Happy New Year!
As we embark upon 2012, we wish to highlight some new developments in California law. Please let us know if you have any questions or want to learn more.
First, California's summary judgment statute has been amended to let parties stipulate to claims or defenses they want the court to adjudicate as a matter of law. It remains to be seen how much courts will allow this motion, but it could be a good way to streamline litigation.
Also, California's jury selection statute now allows attorneys to question prospective jurors in more detail after the judge is finished questioning them on a particular subject. Judges will still control the trial, but attorneys will have an opportunity to conduct a more meaningful voir dire.
Lastly, look for the courts to find new ways to supplement their dwindling budgets. The Judicial Council is considering the imposition of "appearance" fees for attending routine status conferences, among other things.
