Social Media
Risks and Benefits of Social Media to your business
Social MediaMarketing, interviewing for job placement, and connecting with new and old friends; Social networking can be good when used effectively, however, business owners should take notice that there are liabilities involved when allowing access to social media websites at your business.

A recent case out of Minnesota showed some limitation to employer liability, when a patient sued a clinic for invasion of privacy when a clinic staff member created a MySpace page on the job, with the patient's picture, stating the patient cheated on her husband and had an STD.  In this case, the court considered the fact that MySpace was blocked at the clinic in finding no evidence that employer was involved.

Other issues under review in courts include:
  • Teachers creating and commenting on their own pages with students
  •  Management joining forums where bullying or harassing comments occur
  • Defamation based on online posts

So what are the solutions to these continuing problems and how can you be protected from liability?

  • Consult with a lawyer about developing a Social Media Policy.
  • Train upper management and employees - have a seminar concerning office policies and procedures (If your business does not have an HR department, an employment attorney can assist you).
  • Consult a lawyer at the beginning of a conflict.  Lawyers can help prevent a small problem from escalating.

Obama's Aunt faces Deportation

An immigration court granted asylum to President Obama's African aunt, allowing her to stay in the United States after facing deportation.  President Obama's aunt, a Kenya native and physically disabled, sought asylum due to violence in Kenya.
People who seek asylum must show that they face persecution in their homeland on the basis of religion, race, nationality, political opinion or membership in a social group. Her legality was first brought to light before the November 2008 election results.

Obama has stated he did not know his aunt was living here illegally and believes laws covering the situation should be followed. After the first appeal for asylum was rejected and reopen, different grounds were brought for the asylum case, and this time asylum was granted.
