Background Checks for NJ Nonprofits
An Overview and Considerations
Many nonprofits struggle with the issue of whether to conduct background checks, especially in view of the cost. For nonprofits working with vulnerable populations, such as children, the elderly, and the mentally disabled, the impetus to conduct background checks is more compelling.
With the generous support of The Frances L. & Edwin L. Cummings Memorial Fund, the Pro Bono Partnership has prepared an article that briefly overviews the considerations nonprofits, particularly youth serving organizations, should weigh in deciding whether to conduct background checks, the options available, and the factors to consider when reviewing the results of a criminal history check. NJ Youth and Family Project
The Frances L. & Edwin L. Cummings Memorial Fund
has provided a grant to the Pro Bono Partnership to provide free business legal services to New Jersey nonprofit organizations serving youth and families in Bergen, Essex, Hudson, Passaic and Union Counties.
As part of this project, the Partnership administered a state-wide survey to determine the legal issues of greatest concern to such agencies. The results, in priority order, were the following:
- Confidentiality and privacy
- Employment issues, in general
- Financial checks and balances procedures
- Financial reporting requirements
- Employee/volunteer screening or background checking
- Website and social media policies
- Liability of and for volunteers
- Hiring and firing
- Compensation, overtime and exempt/non-exempt classification issues
- Employee evaluation and discipline
- Parental consents, permissions and waivers
- Ensuring safety and security of facilities
- Liability of officers and directors
- Conflict of interest policies
- New Jersey and/or multi-state charitable regulations
- Reporting child abuse
In response, the Partnership will be providing a number of workshops and teleconferences addressing many of these issues, as well as online publications and legal alerts. This is the first such legal alert.

Pro Bono Partnership

The Pro Bono Partnership provides pro bono business legal services to nonprofit agencies in Connecticut, New Jersey and New York, in the belief that the knowledge and application of sound legal practices make nonprofit organizations more effective and better able to focus their resources on supplying vital services. Substantially leveraging the impact of our in-house legal staff, the Partnership annually recruits and mobilizes hundreds of attorneys from major corporations and law firms to donate time and expertise on behalf of its nonprofit clients, enhancing their ability to improve conditions in their communities, particularly for the poor and vulnerable.
