Greetings!  
Public Law Center (PLC) is excited to announce our 2009 State Bar of California Wiley W. Manuel Award recipients.  Nearly 150 people reported volunteering 50 or more hours of their time in 2009, helping to provide access to the justice system for some of the most vulnerable members of our community.  PLC congratulates the hard work of all of our Award recipients.  Keep up the awesome work!
 
Summer is always an exciting time in the legal community.  For many firms and organizations it signifies the start of another summer class.  Here at PLC, we are thrilled to have seven summer law clerks who began their clerkship on Monday.  Another very important aspect of this time of year is our Summer Associate Program.  PLC offers a variety of pro bono opportunities for summer associates, including assisting with client intake at our community legal clinics or working on a pro bono case in conjunction with firm attorneys.  We are delighted to have a record 12 firms participating this summer. If your firm has not yet signed on to take part in this rewarding program, it's not too late! Volunteer Attorney Needed to Write Article on Commercial Leases
PLC seeks an attorney to write a short article (no more than 500 words) on negotiating commercial leases for its next Nonprofit Matters newsletter.  This newsletter is distributed to PLC's nonprofit clients and other local organizations in Orange County.  The article deadline is June 30, 2010.

Forty-three old English speaking client seeks help adopting a 12 year old minor who has been living with him for three years.  The maternal grandparents won legal guardianship of the minor when he was young, and three years ago they consented to let their grandson live with the client. Minor's mother is homeless and rarely calls her son. She might, however, contest an adoption.  Biological father never contacts his son and his address is unknown.

Client and her husband are in their sixties and are both disabled.  The income that they receive is from Social Security and is completely exempt. However, clients own a home that has some equity in it.  Clients are being sued by one creditor for about $16,000, and have a number of other creditors that are threatening to sue.  Clients would like to file bankruptcy to relieve their unsecured debt so that they are able to keep their home.

She is currently unemployed, but is confident that she may be able to work in the future and would like a fresh start by filing for bankruptcy. Client was previously supporting herself from a worker's compensation settlement she received, but that money is now gone.  Client has been drawing from her 401k to pay her basic bills.  Client is approximately $19,000 in credit card debt and has a home that she is currently trying to short sale.  Client would like assistance with a no-asset Chapter 7 Bankruptcy petition.

Client is a 55 year old Hispanic female who has been working as an aesthetician for several years.  Business has been slow the last few years; last year client made $25,985 as an aesthetician and approximately $300 selling beauty products.  Client has approximately $48,000 in credit card debt as a result of her lack of a steady income.  Client's debt is also due to high chiropractor and dental expenses.  Client unsuccessfully tried to negotiate with her creditors before falling behind on her payments.  Client is now delinquent on bills and seeks relief from her creditors by filing for bankruptcy.  Client owns no property, currently rents a room in her brother's home, and has very few belongings.  Client is seeking assistance with a no-asset Chapter 7 Bankruptcy petition.

Client is a 33 year old woman who is HIV+ and also disabled from osteoarthritis.  She was referred by her primary care physician to an ob-gyn in Fullerton.  After an intake by a nurse who took a history including HIV status, the physician walked into the room and stated that she would not examine the client and stated that "I really don't know why they are sending you guys here."  Client left with no exam and in tears. She seeks the assistance of pro bono counsel to advise her of her rights.

He served eight years in prison for attempted murder. Before his imprisonment, client visited daughter regularly. While client was in prison, the biological mother of the minor died and the maternal grandparents obtained guardianship of their granddaughter. The maternal grandparents will probably oppose client's bid for visitation with his daughter.

Client is an 80 year old man. In 2006, he co-signed with his son on a lease for an apartment. Client paid the monthly rent for his son, but never resided in the apartment. In 2009, client told his son that he needed to find a less expensive place to live and gave notice of son's intention to vacate the apartment. Client paid an early lease termination fee to the property management company on behalf of his son.  Son held over, and was evicted by the property management company in February 2010. Shortly thereafter, son attempted to murder client and is now in jail. Apartment complex is pursuing client for legal fees for the eviction and for rent during the period that son held over. Client would like an attorney to help him negotiate with the apartment complex.

Monolingual Spanish speaking widow seeks assistance of pro bono counsel in clearing title and negotiating with the lender on her home. Client was married to her husband for 22 years. Husband died in 2005, but no will existed and no administration of estate occurred. During marriage client and husband purchased a piece of property which was refinanced over time and in which client continues to live. Both client and husband are on title, but only husband is on the loan. Lender has not been notified of husband's death. Lender has imposed insurance on property and refuses to communicate with client. PLC can provide a translator if necessary.

Loan Modification, PLC 10-1017696
Client and her husband refinanced their loan in 2006, into an Option ARM.  Their current servicer has only offered a repayment plan, which they cannot afford.  Clients had a sale date scheduled for February 2009, but it has been postponed for over a year now.  Clients owe significantly more than what their house is worth, but are determined to keep their house and would like assistance negotiating with their servicer for a loan modification.
Deadline:  Clients have a sale date pending the first week of June.

Predatory Lending, PLC 10-1017727

Client is a 51 year old female whose only source of income is worker's compensation.  Client's second mortgage foreclosed on her property in 2007.  The third parties that purchased the home allegedly forged client's signature on short sale documents with the first mortgage.  Client notified the first mortgage of the forgery.  The first mortgage agreed to consider renegotiating client's mortgage if she could get title back in her name.  Client negotiated with the third party buyer and he transferred title back to her name in 2008.  However, the day after title was transferred back into her name, the first mortgage sold client's home at a foreclosure sale.  Client filed a lawsuit in December 2008, after she was served with an unlawful detainer, alleging various claims, including unfair business practices, consumer fraud and quiet title.  Client had an attorney, but had to let him go due to her inability to pay.  Client would like assistance pursuing her claims against the first mortgage holder and the third party buyer, among others.  Next Court Date: Status Conference on July 29, 2010.

Clients are a wife and husband, 84 and 67 years old respectively.  The wife has been living in the home since 1960.  In 2006, a broker cold-called once a week for six weeks until he was finally invited to the clients' home.  The broker convinced the clients to refinance their reverse mortgage.  At this time, they had substantial equity in their home.  The husband was heavily medicated and in a wheelchair at the meeting.  The clients were not working at this time and their sole source of income was from social security benefits.  The broker told the clients that they could get back into a reverse mortgage after a few years, which was clearly not the case.  The clients now only have a few months worth of mortgage payments left in their savings and are afraid of losing their home.  Clients may have several claims under California State Law against the broker and their lender, including financial elder abuse.  The statute of limitations for clients' state claims will expire by June 2010.  PLC would be willing to co-counsel on this case.

Mobile Homes, PLC 09-1017002
Client has resided in a Santa Ana mobile home park for five years and owns her mobile home outright.  Client states that the mobile home park is responsible for maintaining the grounds, but that they have fallen into disrepair. The mobile home park has also substantially increased each resident's space rent. Client would like an attorney to determine her rights and remedies against the park.

Client seeks to apply for a U visa for herself and her two minor children.  PLC can provide an interpreter if necessary.

Landlord/Tenant - Commercial lease, PLC 10-1018220
Client is a single mother who operates a child care facility in a space she has rented from a school district in Orange County for the past 12 years.  In March 2010, client started advertising the child care by placing flyers on cars parked in the school's parking lot.  The school district asked client to stop this practice immediately and client complied.  In May 2010, she received two notices:  a three day notice to pay or quit, and a 30 day notice to vacate.  Client fell behind on the rent, but since she received the notice to pay or quit she has been paying the back due rent in installments and is nearly caught up.  Client is worried that she received the 30 day notice because the school district is trying to evict her based on her advertising her business on the cars parked in the parking lot.  Client would like an attorney to help her negotiate with the school district to allow her to continue renting the facility where she presently operates her business.

Landlord/Tenant - Habitability, PLC 10-1017904
Client receives federal subsidized housing benefits. In 2002, client moved into an apartment in the complex where she presently resides. Throughout her tenancy, client has reported cockroach, rat, and termite infestations to the property management company. She also reported a leak in the bathroom which resulted in warped cabinetry, drywall deterioration, and mold. Additionally, she reported that the ventilation ducts were broken and emitting dust. Client states that the property management company failed to address some of these problems and inadequately addressed others. Client would like an attorney to help her negotiate with landlord to address these habitability issues.

Landlord/Tenant - Security Deposit, PLC 10-107872
Client sought housing for herself and her mother. Client placed an ad on Craigslist. Landlord responded to the ad and offered to rent two rooms in her house to client. Client paid the landlord $200. Client believed this amount was for the security deposit. Landlord gave her a signed, handwritten receipt worded "a security deposit to hold the rooms." Landlord and client proceeded to negotiate the terms of the tenancy, but were unable to come to an agreement. Client never moved into the rooms and asked landlord to return the $200. Landlord refused because she considered the payment a "holding deposit." Client is in dire financial circumstances and living in a motel. She would like an attorney to help her negotiate with the landlord for the return of the deposit.

Client is a 29 year old female client who speaks English fluently.  Client was trafficked into the United States to work as a nanny and housekeeper for a family living in Orange County.  Client was forced to work seven days a week for 16 to 18 hours every day with no breaks and no overtime compensation.  Client is in the process of applying for a T Visa to obtain legal immigration status.  Client seeks to file a tort suit for wage and hour violations, amongst other statutory remedies.

Client is a 33 year old woman who is HIV+ and also disabled from osteoarthritis.  She was referred by her primary care physician to an ob-gyn in Fullerton.  After an intake by a nurse who took a history including HIV status, the physician walked into the room and declared that she would not examine the client, stating "I really don't know why they are sending you guys here."  Client left with no exam and in tears.  Client would like the assistance of a pro bono attorney to discuss her options and possibly file suit for discrimination.

Both client and husband are on title, but only husband is on the loan. Lender has not been notified of husband's death.
