Now that national health care reform is a reality, what do employers need to do? The attorneys at Mazaheri Law Firm will be holding a free one-hour seminar to address the key mandates that become effective over the next two to three years, providing the most up to date formal and informal guidance from Washington.  Please contact our office if you are interested in attending.

The national health care plan will be closely based on a system already set up in Massachusetts. For instance, many middle class households will be issued insurance credits for persons with household income between 133% and 400% of the Federal Poverty Level (only up to 300% in Massachusetts). Those curious about what kind of coverage they might receive and what the premiums may look like should check out the website for a unique perspective on some of the changes to come.

Negotiate your employment contract, severance package, and/or pre-nuptial agreement while you're still "in love"
 
 
Buck stops hereI recently attended a conference regarding negotiating high level executive contracts.The lawyer conducting the conference called himself the "champion for the overpriviledged" and lended us some great tips on negotiating executive contracts. 
 
This got me thinking...employment is very much like a marriage; you hold all the cards in the beginning, when you and your partner or employer are "in love."  Parties will be more apt to negotiate reasonably when they genuinely want to begin work with each other. 
 
Having also handled divorce and custody cases, not to mention complaints and employee disputes, the above rings true.  Some of the most difficult and emotional cases are those after a "break up" and you want to be sure that your expectations are clear and in writing before big changes affect your work environment or your relationship leaving things unmanageable.

Tips for dealing with contractors and adjustors
 
1. Make sure there's an indemnification clause on the contract. (Use a lawyer to negotiate this)
 
2. Take pictures that are date/timestamped, if possible.
 
3. Make sure you keep receipts of payments made to contract in case they have not paid their contract.
 
4. Insurance adjusters are visiting from other states so it's imperative you have all your documentation in place to get paid on your claim.
 
5.  Before you meet the adjustor, have your estimates ready. 
 
6. Before you meet the adjustor, have your roofer or heat and air contractor at your side if you can to assess the damages.
 
7.  If adjusters are giving you a hard time or denying your claim, call us or an attorney to help you negotiate.
 
 
Social Media may affect your case
 
1.  Have you checked your facebook, my space, or twitter page lately?  Everything from hiring, firing, and compensation of benefits is being determined through social media these days.  If you put it on the web, someone can access it.
 
2. If you have a social media account you should consider having your attorney look over it and advise you as to the content that should and/or can be recovered.
 
3.  Employers should have a social media policy and consider blocking certain websites especially if the business involves confidential information.  This could relieve employers from liability from leakage of confidential information.
