NYC CARRIAGE HORSES AND THE HEAT
how this arcane, bizarre and ineffective law "works" in NYC
NYC is suffering from one of its worst Julys on record. June had a few days in the 90s but since the beginning of July, it has been very hot and many days have gone well over 90. This is how the law works for the carriage horses. It does not make sense.
- the carriage drivers are supposed to be sent back to their stables when it reaches 90 degrees. Humidity is not a factor
- It is only the ASPCA's Humane Law Enforcement officers who can make the temperature determination by using a special so called "state-of-the-art" thermometer that only they possess.
- It is not clear if the Department of Health is also charged with enforcing this law and when, who and how they would do it.
- If the officers are not available, which they have not been on a few occasions, the law is not enforced and the drivers can continue to work. No one else is designated by the Department of Health to enforce this law. The officers were MIA on Sunday, July 11th when it was in the mid 90s and in the early evening of July 16th when again it was over 90. There were other days as well when they were not available to enforce the law. There are only 17 officers with one dedicated to the carriage horse issue.
- If the trade is suspended at 12:15 PM (for example) it is not clear who lifts the suspension or how it is done.
- When still over 90 degrees (from other sources) many drivers have been seen working. This is usually their second shift -- after 5:00 PM.
- The ASPCA has been called and when available (not always) they have returned to the hack line and ordered the drivers back to the stables.
- If the drivers need the force of an ASPCA officer to determine the temperature - since they cannot figure it out for themselves -- then how can they determine it is under 90 degrees when they return in the early evening - or do they just not care.
This is a bad system that clearly does not work. Because so many days have been in the 90s this summer, we were able to see the ASPCA in action. The ASPCA would like you to contact them with reports of violations. But they either do nothing or very little with this information. Yet, they are part of the official system. If the horse is involved, the 4-digit ID number is on the left front hoof.
For now, we are addressing this issue in other ways. We do not believe the ASPCA has done or can adequately do this job. They have also advised their people to ignore me, which is petty and shows their lack of professionalism
Remember -- I reported to the ASPCA that Bobby (the rescued carriage horse) was being double shifted as far back as January and nothing was done. After he was rescued, it was found that Bobby had lots of worms, terribly scarred face, very sharp teeth and was lame in his front right leg. Why didn't the ASPCA notice this neglect? They are outraged at me because I have called them publicly on this. A classic case of David and Goliath.
WHAT CAN YOU DO?

It is a challenge to know what to do any more. The most important thing is that you must not allow any of the elected representatives to assume you have given up on this issue. The City Council with its 51 Council Members has little power. However, it is OK to continue to let them know that you want to see the carriage industry end -- after all, they should hear from their constituents. But all the power lies with the Council Speaker, Christine Quinn, so I ask you to reach out to her in a polite way. A majority of council members could sign on to Intro 86, but if Quinn does not support it, it will go no where. She calls the shots. She decides what bills will come up for a vote and which ones will be supported.
Nevertheless, she needs to know that there are people out there who want to see this industry end. It is inhumane for the horses, but also a safety issue for people. In addition, if the classic cars became a reality, the drivers would have better paying and more secure jobs. How can she be opposed to that?

You can address such issues as the industry being a blot on NYC's image; how Central Park South smells very badly; how it is inherently inhumane; how it is dangerous and an accident waiting to happen. Because of their size and physiology, horses are unwitting weapons. They can spook easily and cause a lot of damage. Recently, an accident in Iowa involving carriage horses resulted in the death of one woman and injuries to 25 others.
If you do not live in NYC, say that you will not visit the city - or how you have avoided the area if you have visited. Also say that the new legislation did not do anything to help the horses - that it was mainly about giving the drivers a raise. Horses are still deprived of water in Central Park in the winter months and their stalls are less than half of what experts suggest.
THE MEDIA REPORTS OUR HEAT PROTEST

NEW YORK (1010 WINS) -- July 22, 2010 -- Animal activists gathered near Central Park to
protest the use of horse-drawn carriages during the July heat wave.
Advocates from the group "Friends of Animals" say carriage drivers have
been breaking the law during the recent string of days with temperatures
above 90 degrees.
The group has also filmed drivers operating the carriages in the hot
weather and posted them on their YouTube page.
The protesters say the carriage horses are not legally allowed to be
working when the mercury is above the 90 degree mark, but they contend
drivers have been getting away with putting them to work.
The group says only ASPCA officers have access to special thermometers to
make the determination if the carriages can continue to operate. However,
the fact that no other city agency has access to the instrument, makes the
policing untenable, advocates say.
"Horses do much worse than people in the hot weather," Elizabeth Forel of
the Coalition to Ban Horse-Drawn Carriages told 1010 WINS reporter Mona
Rivera, "the asphalt is much hotter than the ambient temperature."
However, one carriage driver told Rivera that the horses have been taken
care of during the heat wave.
"Everyday since the temperature [went] up above 90, [the horses] have been
all going home back to the stables," the driver said.
The group also makes mention of an incident on July 16 in which ASPCA
officials had sent carriage horses to stables because of hot weather around
noon.
However, horses were seen later that day working in Central Park around
5:30 p.m. A "Friends of Animals" member alerted ASPCA officials who
arrived at the scene and again sent the horses to the stables.
The ASPCA released the following statement regarding the July 16 incident:
On July 16, 2010 the ASPCA Agent present in central park monitoring the
Carriage Horse operations in Central park suspended carriage horse
operations two times that day. Operations were suspended at or about noon,
when the temperature reached 90. After 3 PM the temperature dropped below
90. The ASPCA re-suspended carriage Horse operations (a second suspension
that day by the ASPCA) at or about 6:16 PM.

Victoria horse-drawn carriage accident caught on camera
Tourists who had just disembarked a cruise ship Monday evening for a horse-drawn carriage ride along Dallas Road got a scare when the two horses spooked and galloped out of control down the road. The melee began when the trolley wheels made contact with the curb, causing the two horses pulling the carriage to bolt, said Sgt. Grant Hamilton, spokesman for Victoria police. One of the horses got tangled in the harness and fell, scraping its legs on the roadway. None of the people in the carriage was hurt.
