| Writing Better Reports |
Newton Medical Group clinicans gathered for a Saturday seminar on November 1st, to hear three different perspectives on how to conduct AMA Guides, 5th Edition Impairment Ratings. The speakers were Mr. Bradley Chalk, Ms. Jennifer Callan, and Ms. Annalisa Faina. I'd like to take this public opportunity to thank them for a superb job.
Mr. Chalk presented the work of the CAAA on the subject, and even if you don't agree with all - or any - of their positions, they are to be congratulated on some diligent and thoughtful advocacy. I am sure that The AMA Guides, 5th Edition has never been subjected to such minute scrutiny and thorough analysis, not only line by line but literally word by word. The result has been a somewhat controversial approach including rating "by analogy" and rating by "loss of pre-injury functional capacity". Additionally there is an expanded list of "compensable consequences" or as I prefer to call them "derivative problems" such as Sleep and Arousal Disorders, Urogenital Dysfunction, Cognitive and GI side effects of medication, and the more well known Psychiatric considerations.
Ms. Callan presented the Defense attorney's view which takes a more narrow approach that favors a literal interpretation. The compensable consequence issues were described as efforts to run up a rating (whereas the Applicant Attorneys see it as doing their duty to obtain a "comprehensive" assessment.
Ms. Faina clued us in on how the Rating Bureau actually is handling some of these matters. The somewhat arcane nature of the WPI in California was explained, along with examples of how omnibus ratings from doctors get deconstructed to allow for Age, Occupation, and DEC adjustments before being "reconstructed."
So, what is the AME to do in a situation such as this wherein the waters are truly unchartered? Well we went ahead and solicited input from some of our referral sources on "The biggest mistakes AMEs make" and on "What are the things that the Judge and others look for in a report that make it stand out as high caliber AME?" Some informative and very helpful replies were received, and then distributed to all of our doctors. It was reassuring to learn that many of the recommendations are already in use at Newton Medical Group. Some of the better suggestions will be digested further and incorporated into our reports.
I ask then for three things from you as one of our valued referral sources. First is your forbearance as we navigate the turbulent currents and try to find an AME approach of our own. Writing AMA Guides "compliant" reports has been a challenge for those of us steeped in the 1997 PDRS (and its earlier incantations), and we are all on a learning curve. I assure you that even a graybeard such as myself (well figuratively anyway since I've shaved my beard off), is evolving.
My reporting today is quite different than it was a year ago and will likely continue to evolve in response to changes and/or elaboration in case law that affects the use of the Guides and other issues as well. The same is true for many of my colleagues at Newton Medical Group
So my second request is to give a second chance to any of our doctors whose reports failed to impress the first time around. It is hopefully clear that if nothing else we take our work and our mission seriously. We are steadfast in pursuing our goal of providing you with excellent reporting, not just from the handful of tried and true heavy-hitters, but from a full cadre of excellent clinicians working together in a multidisciplinary setting.

Moses Jacob, D.C. is a well-known and reputable chiropractic QME and AME*, who has been affiliated with Newton Medical Group since 1993.
Dr. Jacob graduated from Rutgers University in 1972 and obtained his D.C. at Cleveland Chiropractic College in Los Angeles, CA in 1976.
In 1978, he opened his private practice in Novato. He still maintains a private practice including the care and management of industrial and non-industrial related injuries. Dr. Jacob was introduced to Workers' Comp in the early 1980s and has been a part of the industry since. He has built his reputation on honesty, integrity and straight forwardness. He has been providing AME quality reports since the 90s.
Dr. Jacob provides conservative chiropractic care for musculoskeletal spinal and extremity joint problems. His expertise also covers low back and other spinal disc conditions; also for Temporomandibular joint (TMJ) dysfunctions, as interdisciplinary treatment in conjunction with dentists and orthodontists. He also conducts independent chiropractic consultations for other clinicians as well as QME related examinations.
Through Newton Medical Group, Dr. Jacob evaluates patients in Sacramento, San Jose and Oakland. He works closely with both Applicant and Defense attorneys in all these jurisdictions.
Dr. Jacob is actively involved with the California Chiropractic Association. He has served on the Ethics Committee, the Guidelines Committee, and the Workers' Comp Committee for the past 5 years.

| The Specialty of Chiropractic in Workers' Comp |
The Chiropractic Intake: During the initial visit, chiropractors typically take a comprehensive health history and perform a physical examination, with a special emphasis on the spine. If needed non-spinal joint disorders are also evaluated. Other examinations or tests such as x-rays may also be performed. Once determined that chiropractic treatment is considered appropriate, a treatment plan and course of therapy will be developed.
Typical problems: Low-back pain, neck pain, and headache are common conditions for which injured workers seek chiropractic treatment. Combining chiropractic services with conventional medical treatments help injured workers who have chronic, pain-related health conditions.
QME/AME Evaluations at Newton Medical Group: These are conducted in a manner similar to that of Orthopedics and Physical Medical & Rehabilitation. Tests such as x-rays, MRIs and/or EMGs may be obtained.
