Ohio were successful.

I had a question regarding compression stockings. I know some of us are cross-credentialed and are able to measure and dispense these items, but I'm curious as to what is typically deemed as prescription strength. I typically don't dispense anything above 10-20 mmHg without a prescription, but I was wondering if anyone knows of the "proper" cut-off. In my mind, 20-25 mmHg is prescription strength and not a retail item. But, one of the major insurance carriers we work with doesn't reimburse for anything below 30mmHg. To my knowledge, there are no regional differences for these items, any advice would be appreciated.

Question: I have been in pedorthics for 17 years, the last six of which I have owned my own facility and lab. I work hard and have expanded my lab to offer central fabrication services to Midwest customers, which is starting to grow. I offer patient care, fitting shoes, making custom orthoses and Medicare billing. I have over the counter products for people who don't need custom.

I saw the survey for pedorthists released a few months ago and I am nowhere near that income: it was depressing to say the least! So, what is everyone else doing to generate that kind of money? As I am trained in gait analysis, I have been wondering if I should charge for this service to boost revenue. Any suggestions?

Question: Does anyone know if one can provide one pair of diabetic shoes without the 3 pairs of custom heat molded inserts? Two examples would be: a) a patient has his own custom orthotics and cannot use the plastazotes, or b) a patient still has few pairs left from previous year and doesn't wish to receive more. When billing Medicare for A5500 only, would the explanation be necessary why insets (A5512) were not provided?

Comment: The practitioners in the State of Alabama refused to acknowledge imaginary boundaries, and set a precedent with clear definition of a pedorthic device that reflects actual work being performed by practitioners. This definition is supported by the BOC pedorthic scope of practice, the PFA, Pedorthic educators at Temple University and Oklahoma State University. In all fairness, without being in touch with other educators, I am unsure where they stand on the issue or the depth of their pedorthic education programs.

Regardless, it is time to move forward. With mandatory facility accreditation right around the corner, practitioners need to consider what is in their best interest for the long run. BOC is certified by the National Commission for Certifying Agencies (NCCA) and accredited by their parent, the National Organization for Competency Assurance (NOCA). BOC is recognized by CMS as one of the ten organizations that have been awarded "deemed status for accreditation”. And with transparent, democratically elected leadership, BOC is the logical choice.

It is critical that practitioners are proactive in maintaining hard-earned ground to protect the quality care that patients deserve. All of us do not live or operate in urban areas and patient access to qualified practitioners is an ethical issue.

I encourage everyone to take a look at the practice act making it's way through the General Assembly in Pennsylvania. This seems to be the only act introduced to date that isn't burdened with regulations and that really does put patient care and access up front. This doesn't need to be a fight. There are federal guidelines to consider and CMS sets the standards that everyone uses for reimbursement. There is no ethical reason to supersede those guidelines.

I encourage everyone to contact BOC for cross credentialing and facility accreditation.

Comment: There has been a great breakthrough in clarification of insurance coding for foot orthoses. This is the first clarification ever provided by an insurance company (that I have seen)and it is a BCBS to boot. Everything else I have found on the web or elsewhere has been by providers or provider groups.

This is important to PNW readers because many people have erroneously been down coding their rigid devices with a heel cup as L3020 when they can and should be using L3000 (which generally pays a much higher payout).

Towering wedges and heel less shoes are the latest fashion footwear

Teeter this way for the extreme footwear boom

Feast your eyes on these shoes: they are the shape of things to come. Louis Vuitton’s footwear statement for autumn is a clodhopping court, balanced on a 17cm heel. Yes, you read that right 17cm (7in to you old-school types). There is already a waiting list, and when they hit the shops later this year, they will be the highest heels in fashiondom, pipping the current title-holder, a pair of 16cm black ponyskin shoes by Christian Louboutin, created for the designer Roland Mouret. Add to this the spooky 14cm heelless boots that Antonio Berardi introduced for spring/summer 2008 and the 14cm Terminator sandals by the cult cobbler Alejandro Ingelmo which have all but sold out in Harvey Nichols (customers are also clamouring for his equally fearsome Thriller sandals) and a clear picture emerges. Business is good on Bay

Neil Lipsitz can see the signs when he looks around his Bay Street shoe store. The retail price for pairs of popular Sperry docksiders has increased between $5 and $10 -- though he said he's largely managed to keep prices from increasing in his store. Lipsitz Shoes sold a particular French women's sandal last year for $260. This year the shoe company released a nearly identical model, but it's $320.

"I'm fortunate that I've got a lot of loyal customers," Lipsitz said.

Reasons for the changes range from a slouching dollar and rising transportation and oil costs to more expensive materials -- all signs of a looming recession squeezing small businesses, experts say. But Bay Street merchants said Saturday they're doing OK and, in some cases, more than OK. Full Text

DIABETES

Good diabetes foot care can prevent amputations

NEW YORK (Reuters Health) - Following an initiative to provide better diabetes foot care in the South Tees area of northeastern England, the rates of diabetes-related amputations fell substantially, according to the results of a study published in the current issue of Diabetes Care.

Dr. Ronan J. Canavan, of St. Columcille's Hospital, Dublin, and colleagues identified all cases of leg amputations in the region from July 1, 1995 to June 30, 2000. Of the 454 leg amputations identified, (49 percent) were related to diabetes and 66 percent were in men. Full Text

Study: 6 more genes found linked to type 2 diabetes
Scientists have found six more genes linked to type 2 diabetes in a study published on Sunday in Nature Genetics, a discovery that could help develop new forms of prevention and treatment. The finding extends the total number of genes linked to the disease to 16 and each of these genes therefore provides new clues to the processes that go wrong when diabetes develops.

In the study, 90 researchers from more than 40 European and US centres analyzed the genetic data of more than 70,000 people. The team found six genetic differences that each individually slightly raises a person's risk of diabetes. Full Text

Footing the marathon strain

Marathon runners everywhere are preparing for the London Marathon and, by now, should be completing training runs close to half the distance, writes Stuart Amos.

The most likely reason several hundred of them won't make it to the finish on April 17, and others will feel the effects for months to come, lies with the very things designed to get them round - their feet.

Research says 85 per cent of people in the UK over pronate - their in-step collapses - when they run, which over the punishing 26-mile distance can lead to crippling calf, knee, hip and back problems. Full Text
