Bye-bye Crawford Defense Claims?
A 2006 update to the Civil Code rendered certain indemnity provisions in residential construction contracts unenforceable in California, but the Supreme Court breathed new life into indemnity law with the 2008 Crawford decision. A further statutory update for commercial construction contracts that takes effect in January 2013 arguably conflicts with Crawford. This may prompt a further look at how risk-sharing and risk-transfer claims will be adjudicated in the near future. Click here to read more. |
Supreme Court Watch
In the much-watched case of DiCampli-Montz v. County of Santa Clara (Case No. S194501), the California Supreme Court had scheduled oral argument for September 6, 2012. However, Appellant has requested that oral argument be rescheduled to a later date.
The issue in DiCampli-Montz is whether a Notice of Intent under Code of Civil Procedure � 364 delivered to a county hospital's risk management department substantially complies with the requirement under Government Code � 915 that a claim be presented to a public entity before filing suit.
