New DUI Laws In Effect January 1st

Those busted for drunk driving will face new, stiffer penalties under Nebraska law.

 

Among the changes, procuring alcohol for a minor becomes a felony if there's a fatal crash involved. And first-time D.U.I. offenders would either have their license revoked for several months or, if they qualify, be allowed to drive only with an ignition interlock device.

"I think the message is that no drinking and driving will be tolerated by the law. The legislature's enacted stiff penalties to punish those people," said Sarpy County Judge Jeffrey Funke.

 

Funke told Channel 6 News he hopes the law makes a dent in the repeat offenders which appear so often before him.

 

Omaha Police Sergeant Tony Gutierrez said the changes won't impact patrols immediately. But within a month or so, they'll begin to see those first offenders who are required to use the ignition interlock.

"What we want people to understand," he said, "is if you say, drive a friend's car and you're required to have an interlock device, and you drive a car without one, you could be charged with a Class IV felony."

Funke added, there are enhanced penalties for repeat offenders including ankle bracelets for third time offenders or higher. The bracelets monitor blood alcohol level and notifies the court if an offender is in violation.

 

Drinking and driving with children, 16 or younger, becomes an offense for the first time - a misdemeanor. "It encourages people not to put their children at risk," Funke said.

 

He and others in the judicial system have a 10-page cheat sheet on the changes. "It's challenging for judges, prosecutors, defense attorneys," he said of all the changes that come down to the unicameral each year.

"But I think the changes are necessary to address the problems sooner, to make a bigger impact right away."

 

Gutierrez added, "We're hoping that we have safer drivers on the road. That's the long-term goal. Time will tell if that's what actually takes place."

Responsible Beverage Server Training Provides Tool to Businesses for Preventing Impaired Driving

 

TiPS (Training for Intervention ProcedureS) is the global leader in education and training for the responsible service, sale and consumption of alcohol. Proven effective by third-party studies, TiPS is a skills-based training program that is designed to prevent intoxication, underage drinking and drunk driving.

 

In April, 2010, the City Council of Nebraska City passed an ordinance requiring all liquor license holders and their employees to pass a state approved Beverage Server Training course. TiPS is certified by the Nebraska State Liquor Control Commission, and meets all standards applied by the Nebraska City ordinance.

 

Partners for Otoe County certified trainers in the TiPS program to help local businesses comply with the new ordinance.   

 

Since that time, 188 employees from 21 businesses have successfully completed the TiPS course and received a 3-year certification, including employees from:

The Lied Lodge has trained 69 employees through TiPS, more than any other business.  Celeste Hudson, Food and Beverage Manager, Lied Lodge & Conference Center says "TiPS has been good for our business and guest safety is our top priority.  We don't allow anyone to work here unless they are certified.  It gives staff pride in knowing that they are doing the right thing.  We are 100% in compliance!" 

 

Persons interested registering for TiPS training or receiving more information can call Laurie at 873-6343, email p4ocnews@gmail.com, or visit our website.  A five-hour class is offered for on-sale certification. For off-sale retailers, a shorter 2 1/2 hour class is offered.  Cost is $20 per person and  a minimum of four persons must register for the class to be held.  Special "work site" classes can be arranged at your business for groups of 10 or more with a registration fee of $20 per person to cover the cost of materials.  The cost of TiPS training is subsidized through a Strategic Prevention Framework State Incentive Grant from the Nebraska Department of Health and Human Services.

This needs to be passed around to everyone who has the keys to a vehicle. This is perhaps one of the most intense commercials that I've ever seen and damn well made.  
 
I think that Australia should be complemented on having the guts to "tell it like it is" and get this campaign out to all of its licensed drivers and to air it on TV...it is very moving and very life like...it has a very strong impact.

The Southeast Nebraska Alzheimer's Support Group, in conjunction with the Alzheimer's Association Great Plains Chapter of Lincoln NE, will host a monthly meeting on the third Monday of every month at the Morton-James Public Library's community room starting February 20th from 2:00-3:30.  The support group is an open gathering of people with common problems, needs and interests who come together to share their feelings, thoughts and experiences to better cope with and manage the shared problems of dementia.   Darcy Carpenter is the facilitator for the meetings.  Darcy received formal training for this role from the Alzheimer's Association in December 2011.  As part of her on-going training, she is required to attend a yearly training session as well as attend at least two educational programs per year supported by the Great Plains Chapter.  Darcy can be reached  at (402)-873-0601 or toll free (888) 773-0605 for further information.
