The Oklahoma State Legislature has recently enacted sweeping reform for the recovery of damages for personal injury in many civil actions. This new legislation becomes effective November 1, 2011.   

Under these changes, noneconomic damage awards in any civil action arising from a claimed bodily injury are now capped at a maximum of $350,000.  

Damage awards that result from intentional and malicious behavior will not be affected by this damages cap.

Furthermore, this Act allows Defendants to pay damage awards over a period of up to seven years. The Act also reduces the amount of recoverable damages for uninsured Plaintiffs by up to 50%. Various other changes will occur regarding the tax treatment of personal injury damage awards and the calculation of actual medical damages.
