Client is a 30 year old woman who would like to modify or establish custody, visitation, and child support with each of the fathers of her two children. One child is 10 years of age and client wants to modify custody/visitation/child support orders from 2001. The other child is three and client wants to file a petition to establish a parental relationship and establish orders for that child.

Twenty-eight year old client seeks help obtaining visitation with his 13 year old daughter. Client was incarcerated when his daughter was two years old. He served eight years in prison for attempted murder. Before his imprisonment, client visited daughter regularly. While client was in prison, the biological mother of the minor died and the maternal grandparents obtained guardianship of their granddaughter. The maternal grandparents will probably oppose client's bid for visitation with his daughter.

Client purchased a pre-owned car with a five year warranty from a dealer in October 2004.  Client experienced stalling problems and noises and tried to have the dealer repair the car.  Client believes that she paid for repairs that should have been covered by the warranty.  The car is now inoperable and stored at repair shop.  Client owes less than $1,000 on the car.  She seeks attorney assistance to try and recoup the money she has spent on the vehicle.

Broker Liability, PLC 10-1017646
Clients are a Vietnamese couple in their 40s. The wife speaks very little English and does not read English well. The husband speaks some English, but also does not read English well.  In 2007, a real estate broker assisted clients with a short sale of their home, because they were told this was better than letting the property go through foreclosure.  Clients were very concerned about being responsible for the second mortgage, and asked the broker directly about their liability. The broker explicitly stated that they would not be liable for any deficiency from the second mortgage, despite the fact that the agreement stated in bold "...the bank will release the lien and charge off the remaining debt as a collectable balance."  In August 2009, a collection agency filed a lawsuit against clients to collect on the second mortgage.  Clients would like assistance with claims they have against the broker who assisted them with the short sale.

Fair Credit Reporting Act, PLC 09-1015644
A judgment was obtained by a law firm representing two private individuals. Client partially satisfied this judgment in September 2005, but the attorney continued to report that client owes the full amount to the credit reporting agencies. This incorrect tradeline has negatively affected client's ability to obtain new credit. Client seeks assistance in correcting her credit report.

Collections, PLC 10-1018165
Client is an 80 year old man. In 2006, he co-signed with his son on a lease for an apartment. Client paid the monthly rent for his son, but never resided in the apartment. In 2009, client told his son that he needed to find a less expensive place to live and gave notice of son's intention to vacate the apartment. Client paid an early lease termination fee to the property management company on behalf of his son.  Son held over, and was evicted by the property management company in February 2010. Shortly thereafter, son attempted to murder client and is now in jail. Apartment complex is pursuing client for legal fees for the eviction and for rent during the period that son held over. Client would like an attorney to help him negotiate with the apartment complex.
 
Collections, PLC 09-1016849
Client is a 55 year old female.  She purchased a pharmacy management system in July 2008 and agreed to pay a monthly license and support fee.  The contract stated that client will be trained on how to use system.  Client ceased making monthly license payments because training was not provided and system did not work properly.  Client would like assistance in recovering the monthly fees paid and reducing the monthly fee.

Client had a default judgment entered against him on November 6, 2009. Client missed payments on a motorcycle due to unemployment. He is now employed and would like assistance in reinstating his contract and avoiding a wage garnishment.
 
Property Lien, PLC 09-1016936
Monolingual Spanish speaking client seeks help lifting a lien placed on her property by a bail bond company.  She offered her house as collateral for her son's bail.  The bail was exonerated but the lien is still on the property.  Apparently, the bail bond company charged client for an ankle monitoring device.  These devices are usually issued by the state.  When PLC challenged this, a representative of the company said that he would release the lien by the end of November 2009, but has failed to do so.  Client plans to refinance her home and is unable to with the lien on her property. PLC can provide an interpreter if necessary.
 
DISABILITY RIGHTS
Personal Rights/HIPAA Violation, PLC 10-1017359
Client is an extremely poor 55 year old monolingual Latina.  She has HIV/AIDS.  Client was brought to a local ER by a friend because she had a pulmonary infection.  At the ER, the hospital translator informed client's friend that she has HIV/AIDS.  Client seeks assistance in filing an administrative claim for HIPAA violation.

Client is an 86 year old English speaking man who 1) would like to be reunited with his spouse and 2) believes his wife's daughter (his step-daughter) took money from his bank account and sold his cars without his consent and then pocketed the profit. He and his spouse retired to Hawaii where his spouse suffered a stroke. Spouse's daughter took her recovering mother to Colorado to take care of her. Client moved back to California and presently resides in a retirement home near his son. Client asked his step-daughter if she would send her mother to California so client and spouse could live in the same retirement home.  Step-daughter does not answer client's requests and client feels step-daughter prevents him from speaking with his wife.

Clients are a wife and husband, 84 and 67 years old respectively. The wife has been living in the home since 1960. In 2006, a broker cold-called once a week for six weeks until he was finally invited to the clients' home. The broker convinced the clients to refinance their reverse mortgage. At this time, they had substantial equity in their home The husband was heavily medicated and in a wheelchair at the meeting. The clients were not working at this time and their sole source of income was from social security benefits. The broker told the clients that they could get back into a reverse mortgage after a few years, which was clearly not the case. The clients now only have a few months worth of mortgage payments left in their savings and are afraid of losing their home. Clients may have several claims under California State Law against the broker and their lender, including financial elder abuse. The statute of limitations for clients' state claims will expire by June 2010. PLC would be willing to co-counsel on this case.

Employment Discrimination, PLC 09-1016773
Client is living with HIV/AIDS, as well as vitiligo, which is a disfiguring condition affecting client's pigmentation. Client had been employed as a food server for three years, when an incident at work led to his dismissal. Client states that another employee at work grabbed client around the neck and pushed him to the ground, breaking the skin on client's lip. The employee made obscene comments to client. Employee then accused client of sexual harassment and an investigation by human resources resulted in client's dismissal. Client states that there was a witness to this incident and that it was captured on video. Client seeks legal counsel to discuss his rights and explore any legal remedies.

Client received a Notice of Default in September 2009. This case is time sensitive since client might receive a Notice of Trustee's Sale soon. Client is a 61 year old female and has been living in her home for the past 17 years. She is about seven months behind in her mortgage payments and is currently unemployed. Client was previously employed at the same company for 23 years before being laid off. Now, client's only source of income is unemployment at $1,824 per month. Client applied for a loan modification and was denied based on income. Client is desperate to keep her home and will be trying to get renters to increase her income. She believes she may be able to get one or two renters to pay $500 each. Client's current monthly mortgage is $1415.  Client would like the assistance of someone to advocate on her behalf for another loan modification application.

Client is current on her mortgage. Client is a 78 year old female, whose source of income is social security of $1,657 per month. Client's son used to assist her with making her mortgage payments when he could, but he recently became unemployed. Client's daughter will soon be moving in to assist with expenses and expects to contribute about $2,000 each month to the household. Client's current monthly mortgage is $1,857. Client does have around $165,000 in equity. Client had been using her savings to pay her monthly mortgage payments, but her savings has run out.. Client is in desperate need of assistance in submitting a loan modification application to avoid foreclosure.

Client is current on mortgage payments. Client is 55 years old and self employed. Client has a yearly income of about $22,000. Client and his wife recently separated. Client's other source of income is from two rental properties totaling $4,700 monthly, although his wife currently lives in one of the properties and is paying the monthly mortgage. One of the client's rental properties is paid in full. Client's current monthly mortgage is $2,175. Client's wife is no longer assisting with expenses since they have separated and client would like to apply for a loan modification to hopefully reduce his monthly mortgage payment.

Clients are three months behind on their mortgage payments and have not received a Notice of Default.  Wife lost her job in April of 2009 and is currently receiving disability benefits.  Husband is employed full time.  Clients' total monthly income is around $9,790.  Clients' current monthly mortgage payment is $3,002.  Clients have previously applied for a loan modification but were denied because of their high debt.  Clients filed bankruptcy and tried to apply for another loan modification but were denied because the investor did not find that they had a good cause for hardship.  Clients do not have the denial in writing.  Clients are in desperate need of assistance and would like to avoid foreclosure.  Clients require assistance with a loan modification application.

Client and her husband refinanced their loan in 2006, into an Option ARM.  Their current servicer has only offered a repayment plan, which they cannot afford.  Client had a sale date scheduled for February 2009, but it has been postponed for over a year now.  Clients owe significantly more than what their house is worth, but are determined to keep their house and would like assistance negotiating with their servicer for a loan modification.

Client's home was sold at trustee's sale in May 2009. Client has since been evicted from his property and is now homeless. Client may have some potential claims against his lender for wrongful foreclosure which would allow him to recover some damages. PLC is looking for an experienced real estate attorney who would be willing to examine the facts of the case to determine if there is a viable lawsuit, and then possibly litigate the case if there is something there.

Mobile Homes, PLC 09-1016608
Client has resided in a Costa Mesa mobile home park for 11 years. Client alleges that the park management continually harasses the residents, including entering residents' homes without permission, instituting rules such as forbidding children to play in certain common areas of the park, and failing to give notice of water shut-offs. Client states that a majority of the residents have complained to the park management about their practices and about how the park has fallen into disrepair, yet the park refuses to address any of these issues. Client would like an attorney to assess her rights and remedies against the mobile home park.

Client has resided in a Santa Ana mobile home park for five years and owns her mobile home outright.  Client states that the mobile home park is responsible for maintaining the grounds, but that they have fallen into disrepair. The mobile home park has also substantially increased each resident's space rent. Client would like an attorney to determine her rights and remedies against the park.

Client gave landlord notice of her intention to move out several days after she moved in. The apartment was uninhabitable--it was infested with roaches, had a broken heater, and the neighbors made living there impossible. Although the client was able to move in to an apartment in another complex, she was homeless for several days. Client contends that she is owed some of her rent/security deposit from the landlord in addition to miscellaneous fees (including storage fees, moving fees, hotel costs and lost wages). Client would like an attorney to help her negotiate with the landlord so that she can recoup her losses.

Client receives federal subsidized housing benefits. In 2002, client moved into an apartment in the complex where she presently resides. Throughout her tenancy, client has reported cockroach, rat, and termite infestations to the property management company. She also reported a leak in the bathroom which resulted in warped cabinetry, drywall deterioration, and mold. Additionally, she reported that the ventilation ducts were broken and emitting dust. Client states that the property management company failed to address some of these problems and inadequately addressed others. Client would like an attorney to help her negotiate with landlord to address these habitability issues.

Client receives federal subsidized housing benefits. Client moved into an apartment in 2006 and paid a $500 security deposit. Client moved out in 2009. Landlord refunded her $140 from her deposit. Client disputes this amount and believes landlord charged client for items that should be considered normal wear and tear. Client would like an attorney to help her negotiate with landlord to return her security deposit.

Client sought housing for herself and her mother. Client placed an ad on Craigslist. Landlord responded to the ad and offered to rent two rooms in her house to client. Client paid the landlord $200. Client believed this amount was for the security deposit. Landlord gave her a signed, handwritten receipt worded "a security deposit to hold the rooms." Landlord and client proceeded to negotiate the terms of the tenancy, but were unable to come to an agreement. Client never moved into the rooms and asked landlord to return the $200. Landlord refused because she considered the payment a "holding deposit." Client is in dire financial circumstances and living in a motel. She would like an attorney to help her negotiate with the landlord for the return of the deposit.
