ABCs of Nonprofit Law

This important workshop is an overview of the key legal issues for nonprofit organizations, including board roles and responsibilities, proper state and federal filing requirements, sound corporate governance, political and lobbying activities, fundraising and revenue generating issues, and much more.
 
Topics will include:   
  • What are the important state and federal rules that apply to nonprofit tax-exempt organizations?? 
  • Do your board members understand all of their legal and fiduciary obligations? When can board members be sued? 
  • Does your organization have sound and legal employment law practices?
  • How can you protect your organization from employment-related lawsuits, while treating your employees fairly?
  • Is your organization submitting all of its required IRS and state-required filings and reports?  What happens if you are not doing so? 
  • Can your organization engage in lobbying? Political activities? What's the difference? And what happens if you violate IRS laws?

Evaluations and Terminations
 

This important workshop will describe how a nonprofit employer should evaluate and provide feedback to its employees, including progressive discipline procedures.  The workshop will also discuss the careful analysis that must be used if a nonprofit needs to terminate an employee for any reason and the steps to use in implementing the termination.  

 
Topics will include: 

  • Does your organization provide regular, ongoing feedback to its employees?
  • Does your organization have personnel policies? Are they followed?
  • Does your organization have evaluation and progressive discipline procedures? Are they followed?
  • Has your organization ever had to terminate an employee?

Wage and Hour Issues for NJ Nonprofit Employers
 
This workshop will discuss the factors to be considered in determining how to properly classify employees as exempt or non-exempt, and the consequences of these classifications. The workshop will also discuss overtime issues and allowable wage deductions.
 
Topics will include: 
  • Does your organization need guidance in determining how employees should be classified? 
  • Do you sometimes struggle with issues of how and when your organization is required to pay overtime? 
  • Are you implementing wage reductions and furloughs in a manner that does not violate wage-hour laws?
